😢 This is a ridiculous and discriminatory action taken by the government. It clearly discriminates against students based on race by allowing British and Hong Kong nationals to apply below 50 years old. British and Hong Kong nationals do not have a specific genetic advantage to slow down aging. Most of these students were promised a future in Australia, and they paid their hard-earned money for the course, insurance, and everything else. The Australian government profited from them, not the other way around. I'm a citizen of Australia, but I'm ashamed of this. The Labor government has broken everything. These students should file a class action lawsuit.
British Nationals Overseas are not the same as those Brits who live in the UK.The term can be readily clarified by a simple Google search from which you will see this statement is correct.

They probably have diplomatic arrangements or strategies to tighten relationships with those countries.

However, statistics show that the largest percentage of students come from the UK and India, with significantly fewer students from other countries. Despite this, the rule includes exceptions for the UK, Hong Kong, and India, possibly due to cross-government agreements. This measure doesn't resolve any housing or economic issues and discriminates against minority groups. Furthermore, when these students enrolled, such rules did not exist, and many planned to stay in Australia after their degrees, making investments based on that expectation. Their dreams are now shattered. The government could at least introduce a grandfather clause to address this.

More than 80,000 dollars in university tuition, living expenses, the time we spent, all these investments were in vain and we can't get specialized work even now. Before we applied, they should have told us that the graduate visa does not apply to those over thirty-five years old, so that we choose another country.

exactly. I would consider for other countries if this rule was introduced before I came here. I invested all my savings, gave up my home country job, already studying in Australia. Now they have imposed this rule for all. At least they could exempt onshore students

Thanks for this Karl! I think you're the only Immigration Lawyer that speaks up for international student. I am finishing my Bachelors in Early Childhood this week and my visa expires end of August. I just turned 36 January and now I'm lost. If it wasn't due to covid I could have finished my course last year. Also the government needed more Early Childhood Teachers and this new laws is ridiculous. I understand the need for reform but they could have been more fair and placed a grandfathered clause. I spent almost 5 years studying and now I just need to go home as there is no visa option available. Sponsorship needs 2 years experience and how can I get that if without the 485? It really breaks my heart. Is there a way to sue this government for this discrimination? If yes let me know, I am willing to take action for this unfairness. Being a teacher, teaching children of fairness and respect for diversity this decision from the government is opposed to all Australia stands for when it comes to equality and respect for diversity. This is indeed discrimination due to age.
Thank you Australian government for discriminating against people based on their age! I cannot tell you how hard it was for me to make the decision to come to Australia to study for a Master's degree last year, and it only took the politicians a split second to change the policy and smash the dreams of my family.

Same here brother. I left my well-paying job and came here a couple of months back to study. After spending almost $ 30K now, I don't know what to do. Still in dilemma whether I should continue my studies and spends another 50K on it.
Relax folks, there are always other countries for you like China or Singapore and many others. These countries are the best for education.

A class action lawsuit is a type of legal case where one or several individuals sue on behalf of a larger group of people who have a common interest in the matter.
Notable examples of class actions against governments include cases involving unconstitutional practices, discrimination, and environmental damages.
We should all be class actioning our mortgages and if possible (I am not a car owner), any car dealership which has given us loans that can’t be repaid.
Just a fact. Plain and simple.
They should have allowed students who are already enrolled, completing, started and have student visas granted before such a decision . Very unfair.
Few tips:
When you are studying please network and try to find employer sponsored 494/482 onshore. When you are studying you can transition to 491 with part time work right following state rules. Spouses who are young can apply student visas.
Don't such visa require work experience you cannot get before to complete your degree?
491 can applied on part time work visa on ACT and I don't know about other states. I believe if you are 35 you may have some work experience and if your skills match the Australia skill shortage, hopefully you may get sponsorship onshore
@@Sush1111 If you look at the page of the 491 visa, it says that you must:
be nominated to apply by a state or territory government agency, or an eligible relative must sponsor you
have an occupation on a relevant skilled occupation list
have a suitable skills assessment for the occupation
be invited to apply
satisfy the points test
None of those things are possible if you haven't completed your studies

May be 35+ students get priority to get TR like 491 , atleast that has to be taken into account
Cutting off those over 35 has severely impacted our entire family. The 5% is not just a number, these are real people with families to support and loans to pay off. A transitional period must be reconsidered.
Indeed, at least we need few years to gain experience 😢. Feeling devastated.

Looks like trade occupations are almost the only viable option for the 189 Visa at 65 points, especially for international students who can only gain a limited amount of Australian work experience or don't have much overseas experience (and most likely won't be able to obtain 20 points from the English test).
Best case scenario, considering 10 points for Proficient English, is 75 points total for diplomas and 80 for bachelor's (highest points for age, regional study, Australian qualification).
The minimum points needed to receive an invitation in this case was at least 95 with a few exceptions at 85 points for non-trade occupations, this would rule out everything but trades.
For example, even "Civil Eng. Draftsperson" is at 85 points, and that's at a diploma level meaning you get less points for your qualification.
That’s not the full picture however. It is insanely difficult to get TRA skills assessment on time for some invitation rounds, now that a regular 189 invitation round is nowhere to be found. Superior English is not that hard to get if you genuinely use English on a daily basis and practice PTE test, since PTE is generally easier to prepare than IELTS. And you are meant to have good English skills anyways in an English-speaking country.
And to be honest, 85 points aren’t that unreachable considering the below score structure:
Age: 30
Degree: 15 (Bachelor or above)
ASR: 5
NAATI: 5
Superior English: 20
Single: 10
Total: 85
Swap out NAATI to regional study also gives the applicant 85 points. Let’s just say PY is completed on-time, then we can have 90 points, though that is limited in eligibility.
Point is, there is no hard requirement for work experience.
But if you want 100 points, this is one way to go:
Age: 30
Degree: 15 (Bachelor or above)
ASR: 5
NAATI: 5
Superior English: 20
Single: 10
PY: 5
Regional study: 5
1 year Australian work experience: 5
Totalling 100.
Or get 3 years of post-graduate work experience but without regional study. You cannot get to 100 points without some form of highly relevant work experience.
@estellebright2579 for sure, I'd do a lot of practice and try to get those 20 points as hard as I can, but realistically speaking, it's well known that chances are very slim for most foreigners who don't speak English as their native language.
@estellebright2579 to be honest, the points system is going to change soon, so there's that.
But even then, since you're focusing on occupations that require a bachelor's, the Minimum is 95 points, with very few exceptions.
I'm not saying it's impossible but nearly.
The PY is only limited to certain sectors anyway, and I'm not sure many people will go down the NAATI path; not even sure they will keep those ones the system changes.
Also, the few occupations that only require a diploma and aren't trades, are still being invited with a minimum of 85 points, so it's even harder.
Some of us brought our family here thinking we can stay longer. This is devastating. Totally absurd for not meeting your promises, Immi. How would paying-international-fees-students hurt you?

Hi Karl we all love the information you deliver, it’s very helpful. I have a question, I am on 494 visa and I have already applied 191 visa on 12 April and still waiting. If 494 visa can search for other jobs for 6 months than can I stop working with my current employer? I have very good high paying opportunities but I am on sponsorship. Just wanted to know if I can start other work since I have already completed 3 years on 494 and it’s already 3 months that I have applied 191.

Greetings kari ,thank you for the updates, l would want to find out ,l had an ATT case and won it on the 24 October 2023 ,should l have to get a refund or it's an arrangement for this year only.

What is still surprising to me that I have a PhD in climate science and I lodged a 190 visa application over 13 months ago and not yet received an outcome of it. The harsh reality for me is that I will not have any contract after the end of this year and all the position that is available required PR as a minimum criterion, and believe me there are many positions available. But because of not having PR I will be unemployed or probably driving Uber to support my family despite having the highest possible qualification of more than 3 years of experience in the field.
What is your analysis on the next 189 round, will it go back to 65 for healthcare sectors ?

there are many tr visa that you can apply for now including temporary skill visa and soon skill in demand visa too

we are already onshore and studying Masters coursework. I will be 36 just before 1 month of completing my Masters. This is completely betrayal and discrimination. When I got visa, their offer was to get post study work visa for 2-3 years. We came here giving up our job in home country and invested lots of money for better professional experience. Nobody is talking about the students who are already studying Masters by Coursework

I am over 35 and graduating in October with a Dean’s Award Recognition as a proof of my dedication to my studies. I have originally planned to level up my academics to gain competitive skills and take real-world experience in the Australian Workplace after finishing knowing there is 485 Visa allowing me to do that. Now, these plans which involved a lot of mental and financial preparation are all shattered😢💔

I am dependent of TSS 482 visa working in sydney. My husband is the primary applicant of TSS 482 sponsored by his employer. Now his employment is comin to an end earlier than expected, by the new rule he will have 180 days to get another sponsor. Meanwhile will I be able to work until that time?
So why is good to take 6 months no work on 494? It's gonna be longer to get PR isn't it ?
That provision is not there to let you abuse it, but for you to have more time to transition to another qualified employer should previous employment breaks down. 494 visa only gives you limited work rights, so you still have to abide by your visa conditions.

You have got to be joking, that in itself is a huge joke!
DOHA has no quota near the end so grant very few, thus adding up the processing months. The number should go back down a bit when new FY arrives in 2 days.

DOHA has already said 476 will be permanently closed on 1 July 2024.
@@estellebright2579 yes but doha granted visas in irregular order. 2019 Applicants are waiting and 2023 got their visa.

35 or under means as long as you haven't turned 36.
If you are even a day older than 35 on the 1st of July, you won't be able to apply.

True. We got sold false TR visa dreams. Forget about the huge investment we made, the stress and the mental anguish we are going through because of these changes will forever take toll on our life.
The simple facts are that the students were offered visas and were told there was a post-study work visa available. Then, in the middle of their course, the policy was changed to say only people of certain ages from specific countries could get the visa, while others were left out. Oops, sorry, we lied to you. If that’s not discrimination, I don’t know what is.

Hi, I have applied for 485 visa on 29th June before the new changes. I have studied Masters in Cyber Security at RMIT University and according to the previous CRICOS course list my course was in the list to get 5 years of Post Study Work Permit Visa.
Today my 485 visa got approved on 1st July and I can see that I got 2 years Post Study Work Permit where I was supposed to get 5 years according to the previous rules. Could you please suggest me what can I do in this situation?

I became 36 1 year into my masters in AU transferred over to New Zealand they got 1 year masters there so I had to only study 6 months got a 3 years post study visa in NZ got my pr literally after 1 year of work in 2 weeks as a marketing coordinator. They got a new 6 point system where if you get 6 they just give you pr regardless of occupation or anything

From July 1, the studen visa fees have risen from AUD710 to AUD1,600.
It has more than double. We were told fees wouldn't increase from July 1. What is that?
Basically to tell a prospective student: "Hey! We know that you are not serious about learning. You came here and worked with cash in hand while neglecting your main duty as a student. Therefore we increase the visa fee so that you are more serious in choosing Australia as a place to study.
Also, you keep applying for a student visa not to study but to buy time to work and get PR, this is destroying the reputation of our education institution! "

@@rl2388 The increase doesn't make any sense because genuine students will think twice since you're not sure to get your student visa. This increase allows firstly and mostly Australia to get more money from rejected applications. With the same amount of rejection as before the increase, they will get 2 times more money. Now let's say they increase the rejection rate, and you have created a new source of income.
I'm more shocked about the fact that nobody is talking about this increase and by the fact that it wasn't expected. We were told it wouldn't come true by July 1
@@jayson4602 I agree.. They are quite cunning.. If they make everything harder (age cap, GTE, saving account, etc) they should at least keep the visa fee stays the same.
The university cost keeps increasing for overseas students, and yet they give us this kind of treatment.
Once I heard an Aussie complaining about the working visa to my country (which is only around 300 aud). That is nothing compared to what we got here.
@@rl2388 I'm really disappointed. I should have chosen Canada over Australia. At least I could speak French in addition of English which would have probably helped me to for a smoother journey.
I chose Australia because I'm from a French speaking Pacific Island (New Caledonia) and wanted to remain close of my home country. Probably not the best idea I've had in my life.
I'll try to be optimistic. And I hope it will be fine for me and most people affected by the new crazy changes.

Thank you Karl, immigration broke us emotionally, mentally and socially. Knowing that we're only 5% of more than 35 years old, damaging us might be reasonable for them. We also contributed in the country, we have also families who will be affected and why they're not considering us. Is the petition has any possibility?
I believe they are lying saying that students over 35 are 5%. I believe a mass exodus is coming which is what they are trying to do. They want to deport people using age while retaining millions of dollars
They want a better Australia and same time they do things like this. Clearly they dont understand how an economy works.

You might want to read the requirements on the website before going to TH-cam. 190 is a state nomination visa and requires a nomination by the state you are targeting. State requirements differ to each other. Some require you to live and have a job in that state for certain period before getting the nomination.
That is WHY student visa and TGV is important
