The prisoner's ladder would be kicked away and the executioner climbed down his ladder.

You have to remember, some of these "pirates" at least started with a letter of Marque from rival nations. That didn't change the end result if officials ignored it. As for merchants hiring them to go after rivals ships, that was a thing too. Not many of those got executed.

The assumption that those hanged with a “short drop” suffered for 10-15 minutes of terrible pain from the tight noose and oxygen starvation is false. At about maximum, consciousness for only 20 seconds to roughly a minute remains after oxygen is removed from the cerebral cortex. The so-called “dance” of the executed is only spinal nerve activity from oxygen starved neurons. The hanged person is no longer conscious or aware. There is some terrible pain when the weight of the body is being “supported” by the noose at the neck. But unless oxygen is restored, consciousness ends in just over a minute.
