    Maraming salamat atty sa mga info na binabahagi nyo, I really learn a lot. Napansin ko po sa subd lot plan ang nakalgay sa owner of land at ang nakasign is yung taong binigyan ng SPA na nakatira sa Canada. Sino po ba dapat ang nakapirma ang owner or yung may SPA?At valid po ba ang SPA kung HINDI notarized mismo sa Embassy ng Phils sa Canada dahil hindi sila kasali sa Hague apostille convention.

    tanong ko lang po kc ang lupa ko po 47sqm at ang lupa ng kapatid ko ay 55 sqm magkatabi po ..mana po namin sa mama namin pero wala pang tax declaration certificate.pero na sub divide na po ito ng kapatid kong geodetic eng. at may titulo kaya lang hind pa nalipat sa pangalan namin nasa isang papel pa. ngayon po ang pinasa po sa city hall ng kapatid kong geodetic eng. ay walang bahay ang dalawang lote. pero every year po kami nagbabayad ng amelyar at ang amelyar nakapangalan pa po sa mama ko ngayon po gusto ko po kumuha ng tax declaration certificate at ipa survey ang bahay ko para malipat na po sa pangalan ko ang amelyar. magkano kaya po ang babayaran at ano po ang mga requerments..thank you po sa sagot

      I am not an attorney but very concerned in your situation. I believe your mom is still strong and intended to give to you and your brother the lots. The tax declaration reveals the land only, no building . In your case, with your brother wanting to have tax declaration separately, likewise with proper different surveys, need be pondered on. For one, your mom needs to issue a deed of donation or other legal matters to change the ownership intended to you and your brother. If you have secured it, you can have the TCT, tax declaration(land only), and other necessary documents relating to acquiring land. There is a glaring fraudulent declaration on said lot. You may find yourself and your brother to be penalised by the assessors office for not declaring there are buildings on it. Secure and pay the penalty first before transferring the lot to your name and your brother.

    The Survey Fee depends on what region the land/Lot is situated.
    every region po ay meron approved na taripa :) Bali iba iba ang rate depende kung saan region :)

      Kailangan pag nagpasurvey kayo siguraduhin na ang Geodetic Engr ay kasama sa actual b survey dahil maraming surveyor na inaasa Lang sa mga taohan na Hindi bihasa sa survey dahil baka ang mangyayari ang lupa kanilang survey ay NASA bundok o Kaya NASA dagad maraming Hindi magandang pangyayari sa survey.

      Good p.m sir ask ko lang halimbawa ang lupa na wala pang mga document maliban sa barangay na document lang pinanghahawakan nya na nagpapatunay na siya ang may ari ng lupa ay pwede bang mapa survey for future titling. Salamat po sa opinion.

      @@elsonsralbao5711 if that's the case, possible din bang magkaroon ng error sa pag sukat ng portion ng lote kung wala mismo yung engineer sa location? I think ganyan ang nangyari sa lupa ng mama ko at mga kapatid nya. Originally, 129sq yung lote ng uncle ko. Katabi ng bahay namin ang lote nila. Then there's somebody na nakabili umano ng lote ng uncle ko at may deed of sale na, naka indicate dun na 171sq m daw yung loteng binili nila. So, damay yung lupang kinatitirikan ng bhay namin pag nagkaton. Nagtataka kami kung paano sila nagkaroon ng ganung sukat na 171sqm, eh ang nasa original ay 129sqm lang.

    Atty, Please discuss in your next video the issue about "Barangay Certificate". Paano process ng pagpatitle ng barangay certificate? Is it safe to buy a land with barangay certificate only? What are the due diligence to make it safe to buy a land with barangay cetificate only?

      The rule of thumb when buying property is as you mentioned the observance of due diligence. Is the property legit? Check and confirm the identity of the seller, wiith at least 2 government issued IDs, secure a barangay certicate na kujng seller ay legitimate at kilala sa barangay, kasama rin sa barangay certificate ay walang naghahabol at walang pending na complaints or reklamo na sa record ng batangay hinggil sa nasging property. Ask first copy of the document(Tax Declaration Certificate, title, Deeds, legal notarized documents,etc). Then check it out with the Assessor's office, Regisgter of deeds(RD) the status of the subject property. Is the seller legit? showing ownership or real rights of the seller. Mayroon bang kaso, liens, adverse claims ung lupa na naka annotate sa title at sa Tax Declaration Certificate . Ang barangay certificate may be worth its contents and purpose(s), pero walang kakakayarang at records ang barangay sa mga transactions ng lupa, tulad ng sanglaan, bintahan, o pagpapaupa nito, among others. Maraming mga incidente na ung seller at buyer ay nagkarooon ng bihihan ng property na naisagawa sa barangay at witness ng mga barangay officials. Maaring magamit ito na nagkaroon ng nasabing transactions. Pero kung hindi ito mapanotaryo, ito ay mananatiling isang private document lamang, at hindi ito kikilalanin ng Assessor's office, BIR at ng RD for purposes of registration. Maari lang magamit ung barangay exectuted na bilihan na hindi notarized, kung dadaan muna sa korte ito upang mapatunayan ang due execution nito ng mga seller at buyer at ganoon na rin ung kanilang naging testigo. Masuyadong hassle at magastos pa ito in contrast sa notarized na deed of sale or documents na hindi na kailanganin pang patunayan sa korte ang due execution nito, dahil sapat na ang acknowledg,ment of NOTARY PUBLIC na sa kanyang harapan at pag pirmahan ung seller at buyer at ung mga testigo voluntarily at freely doon sa nasabiing dokomento.xxx

    Sir, paano magpasurvey kung may pumigil sa pagsubdivide ng mother title.?
    Yung taong pumipigil ay taong nkabili sa isang lot ng mother title.

    Atty. Ang lupa namin ay epancipation patent (EP) na sakop ng Dept. of Agrarian reporm.Ito po ay mayroon n ring title (marami kami), ito po ay nagkaroon ng panibagong survey n ginawa ng ahensia dahilan sa ang iba ay malaki ang sinasaka ngunit maliit ang nasa titulo. Nacancelled ang unang survey with finality at dapat ay ung bagong survey na ang sundin ngunit d nalagyan ng muhon kaya hindi eksakto ang sukat ng boundary sa aming karatig/katabing lupa.Paano po ang aking gagawin para malaman ang exact n sukat ng lupa at malagyan ng muhon, Dahil s ito ay sakop ng Agrarian reporm at tinatiman pa ng palay pwede bang ang surveyor ng gobyerno ang gumawa nito at anong ahensya po ang magsasagawa at magkano ang babayaran. Bigyan nyo po ako ng guidelines o proseso sa problema kong ito, salamat po sa sagot nyo.

      Upang ma resolba ang issue ng overlapping ay makipag ugnanayan kayo sa DAR. Ang nasabing office ang pinag huhugutan ng karapatan ng mga contesting land reform beneficiaries upang maisagawa ang relocation/verification survey. Ang main purpose ng RELOCATION/VERIFICATION survey duly approved ng LMB-DENR is determine the OVERLAPPING ANG CONFLICTING boundary lines at markers/mujon ng mga karatig na land owners at maitama ito.
      Kahit ang EP ay nasa issued sa ilalim ng P.D. No.27, ang pananaw ng batas pinoy ay applicable pa rin ang Section 37 ng R.A.No.6657(CARP/CARL) the DAR is mandateed to provided support Services to the Beneficiaries. - The PARC shall ensure that support services to farmers- beneficiaries are provided, such as:
      (a) Land surveys and titling;
      (b) Liberalized terms on credit facilities and production loans;
      (c) Extension services by way of planting, cropping, production and post-harvest technology transfer, as well as marketing and management assistance and support to cooperatives and farmers' organizations;
      (d) Infrastructure such as access trails, mini-dams, public utilities, marketing and storage facilities; and
      (e) Research, production and use of organic fertilizers and other local substances necessary in farming and cultivation xxx
      xxx xxx
      Sa inyong pakikipag ugnayan sa DAR issue ng gastos sa pag papasurvey ay maari ninyong idulog dahil mayroong kaukulang pundo ito naka laan para sa mga support services ng mga land reform beneficiaries tulad ng sa issue ng land surveys at titling na nabanggit sa itaas.

Nakabili po kami lupa portion lang po ng kabuuan den may deed of sale na rin po ang nkalagay lang po sa deed of sale ay measurement lng in square meter wala pong technical description kc di pa po nasurvey paanu po ngayun ang pagpatitulo? Tsaka po during sa pirmahan ng deed of sale buhay pa po ang may ari den siya ang nakapirma tpos ngayun patay na po. At ngayun po ang nlalagay po kc sa deed of sale ang nabenta ng may ari ay 1119 square meter tpos nagcancel ang heirs ayaw nya na ibenta ang share niya pwd pA po kya mabago ang deed of sale?

    Atty.. napakareklamador pala ng mga surveyor na mga kakilala nyo...ang daming iniimbetong mga dahilan na ang intensyon ay mapataas ang bayad sa kanilang mga serbisyo..ang tanging intesyon lang nman ng mayari ng lupa ay ang malaman ang tamang sukat ng lupa base sa titulo...yung lang po...wala ng iba..

      Sorry wala akong nire-commend at inindorse na surveyor. Masama po ang mag bintang ng walang basiahan maari kayong makasuhan. Kung ayaw ninyo sa nasabing surveyor ay palitan ninyo. Pag may paglabag sa tungkulim ay mag file kayo ng administrative complaint sa PRC.

    ang ibig ko sabihin may lupa na mana sa nanay niya, tapos sa tagal ng panahon dahil sa busy sa trabaho, mga anak hindi nila asikaso na ipalagay sa kanilang pangalan ang lupa,pero may meron silang attorney na siyang nakakaalm sa document nila ,ng asisikasuhin nila may nag angkin sa lupa nila at pinawalan bisa ang pagiging may ari sa lupa nila sa governemt sa lupa,bakit ganoon inangkin ng lupa nila wala man lang notice kung hindi nila asikaso ang lupa, biglang inangkin at napa tituluhan ng ibang tao wala man lang ginawa ang attorney nila na siyang may usapan na 1/3 ng lupa ay sa kanya bilang bayad sa kanya.

    Dapat pag hahatiin ng magka kapatid ang kanilang lupang minana sa kanilang magulang ay mag lagay muna sila ng right of way..para pag ibenta nila ang lupa ay walang maging problema sa buyer at seller...
