      I’ve not looked into that option. You can do it as well. You have to provide all your Indian passport information ℹ️

Specifically, after clicking on YES (applying as Foreign Indian Spouse) They ask about the address of both (address abroad/ India) What address I should put? Our home in the US or our address in India. (we currently live in the USA) but also have an address in India. This part is on 9:42 minutes of your video OCI. Looking forward to your response.     Hi thanks for posting this. I don’t see this option on your screen but I’m seeing “Relation with the root Indian”. I have an OCI card while my wife is Us born and US citizen. The drop down does not have “Spouse”. Should I select “Self”?

      Yes. They ask basic questions like how you two met? When you all got married etc. Very similar to GC interview by USCIS but very short and to the point.
      They also ask for photos if available of you two and kids (if you have kids)

    Hi VK! How were you notified of your interview, and were you able to request to do the interview online? Did they seem flexible about that? I am wanting to travel overseas, and not knowing when the interview will be, I am hesitant to wait in the US for that.... Thanks for any advice!

      Yes I got email from embassy for interview. They did a video call due to CoVID. Not sure now if it’s back in person

    Hi, thanks for the video, really helpful! I have one question that i can’t seem to get answer for, hope you can help. Basically, i have OCI (applied via myself as a former indian origin), this was approved when i was single. I have since then got married, do i need to update/renew my OCI card to show i’m married and add my Mrs name on the card, or is that not necessary? Please help. Thanks

      @@varunkapoor2159 good to add the spouse name but it’s not mandatory from what i’ve been told. If u wish to add spouse name, you need to apply under miscellaneous chargeable service at VFS with the marriage certificate.
      I also travelled to India recently without adding my spouse name on OCI, had no issues at the airport.
      It might be worth contacting indian embassy and have them confirm the above on an email, and travel with that proof to avoid any issues.

      @cristiano quick question , when you applied for spouse OCI, was it required to send a copy of your OCI with spouse name on it . Because currently they are asking for it but I am not sure if it a soft ask or mandatory

      You have to prioritize what’s important and do it I guess. It’s just as important as the Green card interview

      If husband/wife of foreign spouse is still Indian citizen you don’t need to enter your OCI number (as you don’t have one)

      If you yourself are former Indian citizen. You don’t need to apply via foreign spouse. You can do it yourself

      Yes, and it needs to be apostilled wherever its acceptable. I did my wife's birth certificate before sending her documents.

    How can I obtain a appostilled marriage certificate? You also mention about the "Sworn affidavit". I do not see that in the VFS portal. where do i obtain it?

      Apostille needs to be done by state govt if married in US state. If abroad or in India, you need to confirm with Indian Embassy on that portion.
      For sworn affidavit, template is mentioned on checklist on VFS site

    Additional documents : Application is being submitted to Consulate for applicant's interview,
    No instruction on how to schedule for interview at consulate. Did you schedule, or they scheduled it for you. Thank you

      Yes. You need 2 years of marriage to be eligible for OCI for foreign spouse (please check rules)

    Thanks for this video. I am a US citizen now (Formerly Indian citizen) and my wife is foreign spouse. We are in the process of applying OCI for our family (Us & 2 kids). Is my wife eligible to apply now since I am not an Indian citizen now and do not have the OCI yet. Does she have to wait until I get my OCI? I know my kids are eligible.

      You are most welcome. Yes. You can start your process first. Renunciation, then OCI then your wife’s. In spouse OCI card they do ask for Indian origin spouse OCI. So do it per your convenience

    Hi VK, I am an Indian Origin OCI holder but recently got my US passport renewed. I have not updated my new passport info using the OCI Misc Services yet. I am helping my spouse (who is American citizen) apply for OCI. There is a part of the application that asks for the passport number of the applicant's spouse (basically my passport number in this case). Should I provide my old passport number here or the NEW one (which has not been updated via Misc Services)? Or do I first update my new passport info using OCI Misc Services, wait for that to happen, and then have my wife apply and enter my new/ updated passport number? (I received my OCI when I was 36, and have not yet turned 50, so I don't need to renew OCI per your other video/ updated rules).

    My husband was born in Canada and has OCI based on his parents both being born in India. I am a U.S. citizen not of Indian origin and we married in the US two and a half years ago. My husband would like to move to india and start a business there. Can I apply for OCI on the basis of my husband’s OCI, even though he received it on the basis of his parents?

      Yes you can. Since he is of Indian origin and is still 2nd generation Indian. I think it’s not possible after the 3rd generation. In your case you can, you will have to send all docs for your husbands OCI and supporting docs on how he got it.

    Can you help me if name change is required for foreign spouse OCI? Never got correct answer so far.
    Note: Applicant should submit a copy of Indian origin spouse's Indian passport that reflects the name of the foreign spouse. If foreign spouse's name is not reflected in the Indian passport, the Indian origin spouse should get his/her Indian passport re-issued to include the foreign spouse's name.

    Hi you mention that the foreign spouse needs to submit an aposstille birth certificate, however when I go through the checklist for foreign spouse it does not say that the birth certificate has to be aposstille, only marriage certificate. Can you clarify this?
    Also, the checklist is a bit puzzling how it mentions root Indian spouse's OCI card as mandatory. What if the root Indian is still a citizen of India (did not naturalize) and acquired a green card for permanent residency? I saw couple of comments raising similar query, however the answers to them are a bit different, would you kindly clarify it again?
    Lastly, when I upload my documents do my pdf uploaded versions need to be self-attested as well (print-->attest-->scan-->upload) or that requirement is only for physical copy?
    Okay one more last question, under the checklist for spouse of foreign origin document, there is a document copy mentioned as "native address detail from the country of nationality...non us nationals residing in USA on a valid visa....address proof of home country...." does that apply to us? Since my spouse is a non us national on green card? What does a notorized statement as an alternative mean? What is this statement?

      #1. Yes apostille marriage certificate should be enough. I went ahead and apostille wife’s birth certificate as well as when I was uploading the doc. The version of checklist mentioned apostille Birth certificate.
      #2 if root Indian is still Indian citizen, just submit all those documents.
      #3 only physical copies sent in packet need to be self attested where noted.
      Uploading docs don’t need to be. Hope these help

      Yes, as long as you have all documents mentioned in the above document checklist (latest) you should be good to go

      OCI Card rules are same/similar for all Indians. Docs needed to submit might vary. Check local vfs site for details

      @@ahsk123 not sure about that. Please check the rules for OCI once. Maybe for kids might be okay. Best to consult with the Embassy or Mission.
      Why don’t you take visas if that’s an option

      Yes you can. But first Indian origin spouse need to do the needful before it’s done for for foreign spouse and foreign born child. This is what I followed, just an advice. Do what works for your situation

    What about VFS registration process. Do you select New OCI category or Foreign Spouse category? As they don’t have foreign spouse category if you already have VFS account and adding new customer. Kindly let me know

      You need to create a separate account for the spouse. You cannot use the same account. Hope this helps

      Also sometimes Indian embassy might also apostille Indian origin documents. Hopefully VFS/Embassy can get you an answer. Good luck with your application

      Apostille is only needed for a document issued by a country/state which will be presented to another country/state
      (provided the issuing country and the receiving country are both signatories to the Apostille Convention).
      So, if the Marriage Certificate is issues by India and it will be presented to a government agency/office in India, no need to apostille.
