  • (This interview was recorded a day before the Supreme Court upheld interim bail to Arvind Kejriwal in the ED case)
Senior Supreme Court Advocate Abhishek Manu Singhvi talks to Vir Sanghvi about a 'fear psychosis' that now permeates the bureaucracy, judiciary and civil society, says there is a misapplication of laws, of using them to curtail liberty. He also talks of the new criminal laws, calling them an exercise in 'vanity and cosmeticism'.

SC should have benches in every state to keep a check on the judgements by HC & trail courts? An accused who is poor just can' t imagine going to Delhi for defending a case especially when the opponent litigant is the state itself or a big corporate/rich?
Why the SC is not installing a system for quarterly reconciliation of all pending bail applications in the lower courts? Any bail not given in 10 days needs to be questioned?
The judiciary is to be blamed for this self created non accountability...

Next you say that tampering with evidence by accused can be watched and recalling accused when need be is also manageable. This is totally untrue.Kejriwal did not make himself available even after 8 summons by investigation agency. After releasing him on interim bail he tried tactics not to get jailed again.

There is one thing Mr. Singhvi did not bring up (or highlight as much as the others) as one of the possible reasons behind the current pronouncements of certain judges -- _ideological inclination_ . A certain ideological impulse which was lying dormant in the hearts of many judges suddenly became activated when Narendra Modi took charge in 2014. They view themselves as important cogs in the wheel of a massive ethos-changing ideological project.

It's ironic that the ruling party has recruited congress politicians & used the PLMA law to target opponents without evidence. This prompted ordinary voters to strengthen the opposition. We should never forget that govt are public servants, & they should not to be revered like god-king.
Why do G0di media people just like hungry poor farmers who wear torn clothes & have no voices, & want Punjabi farmers to be silent like those in central parts of India, hanging? Govt sends police to violently suppress peaceful students & farmers protest by beating them mercilessly, supported by G0di media. There is a lack of entrepreneurial opportunities for employed youth, & many are being driven back to farming due to joblessness.
This govt policies benefit only 2 rich corporates, who spend lavishly on luxury events, while neglecting the struggling manufacturing sector, which has declined from 17% in 2010 to 11% in 2023. Company 'A' hides black money in shell companies in the Cayman Islands. Will anyone even reduce your LPG gas costs? No wonder, smart youth are illegally seeking jobs abroad. Also, RTI activists are silenced for seeking truth, like R@njeet s0ni in Bhopal & 20 others in Bihar.
Organized corruption thrives in rigid systems, allowing those with ruling party connections to commit crimes like paper leaks with impunity. The Supreme Court has deemed electoral bonds legalized corruption, making the ruling party the world's richest political party in 10 years. Meanwhile, UP has the highest number of custodial deaths, wrongful charges. UP has also failed to keep its rivers & temple areas clean. The new criminal law (BNS) contains draconian provisions that reinforce a colonial-minded police system.
Food inflation & cost of living are increasing. This Govt has prioritised imported luxury cars for VVIPs over the needs of ordinary voters. While our brave AVs at the border deserve fair compensation as regular jawans. If Pak & China can pay their troops, so should we. Who pays for jawans pensions, NSG weapons & salaries, roads & railways for transporting goods? Not Industrialists like Company 'A', but the Indian public. India's poorest & middle class pay 50% & 33% gst taxes, while the wealthy industrialists pay only 3% gst, oxfam.
