You are wrong. Nigerians have this belief that next of kin is who will inherit, however, the true definition of next of kin is one who is prioritized to retrieving a late person's assets. So, even if he pais, the son can only retrieve and not inherit. What guarantees inheritance is will. If the father has willed his estates to the elderly man who's the defendant, then all the properties belong to him and no one can take him to court. That's why having a will is very very important.
