Spelling isnt a cheap shot in legal writing, its a serious point. Mispelled words can be voided on documents, because a mispelled word can be argued as good as a nonsense word.
If they can't follow due diligence, something as simple as proofreading and making sure they have actual grounds that are solid for the order.. It actually reflects on them very badly as to their competency and overall case. You can't argue that you are even a good lawyer of standing with even a structured side argument or case if you can't even get the basics right. The NSW Police essentially investigate themselves now that the Police Division of the Ombudsmans office is gone...replaced by the LECC which has a very narrow scope.

I feel that the rules should be if anyone politician or working for the government is found guilty of corruption that they should not be entitled to their parliamentary Pension or pension to make them think twice about doing the wrong thing.
To the best of my knowledge that is the case. And the laws in nsw were recently changed that even if someone steps down and is found guilty of corruption afterwards they are no longer entitled to their pension
The entire pensions-for-pollies thing is shit. It made sense several decades ago when going into politics was effectively an end to your civilian career, but now it is just free extra money on top of the inevitable boardroom seats they get. And now you just get a bunch of has-beens and not-wanna-bees just hanging out long enough to qualify for their free money, doing nothing to earn it. Politicians should pay into some sort of compulsory superannuation like the rest of us. The longer they serve, and the higher the level of their service, the more they get back at retirement.

The costs orders should be against the police officer personally on an indemnity basis. It will be interesting to see how they re-draft their application and what affidavit evidence in support they will file, not to mention their submissions at the end of the case. The court is our last defence against this over reach.

I agree with the decision the magistrate made today refusing the prosecution's request to take down the video and so I've decided to subscribe to your channel. Spelling isnt a cheap shot in legal writing, its a serious point. Mispelled words can be voided on documents, because a mispelled word can be argued as good as a nonsense word.
If they can't follow due diligence, something as simple as proofreading and making sure they have actual grounds that are solid for the order.. It actually reflects on them very badly as to their competency and overall case. You can't argue that you are even a good lawyer of standing with even a structured side argument or case if you can't even get the basics right. The entire pensions-for-pollies thing is shit. It made sense several decades ago when going into politics was effectively an end to your civilian career, but now it is just free extra money on top of the inevitable boardroom seats they get. And now you just get a bunch of has-beens and not-wanna-bees just hanging out long enough to qualify for their free money, doing nothing to earn it.
Politicians should pay into some sort of compulsory superannuation like the rest of us. The longer they serve, and the higher the level of their service, the more they get back at retirement.

The costs orders should be against the police officer personally on an indemnity basis. It will be interesting to see how they re-draft their application and what affidavit evidence in support they will file, not to mention their submissions at the end of the case. The court is our last defence against this over reach.
