Very insightful video. Questions: Delay in appraisal: Promised every year in April, but disclosed in September-November. Till then the employee is under dark. Any law the company is breaking? HR is having no answer or justification. Verbally said - no gratuity will be given, after 5 years. Abused, harassed and was forced to resign. Senior official calls home at night and abuses on mother in front of family. Complaints were filed to directors and HR - HR took no action. Says, forget it, it happens. Still not replying after writing several mails. What should the employee do after the above experience?
In India there is no such law which deals with the delay in appraisal from the employer. Appraisal is a right of employee if mentioned in the appointment letter. Some of the organisation do not conduct appraisal at all. Annual appraisal if mentioned in the appointment letter is granted to every employee. After 6 months or 1 year as mentioned in the letter appraisal is conducted to see and review the performance of the employee. Every employee is given with a form to fill in about the work they have done in the particular duration and their expectations from the employer or organisation. There could have been difficulties or there can be any other reason for not conducting the appraisal on time mentioned. You should have patience and wait for the appraisal. Proceeding legally will not be advisable for you for the reason that the proceedings can take time. You should ask your employer do state the reasons for the delay in appraisal. You should know how to handle such situations, if there is a genuine problem then you should support your employer this can create a good image of you in front of your employer. If appraisal of other employees have been done and only you are left out you should then confront and communicate with your employer or boss.
