Mere verbalization on issue that is not before the court is a waste of court's time. The judge is magnanimous to allow people express their emotions which is good for their mental health but in reality, of no consequence on the determination of the matter before the court. You will see that the judge went over the claims of both parties at the beginning of the matter and both parties agreed to why they are in court. Domestic Violence is not one of their claims if you listened carefully. There is a separate and different procedure for domestic violence which is a criminal matter. You cannot report a civil case to the court and bring in narration on criminal matter in between, the court proceeding does not work that way. The best any Judge can do in such scenario is to caution / advise the parties, the Judge cannot make judgement on a matter not filled before it.

What you described is exactly the same way it works in Nigeria. The kids stay with their mum during the week, and they go to school from their - That is custody. Their Father takes the kids every weekend / other week for visit - That is access. Don't mix having access to the children with having custody of the children.

You can't have your children under the roof of someone else, your mother for that matter & expect your separated husband to go there visiting in the name of going there to see his own children. What you described is exactly the same way it works in Nigeria. The kids stay with their mum during the week, and they go to school from their - That is custody. Their Father takes the kids every weekend / other week for visit - That is access. Don't mix having access to the children with having custody of the children.

The court system should begin to address this automatic custody to mothers. Gone are those days when motherhood is synonymous to nurture( many women don't even want to breastfeed anymore). The world is largely what it is today because of the absence of fathers from the home either by faults of theirs or otherwise. The system should not make it worse and father's should step up to the plate. Women should remain feminine and leave masculinity for those nature intends.

You can't have your children under the roof of someone else, your mother for that matter & expect your separated husband to go there visiting in the name of going there to see his own children. You live in Lagos while your underage children live in Ibadan. That simply means abandonment of motherly responsibility. Thank God she agreed to the judge's intervention. Otherwise, I believe the custody would have been taken away from her.
