    I am a Canadian Citizen who has received a 5 years entry ban during a
    recent attempt to visit US for business purposes, i am told i need to apply for relevant visa alongside an entry waiver, as such i am applying for an E2 Visa but need to know whether i should submit the waiver alongside the visa with consulate, or is it that they need to be submitted separately with relevant offices, in case of separate applications which one i should be applying first, the visa or waiver? There are some confusions and conflicting views i am getting from on how to go about this? your clarifications would be highly appreciated.

    Hello Gary! Any information on permanent bars 212a9ci and a nonimmigrant waiver 212d3? Wondering if coming on a 212d3 and nonimmigrant visa will break/restart the requirement that someone be outside the US for 10 years before they can apply for I212 waiver for consent to reapply. Any information on that? Thank you

    I got a question, My brother was deported at the Houston airport 3 years ago, they punished him for 5 years for having worked, now we are going to apply for the F-1 visa so that he can come to study English, this type of waiver has to be done after the interview at the consulate because I don't see any type of document to fill out. thank you so much.

      there is no form. you write a letter with equities and let the consul officer know you want to apply for the waiver.

    Hi Gary! I read that for K1 visa the applicant needs to file a I-601 waiver.

      Hi, if there is a ground of inadmissibility, yes, for K visa you need an i 601 waiver. There are other types of waivers as well, but thank you for your astute comment!!!

      @@GrayLawTV Thank you so much. The point is that with the i 601 waiver if you can't prove extreme hardship the applicant won't be able to immigrate, so it's like having no options, although recently forcing the Us citizen to move to a foreign country to be with the foreign spouse has been defined unconstitutional. In my case, although I cannot stay with someone lacking extreme hardship factors, I hope to get a waiver to visit temporarily, based on health and criminal grounds of inadmissibility. I won't go over my situation in public but I'll do everything I can to fix this situation at least partially and I am so grateful there is the 212d3 waiver.

    I recently faced a situation where my F-1 visa was canceled at the U.S. port of entry, and I was given a 5-year bar for alleged unauthorized employment, which I denied. The basis for this allegation was a WhatsApp conversation. The consulate in my country advised me to reapply for the visa, which I did. During my visa interview, the consular officer took my passport and documents. I provided a letter from my university stating that I was not involved in any unauthorized employment, details of an on-campus internship, and evidence of my good academic standing. Additionally, I showed my net worth certificate from a Chartered Accountant and other supporting documents.Given these circumstances, is there anything more I can do to expedite my case? Are there any specific steps or additional documentation that could improve my chances of getting a waiver for the 5-year bar? Any advice on how to handle this situation to facilitate a quicker and favorable resolution would be greatly appreciated. Thank you

      @roh, no. At this point it looks like they will issue the visa it it just administrative processing to ensure you maintained status.

    Hi Alberto, I'm married to an US citizen. I have a 10 year ban for overstaying my visa. There is ground for extreme hardship.

    My visa was cancelled and I was deported in 2018 getting a five-year ban, on the grounds of illegally working on the summer of 2017 (having a B1-B2 visa).
    What are my chances to get a H-2B Working Visa, now after my ban was expired?

    My parents moved us from Mexico in 1996 when I was 5 years old. We came in with tourist visas and overstayed. In 2013 I applied for DACA and was approved and in 2017 I applied for Advance Parole which was also granted so I left the US in 2017 and came back a month later with advance parole.
    In 2018i decided to leave the US so I moved to Germany under a student visa. I am now living in England under a spouse visa and I’m about 2 years away from getting citizenship….
    It’s been 5 years since I’ve been to the states and I want to visit my friends and family but I’m scared to apply because I don’t want to get refused or have a ban out on me. Would this Hranka waiver apply in my case? (While living in the US I never had any sort of criminal record).
    If I wanted to use this waiver do I just write a cover letter and cite this waiver or how is a cover letter asking for this waiver written? Is there a template you would recommend? Thanks !

      Hi, there is no template. You just write down your reasons for wanting the waiver and submit at time of the interview. Good luck!

    Dear Mr. Gray
    Please, allow me one quick question.
    I got an approved I-140 for my immigrant visa EB2-NIW consular processing. I'm now waiting for my Greencard interview at Rio de Janeiro US consulate.
    The fact is, I was granted a waiver of inadmissibility and consent to reapply I-212 for a B1/B2 visa back in 2014 because I had received a 10 year bar in April 2013 due to a minor issue which was later solved through US consulate here in Brazil.
    I still have a valid B1/B2 visa which says "HITS REVIEWED, NO REMAINING INELIGIBILITIES" in the annotation field on the visa.
    I've been traveling to the US either on Business or Tourism since then without any problems of admission with that visa.
    Does that mean I'm good to be eligible for the Greencard or will I need another type of waiver specifically for the immigrant status even though I'm good to enter the US as a non-immigrant at any time ?

      @NK, first of all congrats on the NIW approval! It appears you are good to go for the green card in that your non-immigrant ineligibilities have been lifted....in other words, you could also come to the US and change your status to get the green card.
