    The funniest part is that Asmon is right, you don't have to be fully disabled to need a wheelchair. You still need one if you can only walk like 20 steps at a time before needing rest. He totally could have played it off lmao

      exactly, my friend's dad is like this: in a wheelchair but he can still kinda walk. First time i saw him walk though, i thought he was like the ultimate scammer "ey werent you in a wheelchair mistah"

      yea, i smashed my lower back up 5 years ago after a nasty fall at work. i can walk about 20mtrs before the pain becomes too much. so i use a wheel chair when i go out. but i can still walk round the house fairly easily. i also cant stand in one place for too long. my legs just give way.

    He absolutely could've played it off, man. I have spinal arthritis and occasionally use a wheelchair on days where I can't stand, but other days I can walk around fairly well. Asmon's 100% on the money there, there's a million excuses that could've been made if he just used his brain.

    There was a controversy here when bouncer threw out a disabled person in wheelchair because in the club they walked around. A lot of people think wheelchair means person cannot WALK at all, but a lot of people can walk short distances. Dude could have very easily spin this.

      He might have been able to fool a few people with a good enough excuse, but he would have had anybody who is in a wheelchair but able to walk small distances calling him out. When this first happened I was talking to my friend about it, who frequently uses a wheelchair but is also able to walk small distances. The thing that tipped him off was the guy is sitting in the wheelchair while gaming - he said he couldn't believe someone who is able to walk even a bit would ever do that. The first thing he does when he gets home is fold up his chair and put it next to the door, because getting around in a wheelchair inside a house is just a pain in the ass and you often have to get up anyway (ie to go to the toilet, to reach the sink, to get something from a pantry to eat etc) so the wheelchair just gets in the way rather than helps - plus after spending 8+ hours in that chair while he was out, he doesn't want to sit in it for even longer and would rather sit in a proper chair.

      @@StreakyBaconMan Possible. I think what happened is he was fully disabled and unable to walk when he started streaming. As he started to get better he had to choose between keeping the money he was getting and play along, or be transparent about his improvement. His disability was probably just too important of a factor in his streams popularity, and he was too dependent on the money he was making.

    Personally, as a disabled person who can't even wipe my own ass when I take a shit, I can comfortably say under no circumstances would I use my disability to ever garner donations on a place such as a stream where I show my face and play games. My disability makes me far too pissed off to even want people publicly knowing every detail of my conditions and/or financial situation to which they may feel bad for me, only people I truly trust would hear that vulnerable side of me.

      Facts. While not in a wheelchair, I do have a disabilities due to being struck by a car when I was 2. I always feel embarrassed talking about my issues, etc. Even my best friends don't know exactly what it entails.
      Anyone using their disabilities or mental health as a means to garner attention or donations doesn't actually have em.

    I am not defending this guy but let me share my story. I am partially in a wheelchair because I do have some days my legs dont have strength and hurt a lot. I use a power wheen chair in public to get around. HOWEVER at home i can get around a little bit using a cane to walk in the house in short distances.
    The way this guy got up and out you can tell it wasnt like this. Most people who even partially use wheel chairs have some hesitancy when standing up.

      There are lots of disabilities that don't show up externally but still limit mobility or function. I got sick from the flu and ended up with heart failure. For the most part I get around fine but after 30-45 minutes of walking I need to rest. I still avoid using disabled parking spots because of the looks I get from people. I went to a RenFest with some friends for 3 hours and afterwards I slept for 20 hours. Scammers and fraudsters make life for actually disabled people worse.

      I'm same jumped from a great height shattered both legs and other injuries, I try to walk for 5 min a day, maybe 10 6 months later but I am classed as disabled

      @@koolaidjerk to Zilians defence he started streaming without a cam. Moreover he has pictures from his personal facebook that he was in a wheelchair before he actually started streaming. To this day i have also never seen a video from his streams where he specifically tells people "i can't walk".
      Also this was at a time where streaming wasn't as popular. Today we know very little about the private lives of streamers, back then it was almost unheard of to know anything personal about a streamer.

      It's not even that he didn't hesitate. It's that he didn't brace himself at all. No cane, no crutch, no walker, didn't even hold onto the table. If he was doing physio to try and get out of the chair, he would have had some kind of aid to help him stand and be safe whilst standing.

    Its like this study about Cognitive Dissonance I read a long time ago.
    They paid one group of people 1 dollar to watch an hour long video about some crappy product and then told the people to tell other people about how great the product was. Basically "now go lie to everyone and sell them this product"
    They paid another group of people 50 dollars to watch the same video and tell a group of people about how great the product was. "Go sell this crap" just like the first group.
    Afterwards, they questioned the study participants on their personal feelings toward the product. The people who only got paid a dollar had way more positive feelings than the people who got paid 50 dollars.
    Basically the point is that since they only got paid 1 dollar for a few hours work they had convinced themselves that it was actually a good product. They didn't want to admit that had wasted time AND lied to everyone for ONE DOLLAR
    People who got paid 50 dollars had the opinion of "ehh whatever, it's crap but reason I lied and told everyone how great it is is because I got paid 50 bucks to do so"
    So basically people will lie to themselves instead of admitting that someone made a fool out of them
    Edit:some pretty scary implications politically to this study. If you want someone to go lie for you AND you want the liar to truly believe the lie they are telling, then you want to treat them horribly and pay them next to nothing

      to be fair, there's some disorders that simply make it incredibly painful to walk around for too long, so they use wheelchairs 90%
      of the time but can move for emergencies or to grab something above them out of reach, or to get in and out of beds or the toilet or bath.

    What bothers me are people who are *truly disabled, who's physical disabilities have been documented by Physicians Specialists and ER Staff's in two different hospitals* like myself who live under the poverty line, starve for 10 days per month because what disability covers isn't enough to live on.
    The system isn't designed for it. Rightly so, it's meant to give you just enough to cover your rent and bills but you get the bare minimum as the Taxpayers pay for us.
    Now the challenge is for people like myself who have been seen and wrote paperwork to the Provincial Government saying I will *never be fit to work for the rest of my life* and there should be a class of Disability Benefits wherein people who really are disabled and dying and on Provincial Disability benefits get what closer to what a person makes every two weeks. I don't get even get a 3rd of what an average person makes in two weeks which means I can't afford groceries, I can't afford medications that aren't covered by the Provincial System and I starve for 10 days to 14 days a month because of the high cost of life and I don't live in a big province where rents are 3000$ a month but regardless if a new budget was approved and put in place for people who are actually truly in need which would then have a vetting process where maybe people like this guy would get caught sooner. I don't know. I just know that as grateful as I really am for the assistance I recieve but it sucks to have to starve. It sucks to have to go without medications that I really need and have to rely on a local soup kitchen and the local food bank which gives us food that's already been picked thru and taken by the "paid volunteers" and the stuff we get is basically expired and you can only go every two weeks and what they give you is enough for two meals. Two. That's it.
    I truly hate to complain but it should change. I hope it does. Maybe there could be measures put in place to stop scammers as well.
    I know people will crucify me in the comments because I'm another disabled guy saying it's not enough but it really isnt. I am grateful for what I get but as I said it's not even a quarter of a bi weekly paycheck and I'm tired of suffering.

      Dude that's fucking criminal to do to our people who can't take care of themselves without help. Idk what country you're in (never heard of Disability how you've described so I'm assuming Canada or the UK - is it still UK post-Brexit? Lol) but I hate to think about how horribly people are treated for not being productive - in case someone rips off the taxpayers.
      You know what's worse? The gov rips us off every day. I'd rather pay to take care of people than to kill people. I'm in the US, for context. IDGAF if starving people "steal" my taxes. Or if we have a fraud rate of 2-5%. One of the worst things an allegedly civilized society can do is allow people with disabilities to starve to death because productivity > people. It's really horrifying and I'm sorry that's reality for you.
      I've been sick for two weeks and I realized I don't have it in me to have a chronic condition. This is the third or fourth time in my life that I've been put completely down by an illness. It has only happened twice as an adult, both Covid, and the stress of worrying about documentation for work is messing me up more.
      The pain, not being able to take care of myself or sit upright, worrying if anything will be permanent and if so, can I handle it work-wise, financially, emotionally, physically? 2 weeks. That's all it takes to break me.
      I think you have every right to complain. Your value as a human is not actually determined by what you produce. That's just how we're kept docile - play on shame and laziness - if society points the finger at anyone who can't work, they're not pointing at the however many trillion dollars the Pentagon "lost" magically, or whatever other BS governments do with our tax dollars that they aren't supposed to do.

    27:40 - How is it a HIPPA violation? HIPPA prevents information regarding your health from being distributed without your permission. It doesn't prohibit others from asking you to supply the information. You're free withhold your permission and deny access to your records, but since California is an at will state, Twitch is allowed to fire you for whatever reason, including a denial of access to medical information. HIPPA doesn't apply to Twitch in this case. A HIPPA violation would be if the provider supplied Twitch with the medical records without Zilian's OK.

    He for sure could have played it off as being able to move a little bit but still needing the chair most of the time. He could have said that at one point he was totally unable to stand and use his legs but there had been some partial recovery over time to where he was no longer completely immobile. He could even have said that the reason he had never demonstrated this on stream before was because he was worried that if he did walk at all then the trolls would give him a hard time and spread rumours that he was faking his injury.

    Twitch can definitely request medical records before they appeal his ban. Companies ask for medical records all the time for different reasons. It's up to the employee if he wants to provide them or not. If he doesn't provide them he doesn't work there. It's not that hard to figure out

      Streamers aren't employees of Twitch - they're treated as independent contractors and technically they work for themselves. Kind of like an uber driver. They couldn't just ask him for medical records any more than you can ask your plumber for his when you hire him to fix your toilet.

    I think he probably was in a wheelchair before streaming form some kind a accident, and started streaming in a wheelchair but when it became his thing as the streamer in a wheel chair he was afraid of what would happen to his career after he was fully recover. I remember how you where a few years back about only wanting to stream wow and that if you tried to switch to variety you feared it would ruin what you had.

    the funny thing is, he could have saved his career. I dont remember what she had, but my girlfriend in high school had a condition that had her wheelchair bound, but she could walk for short moments

    It's amazing because I grew up with a father who could walk for a certain amount of time before he was not able to anymore. It would have been very believable if he HAD said it at the time instead of keeping silence "for some reason"

    Honestly, My mom got hit by a van some years ago and have the same issue she uses a wheelchair to get around like 95% of the time, but once in a while with her pain meds she's able to go a very short distance at home... its possible, but so dumb abusing it.

    Ever since getting Covid June 1st I’ve struggled to walk distances. I get bad leg pain and out of breath from walking short distances. I can get around my place okay but I can’t navigate a grocery store without the aid of the electric shopping cart. I get looks from people like why’s he using that cart when he walked into the store. I rely on my inhaler if I walk too far.

    I can't walk very far due to my dystonia. Some days I can't walk at all. People have looked at me as a faker when getting out of my car on my feet and taking out my wheelchair. It's lowest of low to fake a disability, but people need to realize that many people are partially wheelchair bound.

    I had a accident and was in a 2heel chair but could still stand now I can walk a fair bit but still use the chair. If this was the case he should have told people and been upfront

    its not a violation of hippa to state that due to his perceived fraudulent case regarding medical status to have his account reinstated on their privately owned company's platform he would be required to waive his privacy protection rights in regards to the incident in question, because he isn't required to do that, he could also NOT use the platform.

    I literally have a friend who has a permanent spinal injury which makes his back very fragile. However when he is careful and lets his back heal as much as it can - and he does a pretty grueling regime of fairly painful but controlled exercises, he can sometimes walk as long as he doesn't agitate his spine by making a wrong movement and doesn't lift anything heavy. It takes a lot to keep it up though and he can very easily mess it up especially in sideward movement. My guess is that he spends about 50% of his time in the wheelchair, 20%-ish with a "rollator" and about 30% walking around - at times with very little indication of his injuries. So yeah - if he had been smart this could have been explained away... guess he wasn't 😀

    Me personally I can walk, but not for extended periods of time so in public I have to use my wheelchair. But at home I don't use my wheelchair cuz I mostly just walk from my room to the bathroom or kitchen mostly.

    To be fair, there is a lot people with mobility issues that need wheelchair to get around temporarily, i have some issues with my left leg so if i don't take meds for it I have to use crutches to move around

    I actually had to use a wheel chair for quite some time in highschool because I had got bad injury’s. I looked mostly fine but had a really hard time getting all the way from class to class after shattering my foot and having other problems before that. Probably could have made something yo

    Twitch can't legally state that he needs to show his med records to get un suspended, but they could say that it would speed up the review process.
    However that could give ground for potential lawsuit, so I can understand why Twitch doesn't want to bother with that.
    Then again I'm not a lawyer and my understanding is pretty limited, but what I understand from little I know, Hippa is tough thing to walk around

    Employers definitely can ask for medical documents.. not sure about contractors or whatever.
    However if that employer makes public or talks about that medical diagnosis to others, thats a villation.

    For the record the commenter that said that this is illegal it would be a HIPPA violation to have twitch require him release his medical records to twitch that is very true it is a HIPPA violation and he would be under no obligation to release those records. They can only be released if required by court or another doctor or another medical profession type situation. Medical records are completely in 100% confidential. I've worked in the field so I do know this to be fact

    I have a wheelchair for my MS and a cane and sometimes I need them and sometimes I don’t. But it’s a day by day basis. If he had just been honest and update his fans about his therapy this wouldn’t have happened

    Pretty sure Twitch can ask to see his medical records. The key phrase here is asking. They don't have to unban him, and he doesn't have to show them his records. It's their platform, and they can ban and unban who they want.

    Asmon, it wouldn't matter whether he denied it. The girl said "OMG" as soon as he got up and then she quickly non-sequitur'd into a dog story, before he panned the camera away from the empty chair, and ended the stream abruptly. Guy was dead in the water after that, ban or no ban.
