Placing the supermen in cryogenic suspension aboard the Botany Bay was not a sentence for war crimes. Where the hell did you get that? Watch the damned episode for crying out loud. That was their means of escape after being defeated, precisely to avoid the consequences of their actions.
From a certain perspective, the Federation owes its creation to the Augments. If not for a common threat that humanity could rally against that the augments presented humanity may never have come together and learned the lessons that led to the creation of the Federation.
In the Original series/Wrath of Khan, he was portrayed to be a Superhuman of Sikh descent that usurped power over multiple nations in the 1990s, thus becoming the catalyst for the Eugenics Wars (Played by Ricardo Montalbán) In the Kelvin Timeline’s depiction, seen in Into Darkness, he is more European that was “butchered” by Admiral Marcus and Section 31 (Played by Benedict Cumberbatch) Finally, Strange New Worlds reintroduction to Khan in Canon is a young Canadian child of possibly Sikh or Indian descent before his rise to power in the 21st Century Eugenics War and the oldest known ancestor to La’an Noonien-Singh (played by Desmond Sivan) You can see how confusing this is, but then again Star Trek lore has changed in this franchise and Khan’s Origins have been altered in a major fashion to keep up with the times.
For me personally in Real Life or not even in Real Life but also in Fiction Unless there is away to Isolate that Gen then we shouldn't even think about making a superior human, as not only in the Star Trek Universe but this very same thing happened in the Gundam Seed Universe, oh sure an single incident called 'The Bloody Valentine Tragedy' is what triggered the War in that Universe. But that War was always about Coordinators (Genetically Modified or Enhanced Humans) and Naturals (Regular Humans), even before that Incident Naturals had always been Jealous Enough of Coordinators to the point where that Down Right Hate Them. And in turn The Coordinators retaliated by like ten fold I think? I don't know I haven't seen that show or its Sequel Series Destiney in a long time. But what I do remember is that even in that world all Nuclear Technology has been made Unusable it was The Coordinators that found away to disable that System to the point of creating of course a couple of Special Gundams to counter that Technology. Accurately called 'N Jammer Cancelers' and not only that but also at the start of the show all but one Gundam was stolen by the Coordinators to use against the Naturals. Those making them 'The Villain's' of he show and Naturals being 'The Heroes' of the show. And things just Escalated in the Squeal Series Destiny.
It might be interesting to breed better humans the "natural way" but not at the expense of personality traits. We already do this in cattle and sheep, breeding better animals that produce more milk or meat
But now in 21st century (same storyline), but instead of genetically advanced humans, it's the development of Artificial Intelligence. If you have seen the 2024 movie "Atlas." The similarities are uncanny. Atlas is basically the story of Khan as an A.I. who leaves earth to build an army to destroy humans on earth. Another similar storyline, is the Terminator franchise.
