Standing up for photographers rights on Dallas DART train Orange line

- (10-17-2013) Me and a good friend (youtube user gluse) were taking a trip downtown on the DART train. We got on at galatyn park station and were going downtown, We love to shoot videos of our experiences. At the very next station Arapaho Center Station, The driver tells me that photography is not allowed on dart as you will see in this video.. I politely tell him that DART is funded by taxpayers and that I have the right to take photos. He goes back into the driver seat. At the next stop (not on video) he comes out again as apologizes and told me he did not know I had the right to take photos. Before I got off the 2 people in the front seat of the train applaud me for standing up for my rights.

I stated that in the video. The reason I put this up is to show people how important it is to stand up for our rights as Americans..
We need to stand up for our rights. EVEN IN SMALL cases such as this is still makes an impact.
Back about a year ago, I was filming the entire ride on the Metro Rail and after we stopped at the end of the track, the driver came off and asked if I was taking pictures and I told yes and he laughed & smiled. :)

THAT POLICY is illegal. if it is taxpayer funded you can take photos.
And unfortunately the Port Authority Trans-Hudson in NJ/NY actually has a photoban that can result in confiscation and arrest. Same idea as Simon. It’s beyond ridiculous and I have been harassed before. Almost cost me my camera. One day if we can petition for the removal and if it actually we will all be happy, but won’t be happening anytime soon sadly because of phobia and safety concerns.

Andrew, this wasn't harassment, the driver for some reason thought photography wasn't allowed but he apologized. I think this video should be titled "Standing up for photographers rights on Dallas DART train Orange line".

Thank you!!!! I think every transit system lets you film but the drivers and stuff DONT want to for some reason! I even read the policy’s before filming. Thanks for standing up for it

Thanks to the efforts of neighborhood activist Avi Adelman, DART no longer enforces the no photography policy at Cityplace, per a Dallas Observer article from June 6, 2014. When I was in Cityplace yesterday, I did indeed notice that the signs had been taken down.
This is totally awesome! We need more people to stand up for the 1st amendment.

You can get a list of every single elevator in the state of Texas from there public saftey website that list type and instillation date.
He apologized and you are still complaining. The only time I've seen DART Police say something to a person filming is if they are too close to the tracks.
A few times when I rode the (6) & (Q) Trains, the driver of the train in the front cab sometimes blocks my camera, because he or she thinks photography isn't allowed, but I am not to sure.
I agree! To all those idiots thinking photography is a crime, it is not. If you watched this video and you are an elevator photographer, chill, no need to be as scared as p*ssing your pants.

Back in March I was harassed by security for filming at a dead mall. They told me i could not film without permission from management. When I logged a complaint from management, they told me the same thing, giving me bullshit excuses. I was incredibly pissed off. I wrote a bad review of the property on Yelp.

You were not harassed. You were just told something wrong, told him the rules and he apologized.
Great video, but maybe you could have made it sound less serious since you did have a happy ending. It is pretty cool that you could get a good forward (driver's) view. Those views are the best, in my opinion. The train operator's cab looks pretty open and not cramped. Will more videos of DART be coming soon?
Reminds me of the Port Authority of NY & NJ, minus the 5+ PA police officers, 3 detectives and a sergeant... oh and being interrogated, accused of terrorism, having my property searched, spending 3+ hours in a cell and detectives threatening and intimidating my mother as a way of getting permission to search all my things (a last resort for them to possibly get an arrest) when I refused and others who know the law advised us not to consent to anything. All over a video I shot with my iPhone.

Another thing that I recommend you not to do is "what's-so-called" joy-filming. It means you run around filming around while people are around you and it's sometimes suspicious and you can end up getting busted. If I went on the Light Rail in Houston, I'll just film and not disturb anyone.
If you do get busted for filming on the train. Be polite to the driver other Metro Personal and say, "I'm sorry sir. This is a public transit system. It's funded by taxpayers, first amendment rights apply here.

In Malaysia, when people take a video at border or even roadblocks. The police said: If you wish to keep that video/ photos, you should pay RM30/minute video OR RM15/photo.
Because someone will upload to youtube and say that we are criminal.
But in Malaysia, like supermarket, they give flim but some area can't flim.
Other public area allowed to flim the area is beautiful.
That's the problem, transit employees, even here in Canada are misinformed about the rules on photography. That's why as transit photographers, it's our duty to let them know, politely, that what we do is a hobby and it is legal. I also add the fact that we are documenting transit history in the city we're in. I started using that fact when I went to do pictures of Kingston (Ontario) Transit buses back in October and the drivers were cool with that.
Here in the Greater Montreal Area, I only had one major confrontation with a Réseau de transport de Longueuil driver in Saint-Bruno-de-Montarville in '09. He called the police on me and had his passengers waiting in the bus for 30 minutes. So I was told by the police officers, after I told them what I was doing was legal, that if I wanted to take pictures of buses, I should ocntact thr RTL and ask them to go to the garages (Vieux-Longueuil and Saint-Hubert) and ask to take pictures of the buses there.
I found that ridiculous and I still to this day take bus pictures wherever I wish, without impeding the flow of traffic armed with some calling cards I made explaining my hobby and with my point-and-shoot digital still camera. :)
Dart made a mistake, but the war on simion; turns out that simion has every tight to stop photography.
Don't try that on Veolia routes in Austin, I had an incident over my videotaping by one #383 bus driver Mauricio Rodriguez. unless you are using a hidden spycam. That's why I bought one. And I investigate unruly bus drivers. I also tape phone conversations with the public transit agency, because Texas is a One Party Consent state (until Wendy Davis becomes Governor, which I hope she will not) we are allowed to tape phone calls that we make without the other person's consent.
I wouldn't call that harassment.

At least DART lets you take videos. I was told by HRT (The Tide Light Rail) that videos on the train and station platforms are not allowed without a permit due to "safety and security reasons." To be honest, I just think they're scared that they're gonna get caught on video doing something wrong. I haven't been on The Tide since because of how I was treated, and do not intend to ride it anytime soon. At least you had a happy ending. I didn't.

Imagine me inside the dart light rail recording until the operator comes out to say “Hey I’m sorry sir but you can’t take either photos or videos on the train.” I think my only answer to them is to say “Uhh what do you mean I can’t take videos and photos of the train? I mean I’m just doing a TH-cam video and a short tour of the Dart Light Rail itself that’s all.” And then the operator will be like “Ohh ok well I deeply apologize for that sir. Go ahead and continue on what you’re doing, but don’t try to record any of the passengers inside the train, cause they will have to call our police department for that.” And then I’ll be like “Yeah no problem, I’ll try to be extra careful on where I’m recording.” And then the operator goes back to the cab politely and gives me a thumbs up 👍. That’s how I want to say to them if I’m accidentally recording stuff for no reason.

You forget to just say it was for personal use. You do have to have approval from the transit authority for video or photography that's going to be for commercial use, which is probably why he was mistaken.

I’ve been on the train that goes to Fort Worth one we where so close to the station and then it derailed so they had to send us back to Grapevine by taking a bus
I have taken a trip to LA in 2007 and I have taken pictures of the Metro - no one harassed me period. Unfortunately TH-cam won't let me post URLs in comments.
As long as you do not stray into restricted areas you are fine. Be glad we live in America and not in a country where civil liberties are not respected and harassment for legal activities such as taking photographs is commonplace. On a side note, in some countries you need a permit to take photos.

Ive spoken to dart officials about this. The actual rule is no commercial photography.. Just taking pics for personal use with non obstructive equipment is all ok. .. But yea the dart employees should be better informed.
That's the same rules for Houston METRO, I use my visible camcorder and filmed the 81 without any issues.

I do get the driver's point, however I would have simply asked if you could stop. If you said you wanted to keep filming, I would have respected that since there's nothing wrong. It's all personal preference.

The DART train person told you not to take pictures. And you we're going to downtown Dallas
And and that driver was a dumb ass as well, it's first amendment rights by Congress, however, you have to get approval before you do it, that is what most transit agencies do.
Others have had problems with Dallas' transit employees and or police erroneously thinking people can't record in public. First Amendment rights do apply in the case of a transit agency operated by a government agency.

I live in Dallas Texas and yes the train operators are not to be disturbed while the train is in motion. You're not supposed to video tape them. Your lucky DART Police were not on the train with you cause they would make you get off. It's a DART rule to never disturb the train operator and that includes video taping.
If that's true then y'all really have some problems there but it's Dallas so I guess they might get bothered by anything.
Nothing wrong with Dallas man its just they have rules and regulations just like everywhere else. You can videotape the surroundings just not the driver. Where you live don't they have rules and regulations that must be followed or do you live in a place where everyone does as they please?

DART seems like a much better and cleaner system than WMATA.
WMATA and DART are to different systems, one is a light rail and one is a subway. Can't really compare the two.
I mean like it is much cleaner and more desirable than WMATA. I would take DART any day over WMATA.
Except that, with the exception of the Pentagon Station - which may be at DOD's insistence - WMATA has no problems with people filming on transit vehicles and at transit stations. I've also found WMATA trains stations and (usually) buses to be clean.
You are comparing apples and oranges, Aaron. This is light rail, that is rapid transit.
From the videos that I have seen on YouTune, this is anything but "harassment."
Definitely not as bad as when you were harassed by for taking pictures in that building (forgot the name) and they phoned the cops.
