- A bench comprising Justice BV Nagarathna and Justice Augustine George Masih ruled that divorced Muslim women can file a petition under Section 125 of the Criminal Procedure Code (CrPC) as well as the Muslim Women (Protection on Divorce Act) 1986 to demand maintenance from their husbands. Will it help the cause of financial independence for a Muslim woman divorcee? Here's a viewpoint.

Mr. Zafar Sareshwala clarified that injustice is there to women. So, they are entitled for maintenance as per the law of land, Hence, the lady approached the court, as no justice was done to her.

Muslims should treat this as an isolated case and not protest against the judgement. The protests have only exacerbated the problems faced by Muslims and inadvertently aided their rivals.
Muslims are free to adhere to Islamic laws in their personal matters (99.99% doing so). Those who choose not to follow Islamic laws have the option to seek resolution through the courts. In such cases, both parties should respect the rulings of the judiciary. Importantly, accepting the verdict will prevents political parties from exploiting the situation.

Sareshwala does not listen to the moderator. What is his problem in providing legal protection to the Muslim women when the religious scholars and community do not implement the protections that Sharia provides.

No amount of Mehar can be substantial enough for any woman after divorce. This discussion is futile. Mehar is not intended for her sustenance or maintenance after divorce but serves as a token of the husband's financial responsibility towards his wife.

Her brother and father should be able to support her in this situation. I as a person does not want maintenance from the person who has divorced my daughter.
