I believe it is, but it's not always that cut and dry.
Remember, litigation is not about what actually happened, it's about what you can prove, lol. Corporate double-speak is designed to avoid implicating the company, even when they are overtly breaking the rules.
The silver lining, it's a company with 50 employees and functionally no HR (HR is NEVER a friend to the employee, they protect the company). In a small company like that, there's likely nobody who actually knows what they're doing in this regard. They know their market, their client base, but virtually nothing of internal administration.
The real question is how many employees do they have exactly? 50 is something of a magic number in the U.S., that's the threshold for having to participate in FMLA, they have to provide health insurance to full-time employees under the affordable care act, they have to comply with federal regulations as an "Equal Opportunity Employer" (EEOC) and if they have any government contracts valued at over $50k a year, they need to participate in Affirmative Action. If they can't get their shit together with regard to a dress code, what are the odds they're in compliance with these other things? If there's no competent administrator at the helm, I'm betting they're not in compliance at all.
Seriously, get a head-count of actual employees (not contractors). If it's just over 49 people, tell a lawyer, odds are you'll catch them with their pants down on a few other issues as well. OP won't gain from this monetarily in any significant way (she wouldn't really anyway), but she can make them severely regret their mishandling of this issue.

Story 2 - My first question is, is she a black woman? And if not, is she a very curvy woman? (I ask these two questions because I am a very curvy black woman, and know black women tend to have mire curves due to cultural diets of the diaspora being different than other cultures.)
I had to deal with an _extremely_ minor version of this type of issue. But fortunately, the situation was solved by a general work meeting reviewing the dress code. Everyone started wearing new, wide-leg black slacks, not just me. So I was happy. If I had to buy new pants that were not black jeggings, then everyone else should have to as well, otherwise it’s bit fair.
Yeah this was my first thought as well if she was a woman of color. It is obvious she was being targeted though.
