Have they looked at seeking an injunction to prevent the company from breaking the law? If they got such an injunction, then the company could be hauled into court for contempt if it continues.
Should have spoken to my parents. They have lived here for over 40 years. This is nothing new. Been going on for decades. Norfolk Southern blocks that damn crossing for hours at a time they dont give a damn. The only reason we even have crossing gates is because a woman was nearly killed at that crossing
Ohio does not have state police. Ohio has the Ohio Highway patrol and it is just that. They enforce traffic laws, investigate traffic accidents, and DUI enforcement. They only have jurisdiction on state property unless requested to back up county Sheriff's offices. In Ohio the Sheriff is the highest authority in law enforcement.
To and from Franklin Furnace and Haverhill cant you use the Ohio Horse Park Bridge near the Greenup Bridge and the County Road 1A underpass near Hanging Rock ? It is awfully inconvenient though. Great video!
Its a problem in Portsmouth too. If cars aren't allowed to block roadways or intersections, trains shouldn't be allowed to either. I understand that things happen but with how many times it happens its a problem.
The law should be enforceable by requiring the railroad company to build an overpass if it happens more than once. Hit 'em in the pocketbook and they'll comply with the law... one way or the other.
The rai;road owns the right of way and allow roads to cross THEIR right of way with the stipulation that the RAILROAD has the right of way at all times. They could REFUSE to allow grade crossings of roads and require over passes or underpasses thus negating the problem. THEY do not have to allow county roads to cross their tracks at all. It is up to the county to solve the problem not the rail. BTW state law has zero effect on the rail crossings of an interstate railroad, for that you need to go to the Surface Transportation Board... trust me I dealt with rail roads for years.
@@TheJagjr4450 The Federal courts can require an easement; or, alternatively, given the current makeup of the Supreme Court, give the States power over the railroads in their States, as a matter of States' rights (ref. the Dobbs decision overturning RvW.) Or the Federal executive branch can seize the area of the crossing and simply pay for that area - or, for that matter, can simply issue a regulation through the Surface Transportation Board. Or the Congress can abolish or modify the STB, as it is not a Constitutionally-required body. Its powers flow from the Commerce clause in the powers of Congress in the US Constitution. There is recourse to all three branches of the Federal Government. The easiest would likely be for state officials to complain to Federal lawmakers, who would then contact the STB, which would issue that reg post-haste or else be eliminated by law.
I used to have to go over that crossing at 6:30 AM fog covered (its by the river) with no safety gates to get to school, could not see 2 feet in front of you. All you could do was pull up, roll down your windows to listen, gun it and hope you dont DIE. Franklin Furnace is a shit hole

residents should be talking to their county commissioners to pass an county about trains blocking road ways too long.
