It was smart for Prescott to sue because if it's not true then, it puts her on the defense.
As Mike Florio (who is a lawyer) pointed out, it makes disposal of the case harder for Prescott. The first and immediate defense for Prescott was that statute of limitations had run out. That would run much shorter than years long litigation since he sued. It also opens up a can of worms in terms of other legal problems. Evidence that might have been barred under the allegations might be allowed to come in if he sued for extortion. It's not smart. It's at best bravado.
As an example of how suing someone could go wrong, there is the Anna Nicole Smith case. She sued her late husband's estate as she did not receive any significant inheritance when he died. She lost the state court case in Texas as all she had at best was a verbal promise from her late husband but he never changed his will to give her more. The litigation was costly so she filed bankruptcy in federal court.
Her late husband's estate who was controlled by his son then sued her in federal bankruptcy court as a creditor. Their contention was she did not pay back a loan which she promised under a verbal contract. This was their mistake as that allowed her to bring the fact she was verbally promised more of the estate. The federal court ruled that she needed to pay back the loan but the estate owed her a lot more money than the will stated.
Since two different courts in two different systems disagreed, it went to the Supreme Court of the United States. Bear in mind, SCOTUS was not deciding specifically if Anna Nicole Smith should or should not receive money. Their main focus was if a federal bankruptcy court has jurisdiction in this matter. SCOTUS initially decided that generally federal court could overrule state courts; however, it later decided that bankruptcy court could not specifically overrule state probate courts. It took 16 years to resolve.

@minhduong1484 I want to be clear -- you're obviously correct in your analysis of the way the "system" currently works. But, is that how it *should* work? That answer should be obvious & it should be 'no.' We, as a country, need to move away from this heavily litigious culture, and, people who waste both the Executive and Judicial branches' time ( like the Trevor Bauer case) *should* be held criminally liable. So, I applaud a man who has plenty of money choosing to spend it on maintaining the value of his name!
Mike is so right on that last point cause one of the phrases lawyers hate to say in court is "I wasn’t aware of that your honor".
That’s why they always ask their clients "Is there something I should know about this case or your past in relevance of this case that you haven’t told me" 🤷🏽♂️

Civil rights attorney/frmer judicial clerk here - hmm, If she's being sued for extortion, just like it would be in the case if he sued for defamation, it's only fair she can assert TRUTH as her defense ie, my demand letter was based on good faith claim/truth (he assaulted me) and therefore it's NOT extortion or defamation. Also, IF she defends herself successfully by proving the assault, then it would be counter to public policy to let an adjudicated finding of a crime go unpunished.
all extra lawsuits would be based on whether it looked like he was guilty in the first place of the sex assault / crime, agree yes.

I am a woman and absolutely agree that any woman or man who falsely accuses any one of sexual assault knowing it’s a “lie” should be prosecuted when it’s revealed as a false allegation. This malicious act totally disrupts someone life and their family life. Additionally, it’s causes an enormous amount of money and time to fight these type of battles. Lastly it’s a dishonor to all women and men who have actually been sexual assaulted.
I don't understand it either. If a man 'attacks' you go to police right then not yrs later after the person has a high paying career. No excuse.
