  • Alright ladies and gentlemen, welcome back to San Joaquin Junior. Today’s video is from the channel one love entertainment, so be sure to head over to his channel, and give him the credit he deserves. On May 19th, 2023, this man recording was trying to navigate his way through some traffic, which he explains, and that triggers an officer, from the Cumberland Police Department, to pull him over. During the traffic stop though, the officer decides to extend the stop by waiting for a canine unit to arrive. This obviously gets a rise out of the driver, understandably so, but lets just play the video and break a few things down.

      It's all just fishing for crimes. They pick someone out who looks like they might be involved in criminal activity and they turn a simple traffic ticket into canine search. They don't do this to a clean cut man in a suit because there is a high chance he is a man with money and power. Their jobs are done with pure discrimination and it's sickening.

      @@skillethead15 Not really. They pick young males to pull over and lie about traffic violation they cite them for. Cops in the past couple of years are trying to search your vehicle and put you in jail. Doesn't matter if it gets thrown out in court. They are judged by how many arrests they get. Harder to bust criminals because the Cops could get into a civil rights issue or Cops could be deleted from gunfire.

      Its bad when the supervisor act the same way. But 75% of the time the supervisor knows the laws and will correct his deputies. But still even tho they have to come out and train there deputies it should of been done before they go out on patrol. IV e seen a lot of cop videos and I have to say. I have seen more corrupt cop videos than I have good cop video's. Once that badge goes on or once there a cop there thoughts of the laws and peoples rights go out the window. No respect for any citizen. People Don t realize how bad it used to be in the 80s and 90s even before when cameras or video wasnt accessible. Cops got away with way more its just now starting to come to light and people think its just now starting when its been going on. As well as people knowing there rights.

      I can imagine from their perspective its like TSA “randomly selecting people” but the selecting isn’t random. It’s based on stereotypes and characters.     This is SO racially motivated!!! The fact that they’ve continually harassed this guy over and over for petty offenses that may or not be true can’t be explained any other way.
    And it’s not just Mississippi plates, either. I can guarantee that if a Caucasian person had Mississippi plates, unless they did something egregious, they’d leave them alone.       In my opinion this will be considered legal stop
      They can have a dog sniff the car but cannot prolong the original reason for the stop
      Usually the second cop. It would be a canine officer who will run the dog while the other officer will run the license
      And technically cops are allowed to control the stops by demanding passenger or drivers to exit the vehicle

      They can extend the stop. A dog does not have to be on the scene when the stop occurs, but must be brought to the scene within a reasonable time. Courts have ruled within a half hour.

      This driver messed up, when he said "bring the dogs" that allows the stop to be extended, otherwise I think they have 20 minutes to ticket you on a traffic stop.

    Wait…the cop ordered a dog after the driver refused a search. I never heard the cop say that he smelled any drugs. This stop is the epitome of profiling!!

      I'm from this area. Cumberland has a BIG drug problem. Cumberland police CITY cops are 1000x worse than the state cops here. New York gang style behavior. They have someone on the force who wrecked and un-alived a motorcyclist after being told not to pursue. They will stop ANYONE for ANY reason with out of town plates to justify a search. The murderous cops name that killed the cyclist is "Officer Christopher Hill" If you call to complain add him in there. There is a petition with over 1300 votes to fire him. This cop is a law breaking PIG. MANY people HATE this COP here!

      Yep. They just realized they'd already fully stepped in it on camera and the whole dog sniff would be thrown out, so they called it quits at that moment. They knew trying to further violate this man's rights would just land them in a deeper lawsuit, which is the only reason there was no hit by the dog.

      old friend of mine was a K9 handler and he said the same thing. dog is trained to react exactly like they say....and to also get a "hit" on very specific commands or gestures. he got so sick of the shit he saw he eventually quit LEO work and went back into the Marines, said it was way more honest work.

      Even then, literally any dog trainer will tell you that an 80% success rate on commands is excellent. Dogs aren't even as effective as they claim to be when the handler *isn't* commanding the dog to "alert".

      the Supreme Court held that the police can make you get out of your car after a valid traffic stop. This ruling applies to the driver and all the passengers in a car. Because of this ruling in Pennsylvania vs. Mimms, a person must exit their car if ordered to do so by the police.

      Pennsylvania vs. Mimms allows them to order him out of the vehicle during a lawful traffic stop. I am reasonably confident that this was not, and thus they have no right to detain him or give him orders.

      I had a cop ask me to step out of the vehicle and they forced their way into the vehicle as I was stepping out so they could unlock the passenger door. I didn't have automatic door locks in that vehicle they were all manual. If the cop wanted to be even more of a dick they could have gotten me for simple battery on a police officer because of our physical contact as he forced his way into my vehicle.
      The locking of doors and rolling up windows doesn't always work. Even if you can do that and you have the keys on you they will put you in cuff and take your keys so they can gain entry into the vehicle and then claim they had "probable cause" to search after the fact.

    Actually for a Terry stop on a traffic violation, the police are NOT allowed to extend the stop to "get a dog" there without probable cause. The courts have ruled on this before. Twenty minutes is considered the limit for a normal traffic stop. I also noted that the dog handler tried to get the driver to incriminate himself by asking a question under the guise of "just want to make sure the dog is doing his job correctly... has this car ever had illegal drugs in it before". If the driver had been dumb enough to have said Yes, they would have been able to use that to remove him from the car and do a search of the vehicle.

    The fact that the COP is the one who opened the door blocking him from closing it; HE is NOT ALLOWED to do that at all because that alone is a violation of the 4th amendment for illegal search and seizure (United States vs Ngumezi - 9th Circuit 2020)

    The fact that the first officer threatened to forcefully remove him without actually doing it is a huge indicator that he knew he had no legal right to go that far. He was simply trying to employ a scare tactic on this man to trick him into giving up his rights. I feel like this is way too many cops these days. It's almost as if they're trained to do things this way.

    If this is an on going issue of him getting pulled over, held while a dog is brought to the scene to walk around the car with him getting warnings each time, it's Harassment by cops and is an issue he can File a Lawsuit over with it proven in court he can and will win

    Remember, if the dog has to be brought to the sceen , they can only make you wait for the amount of time it takes to reasonably run your info and write a ticket . Tell them you're not waiting.

      ​@@amendez4922 I used to get stop by police for drinking it's funny after they found out on their radio by the police station, they was so embarrassed, because i never drink before never did any drugs before work and back home workout with my weighs at home or at my school employee gym cook my own food and i live alone rent free never been married or got any kids and i hate club's and bars and i have a clean record, and i still drink and drive yes im the MILKMAN that's the only thing i drink in place of water, but driving with a gallon of milk is not normal especially when you are black, but I'm raise different, anything the police can't get you for that's what i do, what they can get you for i don't do, George Stinney i even bring his name up to the police yes because he was innocent black kid that they put in the electric chair Google it for yourself, but we know a white person did it but frame that little black kid

      It’s not his “right”. You are just wrong, and encourage stupid behavior. Officers were completely in the right. They are allowed to ask individuals out of the vehicle (Pennsylvania V. Mimms and Maryland V. Wilson). Failure to obey these orders can lead to arrest.
      These officers were patient. If they were true “tyrants”, they could have ripped him out of vehicle and arrest him on spot for refusing to exit vehicle. But they did not. They just got tired of dealing with his stupid ass. I think they quickly figured out he was too stupid to be any kind of real criminal.
