    In a wide-ranging interview, one of the most illustrious former judges of the Supreme Court has said he is “disappointed” that the Supreme Court did not give “more serious consideration” to many of the amendments of the Prevention of Money Laundering Act which it has recently upheld. Justice Madan Lokur says these amendments should have been looked at in a larger context by a larger bench. He said perhaps they could have been referred to a 7-judge bench. In the interview Justice Lokur made clear he has serious reservations with the Court’s judgement thus suggesting it has major flaws. Speaking generally about the Supreme Court, he said “it seems to be accepting what the executive wants it to accept”. The impression has been created “the Court is partial to the government”.

    Sometimes I dream of becoming so significant and impressive a personality to be interviewed by Dr. Karan Thapar. I really don't understand why so many people, so called politicians and other famous people avoid him or avoid to be on his show??
    But before that I earnestly pray to God to give Karan ji, very good health, so that my dream can come true. This show inspires me to read voraciously, speak eloquently and and think astutely.

    The Judgment of Justice Khanvilkar on Teesta Shetalbad is very unfortunate clearly the judgment displayed the judgment given at the behest of the Modi Government and showed the court in a very poor light and typically against Muslims, whereas in the same incidents other judges relied upon the same evidence of documents and witnesses when he has come to deliver a judgment he should be fearless. should not be under any pressure.

      The very genesis of the octopus provisions brought by the amending act of 2018 is questionable as it formed part of the Finance Act. For that one reason the Hon’ble Supreme court should strike down the amendments of 2018 and it should adhere to the principles of basic structure of the Constitution thereby nullifying the evil contents in the PMLA INCLUDING THE AMENDMENTS BROUGHT IN 2013.

    Present track record of ED is very suspicious. Their conviction rate is only 0.4% . It means 99.6 % people is suffering without any mistakes. Therefore, this judgment is certainly condemnable.

    Quality of justice in Hindu India depends upon the character, caste & religion of the judges. That's why the high caste hindus run judiciary of India rank at the bottom in the world. Sarkar e Khalsa Maharaja Ranjit Singh the Khalsa Sikh Empire had top quality justice systems & institutions but 1947 Hindu India still follow ramraaj model of low quality justice.

    The various amendments in the PMLA have been passed treating it as Money Bill.Its Constitutionality on that ground is pending before the Constitutional bench of the apex court. What would happen to the judgment passed by the Justice Khanwilkar led bench ,if the Act is declared otherthan money Bill,that is General Bill or Act and should have been passed through procedure therefor .

    I presume Justice Lakor is a learned judge and so I wonder why he is harping on the issue "guilty unless proven innocent". I happened to listen to an interview of Mr. Santosh Hegde (ex-Lok Ayukta) by Rajdeep Sardesai. What I got clearly is as follows: In a normal crime like robbery or murder, the police have to do investigation and gather evidence to prove the crime. In the case of money laundering kind of cases: i) Say I have been caught with 2 Cr cash in my house. Naturally it is for me to "prove" the source of the cash and this can be done very easily if I am innocent. OR ii) There is a discrepancy between my income and what I filed in my ITR - it is for me to provide the source of ALL incomes and prove that my ITR is fine. So I believe that in such cases it is perfectly fine that the onus of proving innocence is on the accused. Even if I am wrongly accused/arrested, if I am really innocent and have all dealings in "white", it should not take too long for me to prove that my dealings are above board.

    1. Unless the predicate offence is proven in a court of law, how can the offence of money laundering be presumed. In other words if the predicate offence is disproved in the trial court then the money laundering investigation done by ED is totally useless.
    Money laundering proceedings must commence only when the predicate offence is proven in court of law.

    I have one question, why such interviews take place only with those who appose the Modi Govt.
    Why you ignore the depth and ramifications of the offences under specifies PMLA. These forces have challenged the very democracy, economic and liberal values of the nation. You are also questioning the supremacy of parliament who represents the sentiments of the nation.
    Please understand offenders under PMLA are powerful and manipulative in nature. Any laxity would prove detrimental to eventual delivery of justice. After all Judge sitting in chair will apply his logic n rational in bail cases.
    These laws were enacted before Modi government, why they were not objected earlier. Changes if any in are part of the process. They are made through due process.
    In nutshell it's a propaganda , for sure.

    A copy of any charge , investigation or Fir should be given to the person charged . Otherwise people are at a disadvantage to protect themselves.And a good idea for bullying. Different words are just manipulation but if same intent .

    Hope chief justice refers PML act to larger bench for reconsideration so that this act is not used indiscriminately against political opponents and against those whom present regime doesn't like. Further law itself seems to be flawed wherein accused has to prove his innocence without being given the proof of his guilt
