    I understand going after Yuzu since the console it's emulating is current gen, but going after citra at this point makes no real sense. Nintendo hasn't made a dime on 3ds games and the system itself since they discontinued the line up as a whole.

      @@zk0rned not true at all, the team could have left the website up and its repositories. But they chose to take everything down. Some members have stated they are done with emulation scene altogether. It's likely they will sell all properties pertaining to their LLC and file for bankruptcy to avoid paying all 2.4 million

    One problem from a western perspective that people don't understand is that Japan has no concept of fair use. It's not even an idea in their legal system. They just see it as theft. I still think it's ill advised not to let people make content about your media but that's part of the reason Nintendo is such a hard ass about fair use.

    Associating yuzu with piracy is by far the most Nintendo lawyer sounding argument i have ever heard. By this logic it is now fair to associate any emulator with piracy as I can pirate games and play them on said emulator. Devs should also now sue GOG because the games sold there are DRM free and GOG is directly involved with people sharing DRM free games illegally.

      Most really old games are defunct cost over 100 dollars and can't be bought new and plus open free emulators have better features than some propitiatory emulator that never gets improved, if the game is still being sold I'd buy it on a steam sale super cheap and play the game in the better free emulator

    My friend and possibly me doesn't pirate games unless they are no longer sold digitally or are quite old. My friend and also maybe me feels that pirating recently launched games, especially indie games is extremely messed up. He would pirate SMT IV for 3ds but not Shovel Knight for 3ds since Shovel Knight is available for "modern" consoles but not SMT IV.

      @@QuartzQuadrant I'm not I would just rather give my take that I've rarely seen, If I see a remaster that fits my honestly low standards I would probably buy it, I bought Abe's Odyssey and Abe's Exodus for Pete's sake and that was only a few years ago. not to mention I'm pretty sure those were just ports. I also completely understand not being able to do so, the reason I kept the statement to myself and also my friend who is probably not me is because my situation is a little more fortunate, and I understand even If I made almost no money I would be probably 5x more well off then a lot of people.

    Just reading the comments sections of most of these videos/articles I’ve come to this conclusion. Most of the people complaining about this situation are pirating games.
    My favorite argument is that Nintendo switch games are too expensive so I’m going to pirate their games.
    Just try that logic ANYWHERE else in your life. Let me know how that works out.

    Yuzu really should have known better charging for certain access to Yuzu. I am a huge supporter of game preservation as well as emulation. However, Yuzu really should have seen the signs written on the wall that emulation of a system that’s still in production, as well as taking monetary gain from features. Was destined to die

Now it could be argued that Yuzu devs were being stupid by explicitly advertising Yuzu as a way to play Switch games, but that's another issue

    People who decry Nintendo as an "anti-consumer" company that doesn't listen to its fans and only cares about making money are so unserious. They will cry about not being able to play their older games that are no longer being sold, but when those games are re-released, they STILL fly the banner for piracy despite getting what they wanted. I'd rather pay 60 bucks for the Paper Mario Thousand Year Door remaster than pay over 300 for that one copy I saw at a local shop before it was announced.

      The solution is NOT to cancel group who modify the game experience on projects Nintendo has abandoned or discontinued services for just because they can't profit off of it anymore.
      Nintendo choosing after years of no love for the retro community to sudden come in with open arms in the form of a subscription does not absolve Nintendo of cupability either you pathetic stan. It's a way how Nintendo finds the legal means to now have the right to retroactively deconstruct everything anyone has built for it by adopting the mentality: "We made it so you can buy our old games again w/o purchasing consoles. Emulators are no longer needed so shut it down"
      It's a smack in the face to anyone who's been a long term Nintendo fan. And it further breeds distaste in their legal departments practices.

    It's a shame, because I agree with you, however the video is of very low quality. It's quite clear you haven't really done a lot of research on this topic or performed basic due diligence.
    For example, based on your "why yuzu is wrong" chapter, it's obvious you haven't even read Nintendo's complaint in the suit, as you can't even parrot their arguments. Instead you are coming up with your own (legally unsound) justifications for why Nintendo is right "it was a for profit company", "it's current gen not retro emulation" etc. And then proceed to cite a case where Sony lost against a for profit company emulating their current gen hardware...

    the big thing here (for me, anyway) was being able to buy a game, dump it, and be able to play it on hardware that can actually *run* it competently. botw/totk and pokemon had all had so many issues on the actual hardware, but on pc, they ran pretty well, after a little bit of tweaking on the emulator side. but as you said, making an emulator for a CURRENT gen system, with games that are still widely available/sold today, bad idea

    Every win for Nintendo is a loss for humanity's players all around the world. Nintendo doesn't even give a crap about game preservation, proven by how they got rid of the 3DS Eshop. People need to understand that without piracy a lot of things could simply become lost in time, for example think of an underground cartoon you saw at the 70s, without piracy all the physical copies could end up destroyed and then lost eternally.

    As much as I hate that Yuzu does not exist now, I think whatever happened with them was for the greater good. Nintendo has the best first party studios of all the three. Plus their games are pure games not the "unfun cinematic experiences" that everyone is trying to make nowadays. So, I hope Nintendo gets all the money to make their games and no stealing takes place.

    People in the comments are so stupid. They didn't specifically go after Citra as well. They just made them stop all emulation services so that they wouldn't just make yuzu 2.
    I swear the amount of people in the emu community who are so in denial that their services are used for piracy is nuts. They made a current gen emulator and got caught. Not a DS emulator or a Wii emulator. A Switch Emulator. Citra was hit in the crossfire, it wasnt the target so people need to stop crying. Yuzu was being used to steal. Time to accept that fact and move on.

    this is honestly the take: recognizing that Nintendo historically has anti-fun policies but was objectively wronged in this case
    I'm fine with people wanting to emulate, especially older games like you mentioned, but there has to be some accountability for the emulator producers as well, which I think some modern precedence could've contributed like you were saying in the video

      The problem is... Who cares if the Emulator is for a current system. You must not have heard of an N64 Emulator doing something similar. The Emulator isn't illegal nor wrong. Yuzu never provided keys for their emulator. They never provided roms for the emulator.

    Interesting. My copy of Yuzu still works, I only used it to record a Metroid Dread a few a times after playing through it 50 times on the Switch with a legal physical copy. I didn't download any games I didn't already own so technically I'm in a grey area, but I thought the video said something about Yuzu discontinuing.

    Nintendo wasn't and will never be owed hardware sales. I am not going to pay 400 dollars to someone if all I get from the initial purchase is the priviledge of being allowed to make more purchases. Mario odyssey was not worth 460 dollars. BotW was not worth 460 dollars. FE was not worth 460 dollars. Sword/Shield wasn't even worth 60. For the cost of all those games and the console they come on you could buy a rig that could emulate tens of thousands of retro games plus play pc titles, or buy a vr headset and gain access to vr games, or a dozen other things. The switch (nor the ps4/xbone) was never worth choosing over PC and nintendo refuses to sell on other platforms long after microsoft and sony both realized consoles are a dying breed and started offering games on pc or even the competitor's system. The switch 2 is pretty much guaranteed to be realeased soon and the switch eshop still, AFTER SEVEN YEARS (not counting the lifecycle of the wii, wiiu, and 3ds), doesn't even offer enough of nintendo's own back catalog of retro games to even pretend to be worth considering over a retro emulation capable PC. Hell, they're trying to act like Disney by keeping certain retro games locked away for the sake of artificial scarcity. Plus all the extra fees they tack on like having to pay for multiplayer or having to pay extra money to transfer caught creatures in their decades long flagship series which is exclusively about catching creatures.
    Having a monopoly over how certain software can be played was what Bleem v Sony was about and sony caved instantly on that.
    If nintendo or sony or xbox or anyone want more game sales than their existing console playerbase gives them then they need to sell multiplatform games and if they want hardware sales they need to offer a console worth buying on some merit other than artificial scarcity. The wii was legitimately worth buying for the control scheme. The 3ds was legitimately worth buying for the screen and the portability. The switch is too expensive to actually be portable, was never beefy enough to be better than a pc, and few games utilized the motion controls beyond gyro aim. People like you and the suits at nintendo love doing napkin math to say "look, if X percent of pirates bought our games we'd have 87 morbillion dollars, so that means piracy is bad" but never consider that for the pirates who aren't pirating because they're poor near 100% of them find some aspect of your business so flawed that they would never interact with the game at all if piracy wasn't an option. PS4/5 emulation isn't possible (yet) but I care so little about the consoles as a whole that I'm more than willing to forget about the few exclusives worth playing than even contemplate buying the consoles.
    Emulation was the only reason I even kept nintendo on my radar the last seven+ years and if somehow nintendo magically made switch2 emulation impossible then they immediately become completely irrelevant to me until they start offering titles on PC or a console actually worth buying. If nintendo or their fanboys want me to buy their games then I need to actually be allowed to play the games I buy without a $400 membership card plus annual fees.

      2) Yuzu was free, patreon just gave early access. There's nothing wrong with that and even if it was paywalled legal precedent has established that emulators can be sold
      3) Yuzu could never be as shameless and embarassing as nintendo. With nintendo's history of anticonsumer practices any gloating from emudevs or anyone else is small potatoes and entirely deserved

      @@M64bros Maybe I'm mistaken but I'm pretty sure you are allowed to monetize emus for currentgen. Bleem v sony was about this and there's other legal precedent for it. My understanding is that the two major legal angles are anti-monopoly, so bleem v sony, and general consumer protections. The only area where yuzu was explicitly in violation of the law is their realtime decryption which runs afoul of laws against drm circumvention. If there is some law to the effect of "you cannot make money providing emulators for consoles still in production" then I'd unironically love to read it

    Yuzu does not equal, facilitate or recommend piracy.
    People pirating Tears of the Kingdom, or any Switch game, can play it on a hacked Switch. Yuzu is not at fault whatsoever for people pirating anything.
    Yuzu also instructs users to use their own dumped games, as well as files dumped from their own Nintendo Switch for the emulator to even work. People finding workarounds are the actions of those who defy Yuzu's intended use.
    Emulation does not imply piracy, nor does piracy imply emulation. While they can overlap, it comes at no fault from the emulator since it is not officially required or suggested. Owning a brick is not illegal. Smashing someone's head with it is.
    Even if people at Nintendo still take issue with a modern gen emulator that does support the legal owning of their systems and games, that definitely should not apply to Citra.
    All that aside, much respect to you for holding your head high with this video. It being an unpopular opinion has not shaken you, and you seem more than prepared for any backlash.

      I agree and disagree with your points lol. Emulation is tough. If we lived in an idealistic world, no one would ever use them for piracy. But that's just not the case. I think if you're really honest with yourself about why people use emulators, it's difficult to avoid the giant elephant in the room that is theft.
      People are mad lol. That's fine. Debate is important. Most of these people who are so triggered in the comments would also be the first to complain if companies stopped making great games due to theft.

    No, they are absolutely not right lol, nintendo like usual is just trying to stomp out emulation, as they have for 25+ years. Yuzu had nothing to do with totk being leaked or even being PLAYED on the emulator. Other people created a patch to run the game, again, nothing to do with the people at yuzu. Also they did nothing wrong with having a paypal for donations, emulation is incredibly hard work for a console even 20+ years old, for a current 2024 console? Its near im-fucking possible. Theres nothing wrong with them getting compensated for there time. They also only gave instructions to extract code from carts that were LEGALLY bought. Its my copy of a game, i can do what ever i want with it.

      Yuzu did not paywall the ability to play TOTK. It was other users of Yuzu who made custom builds that could play the game. But yes I agree with your second point.

Although at the same time its more of an ethical situation, I personally don't think Nintendo has done enough for Emulation of Switch games to be justifiable yet. (With the Exception of Game freak. I could give 0 rats asses about how they think about Emulation, Modding, taking elements from their games for your own games, etc)

    We have to remember that Nintendo are the creators from the next generation - After the golden era' of videogame-Coin-op era. Even though there are couple competitors at the time building the hometitle of consoles, Nintendo were the ones who launched pioneer-ic to the advantage they carried with their technology. In my opinion, Nintendo went ahead of their time to input a chip inside their gaming consoles to avoid any piracy by any other party because of course it's a loss of revenue to be reselling like Supreme Clothing. Nintendo is like any insurance company on top of the pyramid scheme. Yeah it sucks but this is rational. If you don't have the money for a new copy, good luck scoring a pre owned copy.

People bash on Nintendo because nostalgia is not supported properly by them, but honestly: What incentive do you have to re-launch a title that has been pirated over several years with better mods and bug-fixes? What chance do you have to do that if you know you can't control your OWN IPS!!
    If Anyone here was in charge of Nintendo, seeing how much it costs to make a game and having no control over public demand at your OWN products because someone made a "passion project" about it that violates laws, you would have to make your case clear in order to remain in business and stop the line-blurrers.

    Emulation is not piracy nor is involved with the process of piracy itself. PLAYING a pirated game is not the same as pirating a game. Those are two different things. Thats one of the reasons why emulators are legal in the first place. As long as Yuzu did not have any download links to any of Nintendos IP they were not causing or facilitating piracy itself. Maybe you could argue that they made playing pirated games easier which would be fair, but its not the same argument as saying they caused or facilitated piracy in the first place.
    Also the argument of "Yuzu was using Nintendos IPs to make money". They were not* (I will clarify the "*" in the second to last paragraph). They never sold or distributed Nintendos copyrighted works and using screenshots of games running on your emulator is legal and would fall under fair use just like the emulator itself. Another thing is that emulator developers are legally allowed to make money off their own work even if the emulator is for a current console. The console being on the market is irrelevant to the legality of the emulator making money or the developers profiting from it. Sony vs Bleem proved this because Bleem! was an entirely for profit emulator yet still won against Sony. Sonys main complaint in that lawsuit is that Bleem! was using screenshots of the emulator running PS1 games to market it. But of course since Bleem! won there is now legal precedent for emulator developers to make money and market themselves.
    Its a good thing that emulator developers can make money off of the emulators they make because making an emulator is NOT EASY. It requires much time and dedication just to get something that generally works yet alone works perfectly. Just like how the developers at Nintendo should be allowed to make money off their own work the developers of emulators should be allowed to make money off the emulators they make as well.
    Of course Im not saying that Tropic Haze is 100% in the right here. Their not. One of problem with what they were doing to me is that they were giving perks to there patrions that allowed them to have early access to in development builds of Yuzu. This partially defeats the purpose of a open source project since the idea of open source is to have everyone have equal access to the code of the emulator.
    There was also the issue involving Tears of the Kingdom leaks were people were giving Yuzu money in the hopes that the in development Yuzu build would allow TOTK to be played early. Fortunately this did not work for the pirates, however Yuzu should not have been profiting off people who want to play a pirated game. I said "not*" is for this reason because you could argue that Yuzu profiting off of pirates is bad because Nintendo should have gotten that money in this situation not Yuzu. Keep in mind pirates would normally not pay emulator developers because the emulator itself is usually free to download but due to the false hope of being able to play TOTK early on the Yuzu in development builds they payed Yuzu for the builds. Pirates eventually solved this their issue of playing early by making their own builds which could play TOTK early. If Tropic Haze would have stuck to making money off of purely optional donations with no perks then they might still be here now.
    Overall a mostly fair video. I don't think this video deserves all the dislikes it got and you make some good points. I wrote this comment just to clarify some of the confusion in this situation. Hope this helps.

    yuzu did do some really stupid things, but that doesn't make Switch emulation wrong. I should have every right to play my Nintendo games that I bought on a piece of hardware that isn't a shitty budget Android tablet from 7 years ago. I get that Nintendo has a huge piracy problem, but the right way to fix it is to start putting their games on PC.

    Blaming the emulator bexaue of the leak issue is like blaming windows for piracy too. Nintendo is morally in the wrong. Also piracy is only more of a mixed issue if it involved recent games where actual developers are being paid so I can understand that part but Nintendo was still not in the right.
    Also innocently making money off original victimless code isn't wrong. Nintendo doesn't morally own the idea of emulating certain switch games. Maybe Nintendo could of gone after the original leaker.

And yes, he was also negative about Nintendo and hoped they'd make games for other consoles, BUT the video was about Yuzu and he was completely on the side of Nintendo there. Wanting one thing, but hating the other thing, it just does not make sense and it's just crying over people making a living with a passion project while not hurting anyone.

      No matter whenever an emulator gets strike down or if a fan game gets removed from Nintendo's DMCA legal team, it still remains on the internet forever.

    Emulation encourages piracy period NOT preservation. This is why we are heading directly to an all digital pay service system. It’s an answer for game comps to combat piracy.

      I've been saying, that if the gaming community was serious about preservation, they would look for legislative means. The film industry has done this and has a committee in charge of film preservation and making older films accessible to the public

    I never would have bought a switch if i had to buy all the games, they are stupid expensive and nintendo deals with way too much anti-consumer practises. So in my case piracy actually made nintendo money. 🤷 So if piracy scares a billion dollar company because they could make an even more heinous amount money by doing shit like this, i say fuck'em, same with ubisoft, EA and activision.

    I am partially with you on this. Even the biggest, richest company in the world can go bankrupt if they make a single bad strategic decision. Ask companies like Kodak or Nokia. I am 100% against emulators. Nintendo is the one who puts the effort, investments and creativity to create games we all love playing. They take the risks. If you use an emulator (even for a discontinued console / game) you just want to profit for free from the efforts and risks of others. The part I disagree with is that final statement: "[...] and the sooner they can come back to reality to work with, not against their player-base, the better". You assume that the reality is that players want to pay for games. My experience tells me that people in general, not just gamers, want everything for free. Why do so many people share their Netflix and Spotify accounts? Why did millions download mp3 songs in the past?. I think your video would have been more complete if you had included a suggestion of how that cooperation with their player-base could look like. Are you hinting, for instance, at porting their older games to PC and charge a small amount for them to be played on PCs? This wouldn't work because Nintendo might want to remake those games on newer consoles and less people would buy them because they have already played them on PC. There is no easy solution to this problem so I think Nintendo is doing the right thing from a business point of view.

      Emulating games from 30 years ago isn't hurting Nintendo at all, Emulating anything upto WiiU does not hurt Nintendo at all, those consoles are all out of production and the games are no longer sold, corporate America sure has convinced you they profit off of games for eternity when the only ones profiting off old games are resellers.

      Great points. I agree there will always be a percentage of consumers who don't want to pay for anything. But people seem to be really prone to steal from Nintendo specifically because of the company's anti-consumer behavior over the last decade.
      I think it's reasonable to assume that if customers have convenient and fair options available to them, most people will buy. That's why even though pirating exists and people do share accounts, Netflix, Spotify, etc are billion dollar giants. It's just way easier to pay $10-20 a month to get safe, easy, legal entertainment than deal with the risks associated with torrents.
      Maybe Nintendo can bring certain titles to PC on a delayed release and offer occasional discounts after the bulk of purchases have been made.

      @@KaosDeathLord that is where I respectfully disagree on, and what I think most people fail to accept: neither you nor I are the president of Nintendo to know whether emulating old games now will hurt the company in the future or not.
      Hypothesis: let's say Nintendo releases a new game of an old, forgotten IP. This game is a total success. They might want to release that forgotten game as a remake for full price (after all, many new gamers have never played old games)... This strategy might not be possible if the game was already available on PC (may be it is, WE JUST DONT KNOW).
      There are other possible scenarios but it all comes down to respecting somebody else's property. I might not have used my old Chevy for many years, this does not give others the right to just take it from me and go for a drive. It is mine and I do what I want with it. You probably use the same approach with your own properties, don't you? Or may a neighbor just come to your house and kiss your wife just because she has not been kissed for an amount of time that the neighbor unilaterally deems too long?
