      Add a link of the actual law. The 1901 Constitution. Then just get people to stand up for their constitutional rights. Rather than beg for them like the little biatches they obviously are.
      Any law, even state constitutional law. That conflicts with the Australian Constitution of 1901, is illegal, and invalid.
      This is not hard. It's simple.
      You have a constitutional, and Human right, to be presumed innocent. Until proven guilty. Almost everyone knows that, even most morons.
      They can NOT presume you'll use a Gelblaster to commit a crime. That is Constitutionally ILLEGAL.
      For a law to be a real law, and not just legislation. The law has to have a proclamation certificate, signed by the AG, or, the Queen. They won't sign it for any law that's unconstitutional. Because they're liable for 10 yrs prison and a 10K fine. For impeaching on your Constitutional, and Human rights.
      The Australian Constitution is the highest law in the land. It's ours "We the People". It is the be all to end all. The true rule of law, is on our side. So, why not just use it?
      The 1901 Australian Constitution is the law of Australia. Nothing can override it. No guns act. no health act. Nothing. Not even the queen can impeach on your constitutional rights
      Wake up Australia. They took the 1901 Aust Constitution out of the Aus school curriculum in the 70's for a good reason. None of you know the law, or your constitutional rights.

      Let this a@# know the police, military government under law are in violation by law the act police for open Carry off firearms and high power weapons swat including explosive compounds which hear is completely criminal act how much do they have and they should be charged for firearms law to that act and any explosive device?? If I put on a rent a cop uniform and carry my pistol blaster and open Carry is that a crime??and unless your in international waters cops military government under your own act. And the training do the police go via a arms act to register to get it to the act or do they just give you one like the guy in south Australia on HPA there??. I have no issue with new color case and gas metal clip case??.a alternative is better than this!.

      You can not do anything in Australia really getting worse each year. I lived overseas for that reason. But stuck here because of covid and travel bans. But soon as that's lifted I'm back to the free world. No more nanny state WA.

      Definetly go to Europe. Countries like Austria, Poland, Czech, other sports like Airsoft are even larger, skirmishes goes on for days and have over 1000+ attendees. It's sad Aussies cannot have the same amount of fun or exercise purely because people cannot use their brains.

      @@telamonize7202 I have an EU passport and direct family in Europe so this is definitely an option. The problem is my life is established here with kids and all, which makes it a very difficult decision to make. I would love to get into air soft, but yeah, straya.

      If your fun could get you killed? Just because it hasn't happened yet doesn't mean that it won't happen. Would you rather they let it go until people are killed because of it? What if the police came to one of these calls and a criminal was somewhere else killing someone and the police couldn't be in 2 places at the same time? It doesn't even matter if the kid doesn't get shot, if someone who was somewhere else got killed. Are you saying you want it legal until people get killed? This isn't a movie, in real life we figure out the things that can kill us BEFORE anyone has to die.

      Think about your implications before you speak. Maybe go outside and live a little. I'll live free and make my own risk assessments without the help of big brother. Thank you very much.

      @@user-hc4hk5bs8l If your gardening tool is black and you are pointing it at people in the park, someone might call it in. Our actions have consequences. If it looks like you have a gun, the cops won't always be able to tell the difference. Sooner or later they will stop coming when someone says they see someone with a gun in the park, they will say that they can't come until you hear gunshots. Do you know how many people can be shot in 1 minute? If it was 100% legal to own something that looked like a gun then criminals that commit a crime with a real gun would throw it over a fence or into a bush and then tell the cops that it wasn't a real gun and there is no evidence against them. The world is not going to get safer unless we try to make it safer. If you want to raise the stress level of cops, they are not going to be thinking clearly. Accidents happen when people are under more stress. Make up a number of people that have to die before you would allow gun-look-alikes banned, and then when that number is reached, tell yourself that you didn't just kill that many people. Why not just legalize real guns? After all it's not your fault if a criminal kills someone...

      @Documentary Detective II You feel very safe because you haven't seen real crime. I hope you will always get to live in a neighborhood with such little crime. Where I live if the sun has set and it is dark outside if you so much as point at a cop with black gloves on, or if a black person points at a cop, the cop yells "Put the gun down or I will shoot" several times but the person thinks to himself, "What gun, what is he talking about? Who is he yelling at, I don't see anyone with a gun. Is he yelling at me? Can't be, I'm not holding a gun." Then the cop ends up in court for killing someone without a gun. The fact is many, many people have died because of this, just because it hasn't happened where you live doesn't mean that it wont start happening if they relax the law. What about a farmer hitting someone in the back of the head with a shovel and killing them because they thought the person had a gun? When they see it was a fake gun they take it because it looks cool. They walk away, no one knows who did it. The cops have no evidence to go on and the news doesn't report it by saying "someone with a fake gun was killed", all they say is "someone was killed with a shovel" and you can live in your imaginary safe world where if no crime is reported, then there isn't any crime. People disappear all the time, no proof, no one thinks there is any crime. Don't get yourself killed. You might be able to tell the difference between a real gun and a stick, but you are lying if you think you can in the dark, after the sun has gone down, and someone in a black jacket points a black object at you and says, "Give me all your money, or I'll shoot. If you report this crime I'll kill you." If that happened to you, would you report it? Feel safe, by all means, but when a grown up tells you to stop doing something because it can get you killed, listen to them.

      i doubt they will get banned in QLD any time soon, we only just introduced new legislation at the start of the year to keep them legal, and now that every other state has benned them it would be dum to follow them, just think of all the $$$$ coming to the qld economy from people traveling from other state to come play gel ball because they cant do it in there own state

    Heard about this yesterday. I don't agree with this. WAPOL goes nanny spec way too often. And this is an over reaction to gel blasters being mistaken for real fire arms. If WAPOL put as much effort into proper policing as they do with RBT blitzes on public holidays, and dispensing of infringements like a confectionary vending machine, this state might respect police and treat them differently.

    No safety flag in the barrel of that real M4, magazine is still in and action closed, for all intents and purposes that firearm could be hot..... goes against all of the basic firearms safety practices just because they want to hold it next to a plastic toy and pass some draconian law, and the commissioner continually flags the crowd with the firearm whilst moving it on the table.

    Airsoft was forbidden in my country untill a few years ago when an association was created in forming regulations in order for airsoft to be legally purchased and played only on specific locations. That's what it actually needs.

    Either Australia has Gun laws that work and restrict the possession, use and importation of actual Firearms and so there is no reasonable expectation that Gelblasters are real, or Australian Gun laws are so lacking and ineffective that the expectation of Real Firearms Such as AR-15's and AK's being easily available in the community is so prevalent that it would be easy to imply that Gelblasters could easily be confused with the real item... so which one is it?

    The best way to look at it is this:
    1. If UK, US, Canada, Hong Kong and plenty other countries that are safe allow these, then why the hell are we banning them. Even NZ has them! Not only they allow, they have no problems with Police shooting people holding them or any problems with those toys.
    2. Police should be trained to identify a real and a fake firearm and even if the person with the gel blaster doesn’t surrender, the blaster aint gonna hurt you if they fire it.
    3. Like Bradley already said, this is Australia, getting a Real Firearm is just as hard as winning the lottery. If you see a 16 year old with a gun, its most certainly a replica or gel blaster.
    4. F*ckin Common sense mate. Any average criminal would hide their gun or conceal it. If they are teens and are running around shooting EACH other then it should tick to you its not real.

    This isn't a difficult one to resolve, I play airsoft in the UK and we have two types of airsoft RIF (Realistic Imitation Firearm) you can buy. You have the ones that look like the real thing and then one that is two tone so its black and then parts of the body are coloured in green, orange, blue or red. The two tone can be owned by anyone, but if you want one that looks like the real thing so you can play milsim you need a UKARA. To get a UKARA you have to play 3 games in a six month period and this is renewed every year and is done by the place you play airsoft. So its regulated by places that run the business, also BB guns do look like the real deal as that is a RIF and If you don't have a UKARA a retailer can't sell you a RIF....simple really, if you are willing to put sensible measures in place.

      The thing is Australia brought in these imitation firearms laws in the mid-90s, which is way before airsoft became a fairly mainstream thing (in the West, anyway). Therefore airsoft never had a chance to establish itself as a hobby in Australia, so almost no one was lobbying for it at the time the laws came into effect. This is partly why Australia stands alone on this stuff, it’s largely due to timing. Had our imitation firearms laws been proposed a decade later, we may have had an established airsoft scene and possibly the types of exemptions that exist in the UK. Instead, the extremely strict laws have become part of the culture here, to the extent it’s basically unthinkable for any major political party to be perceived as “weakening” them by legalising things like gel blasters and airsoft.
      As an Australian who is largely supportive of our gun laws when it comes to REAL guns, I would be happy to see airsoft legalised for adults without a criminal record, and harsh penalties for brandishing them in a public place. I doubt that’s ever actually going to happen though.

      Paintball gun has more potential of being lethal, it uses compressed air to eject the projectile, except that the ammo used for it is "paintball" hence the name. Imagine if u load the paintgun with a harden projectile, like marble or something, that thing has more than a 50% chance of causing fatality, some counties even use the highly compressed air system concept on their weapon for hunting animals such as squirrels, birds, monkeys etc. And what of a gel blaster? The worst it can do is probably cause eye injury despite its appearance, instead of fully banning the gel blaster industry why not take it as one of the extreme sports? And implement a little laws and regulations in owning one of the gel blasters. Even bows and arrows are 100000% lethal and archery is a sport smh.

    To be fair Gel blasters have been illegal in WA this whole time. They have never been legal. Many people have imported them against the law in the hope the government would reclassify them and they would be legal. There has been some comments that there would be a review of the Gel Blasters status after July but I wouldn't hold my breath. As is you can't even get them licensed as a firearm as they are replicas of military weapons which are illegal anyway. All other considerations are moot.

    one thing that I think is completely braindead on behalf of the two men speaking is the fact that menacing someone with a gel blaster would still qualify as a crime, I'm not super learned on Australian law but what matters in any situation in the US is 2 fold, the intent of the wielder and the perception of the victim. The person committing the crime of assault is at fault, not the implement they use.

    When little Johnny Howard banned guns in Australia following the Port Arthur tragedy via a press conference on the television, I was sitting at the dining table with my 9 year old son who listened to the broadcast.     If they painted or made gel blasters in bright colours , this issue of imitation fire arms would not bean issue my thinks.
    I know they are toy guns, ridiculous.

      i am not sure, it seems to be a case of state police not wanting to put extra training in so they can deal with replica firearm related crimes. It's clearly not an issue in European countries and it's really a non issue here.

      @@limeybonesjones7395 imitation fire arms are banned in most of my country Australia, have been for a few years. I live in nsw and had a couple gel blasters , fired at targets in back yard. Only two came with an orange muzzle and the m16 looked straight out of vietnam lol broke apart to keep springs for nerf mods and cut plastic bits up and dumped to the tip after realising I could go to jail for a toy gun. F that.

      @@BradleyPhillipsYT Could also go down to The Reject Shop, get something that looks almost the same for five bucks and paint that black. It would be just as impractical to kill someone with, laugh at this law, and be much cheaper...

    It is both fortunate (in that no one has actually been killed) and unfortunate (in that it is kind of a made-up problem) that this minister is proposing law based on hypotheticals. That female reporter about 1/3 of the way into the video asks some really relevant questions.
