भाई जी मामला ये है कि, दिल्ली का ही मामला ले लो... एक लड़का बीए पास करके एक प्राइवेट कंपनी में सेल्स में का काम पकड़ा। शुरुआत में उसको साढ़े 12 हज़ार रुपये प्रति माह सेलरी कंपनी ने देना शुरु किया। जिसमे से मात्र 7500 रुपये ही इन हैंड आते थे। लगभग एक वर्ष बीतने के बाद व्यक्ति के सेलरी में कंपनी द्वारा मामूली सा हिज़फा किया गया। अचानक स्थिति ये देखने को मिली कि, जो पढ़ा लिखा लड़का डेढ़ साल से नौकरी करके रहा था और जो अनपढ़ लड़का फ्रेसर के रूप में कंपनी जॉइन किया है, दोनों की सैलरी में मात्र पांच सौ रूपये का डिफरेंस रखा गया।जिसके लिए पढ़े लिखे लड़के ने कंपनी का विरोध किया तो कंपनी ने रिजाइन देने की बात कह दी। बीए पास लड़के ने जब श्रम मंत्रालय के वेबसाइटे पर द्वारा जारी प्रेस रिलीज में देखा तो गवर्मेंट के नियमानुसार उस लड़के की सैलरी लगभग चार- पांच हज़ार कम दी जा रही थी।जिसके लिए तुरंत लड़के ने ईपीएफओ की वेबसाइट पा अपनी प्रोफाइल चेक किया तो पता चला कि, ये कंपनी ईपीएफओ के किसी भो लड़के की क्वालिफिकेशन्स को सबमिट नही की है।ईपीएफओ की नजर में कंपनी ने सभी जूनियर कर्मचारियों को मजदूर साबित की है। अगर ईपीएफओ के पास कर्मचारियों का क्वालिफिकेशन सबमिट किया रहता तो ईपीएफओ, कंपनी से खुद नियम के अनुसार कर्मचारियों का सेलरी लगवा कर उसी हिसाब से पीएफ काटती। यही मामला है। आप बताओ कि इस स्थित में कर्मचारी अब क्या करे ?

Only labour office or court can help you. Personally go to Labor office of your city. Also send your grievance to "Ministry of Labour and Employment" using pgportal.gov.in/. Still I will recommend you to go to labor office personally.

" तो हुआ यु कि .. मेरे भाई ने एक private limited company ( Engineering Division ) मे interview के लिए गया और उसे job के लिए select कर लिया गया । जब मेरे भाई को Appointment letter और Employee No. दिया जा रहा था तो मेरे भाई ने यह बात Company के HR से clear कर दी थी कि , मेरे engineering के last semester ka result अभी आया नहीं है.. जो अगले महीने तक आ जायेगा .. तो please आप मुझे अभी as a diploma holder hire कर लिजिये.. तो Company के HR ने कहा कि कोई Problem नहीं है .. हम आपको as engineering hire कर रहे है बस अगले महीने में आपका result आते ही मुझे submit कर देना .. तो इस तरह मेरे भाई को job लग गई..OK..!! और अब job करते हुए 10/12 हि दिन हुये है और HR ने भाई को call किया और कहा कि resign दे दो.. ओ भी person reason लिखो company ने कहा है ऐसा मत लिखना ( without any specific reason ??? ) तो भाई ने पुछा क्यु ..?? तो HR ने कहा कि आप हमारे education and qualification criteria मे fit नहीं हो.. पर भाई ने result की बात तो पहले से ही clear कर दी थी..!! फिर भी भाई ने resign देने से साफ साफ मना कर दिया .. तो मेरे भाई को company के MD, factory manager , production manager और supervisor एकसाथ मिलके mentally torcher और harassment कर रहे है resign देने के लिए..!!! और धमकी दे रहे हैं कि आप खुद resign करो वरना हम आपको terminate कर देंगे..!! 👆इस मामले में हम क्या करें...??? please reply me..👇

भाई जी मामला ये है कि,
दिल्ली का ही मामला ले लो...
एक लड़का बीए पास करके एक प्राइवेट कंपनी में सेल्स में का काम पकड़ा।
शुरुआत में उसको साढ़े 12 हज़ार रुपये प्रति माह सेलरी कंपनी ने देना शुरु किया। जिसमे से मात्र 7500 रुपये ही इन हैंड आते थे।
लगभग एक वर्ष बीतने के बाद व्यक्ति के सेलरी में कंपनी द्वारा मामूली सा हिज़फा किया गया।
अचानक स्थिति ये देखने को मिली कि, जो पढ़ा लिखा लड़का डेढ़ साल से नौकरी करके रहा था और जो अनपढ़ लड़का फ्रेसर के रूप में कंपनी जॉइन किया है, दोनों की सैलरी में मात्र पांच सौ रूपये का डिफरेंस रखा गया।जिसके लिए पढ़े लिखे लड़के ने कंपनी का विरोध किया तो कंपनी ने रिजाइन देने की बात कह दी।
बीए पास लड़के ने जब श्रम मंत्रालय के वेबसाइटे पर द्वारा जारी प्रेस रिलीज में देखा तो गवर्मेंट के नियमानुसार उस लड़के की सैलरी लगभग चार- पांच हज़ार कम दी जा रही थी।जिसके लिए तुरंत लड़के ने ईपीएफओ की वेबसाइट पा अपनी प्रोफाइल चेक किया तो पता चला कि, ये कंपनी ईपीएफओ के किसी भो लड़के की क्वालिफिकेशन्स को सबमिट नही की है।ईपीएफओ की नजर में कंपनी ने सभी जूनियर कर्मचारियों को मजदूर साबित की है।
अगर ईपीएफओ के पास कर्मचारियों का क्वालिफिकेशन सबमिट किया रहता तो ईपीएफओ, कंपनी से खुद नियम के अनुसार कर्मचारियों का सेलरी लगवा कर उसी हिसाब से पीएफ काटती।
यही मामला है।

Sir company dismissed me without given single paisa (money), while I and my family totally dependent on it I,e., no any bank balance, becz of no any other source of income I became completely helpless I am searching for job but no one is giving me job at this age of 35 years with this type of dismissal letter with false allegations without non biased enquiry. मेरे भाई .. ने Mechanical diploma किया है और Mechanical engineering भी कि है बस last semester ka result आना बाकि है ..जो अगले 15 से 20 दिन में आ जायेगा.. " Ok..!! "
तो हुआ यु कि ..
मेरे भाई ने एक private limited company ( Engineering Division ) मे interview के लिए गया और उसे job के लिए select कर लिया गया । जब मेरे भाई को Appointment letter और Employee No. दिया जा रहा था तो मेरे भाई ने यह बात Company के HR से clear कर दी थी कि , मेरे engineering के last semester ka result अभी आया नहीं है.. जो अगले महीने तक आ जायेगा ..
तो please आप मुझे अभी as a diploma holder hire कर लिजिये.. तो Company के HR ने कहा कि कोई Problem नहीं है .. हम आपको as engineering hire कर रहे है बस अगले महीने में आपका result आते ही मुझे submit कर देना .. तो इस तरह मेरे भाई को job लग गई..OK..!!
और अब job करते हुए 10/12 हि दिन हुये है और HR ने भाई को call किया और कहा कि resign दे दो.. ओ भी person reason लिखो company ने कहा है ऐसा मत लिखना ( without any specific reason ??? ) तो भाई ने पुछा क्यु ..?? तो HR ने कहा कि आप हमारे education and qualification criteria मे fit नहीं हो.. पर भाई ने result की बात तो पहले से ही clear कर दी थी..!!
फिर भी भाई ने resign देने से साफ साफ मना कर दिया .. तो मेरे भाई को company के MD, factory manager , production manager और supervisor एकसाथ मिलके mentally torcher और harassment कर रहे है resign देने के लिए..!!! और धमकी दे रहे हैं कि आप खुद resign करो वरना हम आपको terminate कर देंगे..!!

I come a cross a Company which is not registered with ROC but illegally operating as Pvt Ltd company where to complain. I met Company Law Board office they say they take complaint for registered company only...where to file a complaint.
+Jayesh kothari hello I will suggest you to lodge a complaint with MCA using pgportal.gov.in. If they close your complaint stating that they don't handle complaints of unregistered companies then I think you will have to lodge a FIR with police. Whatever you do PLEASE BE VERY CAREFUL.
