    1. I am married to us citizen as you said I can apply after 3 year. Be physically in the United States for at least 18 months out of the 3 years immediately preceding the date of filing the application. My question is 'when can I apply after 3 year or after 18 month since my coming usa.
Another question can in between 3 year period can I travel to outside USA for 2 month or 1 month. 1 or 2 month cause disruption or not?

Hi, I have a question. While completing N-400, they run the eligibility criteria first and there is a question that asks if I had moved in the past 3 months. How do I answer it if I'm just back from a foreign tour of 3 months, although I'm back in the same state that I have been living in for the last 3 years? Please advise.

I have Gc with F4 category. My question is, I'm holding GC from march 2016.....
In march 2022. It will be 3.2 years of "continuous stay" in USA out of 5 yrs (2018 December onwards)
Will I be eligible for naturalization ? Fullfelling all other 8 criterias out of 9. Only doubt with "continuous stay"
    Appreciate your input.

    Hi Micheal,
I have a question. My dad has had a green card since 1991 but has never stayed continuously in the US for five years. He came last time in 2019 and has not come back since because of Covid-19. Does any of his previous physical presence of more than 6 months in US will be counted if he applies for Citizenship. What does he have to do now to get the Citizenship?
Thank you so much for your help.

Question-I have a greencard and am out of the US for already 4 months. I have travel documents valid till 2021. In oreder to avoid disruption to citizenship-I understand have to come to US before 6 months since i left. Now there is COVID19 and travel problems etc.- can this reuirement to avoid disruption be relaxed for the covid time?

    • @AshooriLaw
      @AshooriLaw  4 ปีที่แล้ว +1

Hi this is a great question! Absences of between 6 months and 1 year will break the continuity of residence requirement, unless you can demonstrate that you did not disrupt your continuity of residence.
Here is some helpful evidence to show that you did not disrupt your continuity of residence:
Showing that you maintained employment in the U.S.
Showing that you did not obtain employment outside of the U.S.
Showing that your immediate family remained in the U.S.
Showing that you maintained a U.S. residence (ex. Lease agreement, utility bills, etc.)
The COVID-19 pandemic should also help to show that you did not intend to stay outside of the U.S. for 6 months, but that it was outside of your control.
Another important note is that you should make sure not to be out of the U.S. for longer than a year because after a year, it is definitely considered a disruption of your continuity of residence.
      I hope this helps!!

thank you for the video, I have a question. Are there any consequences if a green card holder makes a 3-months trip outside of the USA for all 5 years he is considering for naturalization? Consider, the Green cardholder had a job, house (leased/owned, paid taxes). Will he be eligible for naturalization? While the requirement for physical presence is 913 days how come continuous residence goes against that? Can you please shed some light based on your experience?

Somebody who spends three months a year outside the US should not encounter any issues with citizenship. For example many teachers travel when school isn't in session.

Hello, I heard that they passed something that’s going to legalize everyone this year? Is this true? I am 20 years old and have been with my boyfriend for 5 years now we are planning on getting married and want to get on this process of making him a citizen but I don’t know where to start this video was super helpful so thank you, although I am curious if there’s anything different now, like does he still need to get a green card? Should we do that first and then apply for naturalization ? Do we have to get his green card first and wait 3 years to apply? He has been in the United States since he was 3 years old?
