    Any Filipino and Sulu supporters would point to the 1878 agreement and claim that Sabah was lease to the British North Borneo Company (BNBC). But there are numerous evidence to point that Sulu did not previously own Sabah as the self-proclaimed Sulu heirs would suggest, the claim that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu as a gift can be disputed and debunked by the following evidence:
    - 1877 Agreement
    Prior to the 1878 Agreement which was signed between the British North Borneo Company (BNBC) and the Sultanate of Sulu, there was an agreement that was signed in 1877 between the Sultanate of Brunei and the British North Borneo Company. Within this agreement, the word “grant” has been used numerous times. It’s also stated within the agreement that the entirety of North Borneo (Sabah) will be ceded to the British North Borneo Company (BNBC) for 15,000 Mexican gold coins .
    With these statements, it’s clear that the Sulu Sultanate did not own North Borneo (Sabah) and that the 1878 agreement is redundant.
    I would also like to point out that within the 1878 agreement, the word “pajak” was meant to be stated a “grant and cede”, and within the receipts of the so-called “rent payments” are listed as cession payment. Cession means to give something away. With that this proves that the 1878 Agreement wasn’t a lease agreement but rather a cession agreement.
    But let’s say for the sake of argument that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu and that the Sultanate of Sulu did indeed own Sabah and that the 1878 agreement was a lease agreement. Yet the Sultanate of Sulu has signed many agreements which relinquishes their rights over Sabah. These are the following:
    - 1878 Bases of Peace and Capitulation Agreement
    This agreement highlights the Sultanate of Sulu’s surrender of sovereignty to Spain. This means that anything happens whether internal or external affairs is under Spanish jurisdiction.
    - Article III of the Madrid Protocol of 1885
    The Madrid Protocol of 1885 was an agreement between the United Kingdom, Germany, and Spain to recognise Spain’s rule over the Sulu Archipelago. There is a particular statement within Article III which states that Spain will relinquish all of their claims on Borneo. This alongside with the 1878 Bases of Peace and Capitulation Agreement as stated previously shows that the Sultanate of Sulu now no longer have any jurisdiction over North Borneo (Sabah). This also means that North Borneo (Sabah) is now under complete British jurisdiction.
    - 1903 Confirmation of Cession
    This agreement was signed between the Sultanate of Sulu and the British North Borneo Company (BNBC) in which it states that the Sultanate of Sulu will grant and cede North Borneo (Sabah) as well as additional islands which is how the payment of 5,000 Mexican gold coins which at this point has switched entirely to the Malayan dollar increased to 5,300 Malayan dollars.
    - 1915 Carpenter Agreement
    This agreement was signed between the Sultanate of Sulu and the United States. Within this agreement it states that any power that the Sultan of Sulu has over his land has been given to the Philippines which is under American-rule.
    -1930 Anglo-US Border Convention
    This agreement was signed between the United States and the United Kingdom. This agrement also define the border of North Borneo (Sabah) and the Philippines with the agreement being that North Borneo (Sabah) will remain under British jurisdiction and the Philippines being under American jurisdiction.
    -1963 Malaysia Agreement
    Finally this agreement was signed between the United Kingdom, Malaya, Singapore, Sarawak, and North Borneo (Sabah) to form a new country now known as Malaysia. Now that North Borneo (Sabah) has gained it’s independence from the UK, they opted to join this agreement and with the previous agreements signed, it means that North Borneo (Sabah) now have self-determination. And with the UK approving this agreement under the Malaysia Act of 1963 which has been passed in the British Parliament. This agreement has also been recognised by the United Nations and agreed on by the UN General Assembly and the UN Secretary-General himself. This means that Sabah is now rightful Malaysian territory.
    With all of these facts in place, it’s clear that Sabah rightfully belongs to Malaysia and neither the Philippines nor Sulu have any legal claims over Sabah.

    Reading the comments from Citizen of the Philipines and Indonesia like I want to 🤮. As a Sabahan I dont want to be part of the Philipines or Indonesia. Sabahan already made “Self Determination”, United Nation and British has record of it.

    Malaysia was paying the lease it means they recognize that the true owner of Sabah is no other than the Sultanate of Sulu. It was only after few years ago that they stopped paying, when the heirs try to get it back because the lease payment were too low as if the value has never change since the original contract was signed between the Sultanate and Malaysia. This is a clear oppression in the part of Malaysian government and a violation of international laws. The Philippine government has been holding back and could not step in the way it always wanted because of petroleum products imported from Malaysia, the threat of cutting off the supply which would greatly hurt Philippine economy. I hope that true justice will be served if not now but someday.

Answer No. Then, on which this letter address to? Answer: to the Philippine government which exist and still under colony of Spain at the given year. What is the content of the letter? The sulu sultanate heirs surrenders their ALL Territory including the north borneo,"which is still on LEASE", under the rule of the Philippines government. Then, what does it mean ? It is a sturdy supporting evidence that North Borneo had a LEASING Agreement. Does it support the claim of Malaysia? No, Because malaysia is still NOT EXISTING at that time. Does it support the claim of Philippines? Yes, because the territory owned by Private family surrender it to the Governer-General of Philippines ( which position is currently equivalent to the Philippines president ). Does the leasing agreement becomes null? Probably if it is address to British, but it is only address to Philippines under Spanish rule. Then Why the leasing payment continue? Because the territory of Sulu Sultanate are occupied by the spanish and british ( North borneo, which on lease ), to avoid any conflict between 2 nations. They had an agreement at Madrid, stating that the Spain will not pursuing the north borneo to avoid War because it is being occupied/ used and LEASED by the British. So, did the Leasing agreement terminated? No, because the rental payment did continue. Then the British left and the agreement is inherited by Malaysia, which they continue the payment until year 2013. Why the rental payment stop at 2013? because the malaysian government deported some Filipinos, onwhich are some are family relatives of Sulu sultanate, that made them angry and sent militiaman to attack North Borneo. But the Philippines government do not support this act of violence. Hope it is clear to you

    Why Sulu never own Sabah simplified
    Brunei went to war and asking Sulu for help. Brunei on the edge of winning the war was when the Sulu arrived to help.
    Brunei never ceded eastern Sabah to Sulu but Sulu proclaim the land is theirs.
    Basically,Sulu is just a pirate.

      Not only that but the 1877 agreement also contradicts the 1878 agreement as the 1877 agreement which was signed and agreed on between the Sultanate of Brunei and the British North Borneo Company states that Brunei will hand over North Borneo (Sabah) to the BNBC. Also in the 1878 agreement there was no mentioned of a rent nor a rent money which further solidifies the fact that Sulu has never owned Sabah.

      The french court said they have no jurisdiction over the sovereignty of the case but decided on the propriety of the land w/c the Kirams won. The $15B award is still enforced.

    North Borneo from its name already known as part of sultanate of Brunei. If there any country want to claim, its only Brunei may have substances. Even it didn't clear how part of North Borneo under Sulu Sultanate if any. During Spain colonial until American came in, North Borneo never under their jurisdictions. The only we can see overwhelmed of refugees, so called warriors from south Philippines. After too long war between them, the numbers of refugees keep increasing. And now they start claimed North Borneo once under their sultanate. I'm not aware how their sultanate have any significant position in Philippines government nowadays. Or they also living like refugees, I don't know. 🤔

      That is a false narrative created by the self-proclaimed Sulu heirs. North Borneo (Sabah) previously belonged to Brunei before they ceded the entire territory to the British under the 1877 agreement, in the agreement it clearly states that North Borneo will be ceded to the British North Borneo Company (BNBC). However the Sultan of Sulu came along and falsely claims that North Borneo belongs to them, and to avoid a possible war in the region the British enter the 1878 agreement with the Sulu Sultanate which states that Sulu will grant and cede North Borneo to the BNBC which was the original meaning of “pajak” and was agreed as such by both the British and the Sulu Sultan however the Sulu heirs of the now defunct Sulu Sultanate then twisted the original meaning and claims that the word pajak actually means “lease and rent”. The British then agreed to pay 5,000 Mexican gold coins annually to the Sultan of Sulu as cession money for North Borneo but the self-proclaimed Sulu heirs twisted the narrative yet again and claims that the payment is “rent money”.

    The purported Sulu heirs are just a bunch of pirates without anyone knowing their true identity/lineage. Therium was just trying their luck - Therium is just another bunch of pirate lawyers, which instituted an illegal arbitration with the help of Stampa.
    Stampa arbitration was cancelled by Spain's court, but he refused to stop his unlawful action and jumped to France/Paris court, to illegally continue the arbitration that had already been cancelled in Spain. Stampa is now facing a criminal charge in Spain
    The Sulu kingdom was disbanded when they surrendered to Spain ie the kingdom *effectively ceased to exist* once the Sultan surrendered to Spain.
    Spain then gave Sabah to British. Madrid Protocol of 1885 clearly indicated Spain gave North Borneo to British.
    A defunct kingdom which no longer exist can never claim right to any land, but these are rogue pirates who understand not , nor respect for any law. The same goes for the supporters of rogue pirates, they are just a bunch of thugs

    I would suggest that everybody reads the Judgement in I think 2001. This was a case that Indonesia and Malaysia took to the international court over the jurisdiction of Sipadan Island. The Philippines intervened as an interested party due to its claim. It was dismissed by a 14 to 1 Judgement. Everybody should read the reasons. The most pertinent point was raised by a Justice by the name of Francke (?). He said that the jurisdiction had been decided in 1963 (I think) by the United Nations. Also the fact that people have the right to self determination.
    As an added point may I raise the incursion into Sabah by Kirams people. This is why they have been determined as a terrorist group. Some are in Malaysian prisons with a life sentence. A few with a death sentence. I would be more concerned in getting them out of prison and execution than chasing monetary gain. Remember that a few of the Malaysian army were killed. They are not going to forget that. This is going to be my last comment as an independent as some of the commentators are firmly entrenched in their views without appreciating the pertinent facts.     You are right in asking that " Is the incorporation of Sabah into the newly formed Federation of Malaysia was legally binding?" We can now conclude that setting up a trading post with an agreement to the rightful ruler of the land is another way of conquering land by the British. Why then they gave up Palestine ,Jordan and other territories in mid east. The Federation also ignore the the protest of Indonesia and Philippines. There must be something wrong here. The UN should settle this dispute and both parties should respect whatever is the outcome.

    The $15B award is not stop. The French court said they have no jurisdiction abt the sovereignty of the case only on its propriety. The award is base on the propriety of the land.

    Content of the agreement.
    Based on the context of attachment of UN General Assembly 1541 (XV), number 4 principal 9, and evaluation of UN Secretary General (at that time held by Bhutan); the three countries, Malaysia, Philippines, and Indonesia HAVE TO WAIT SABAH STATUS DECISION BASED ON TERRITORY OWNER VOICE (FROM SULU SULTANATE), OR RESULT OF LOCAL PEOPLE VOTES IF SULU SULTANATE WITHOUT BEING FORCED HANDED OVER THE DECISION OF SABAH STATUS TO LOCAL PEOPLE WHICH WOULD BE SUPERVISED BY UNITED NATION; because it is related to law order of territorial tenure or decolonization (on the basis of rent document as a proof, SABAH IS NOT BRITISH COLONY, or IS NOT OWNED BUT RENTED BY BRITISH, SO THAT SABAH IS OWNED BY SULU SULTANATE, and BRITISH HAS NO RIGHT TO HAND OVER SABAH TERITORY TO ANOTHER COUNTRY).
    Generally, INTERNATIONAL LAW, decision to certain Sabah status (attachment of UN General Assemby 1541 (XV), number 4 principal 9) MUST BE BASED ON ONE OF THE ALTERNATIVES BELOW:
    a. return back Sabah teritory to
    Sulu Sultanate as the owner of
    Sabah,
    or
    b. (if) Sulu Sultanate without
    being forced handed over
    voice right to people for voting
    Sabah status certainty, then
    the decision of Sabah status
    would be certained by one
    of the following choices:
    - join to Malaysia
    or
    - join to Philippines
    or
    - join to Indonesia
    or
    - establish a new country.
    BUT MALAYSIA DID NOT OBEY THE AGREEMENT and IGNORED UNITED NATION RULE ABOVE through DECISION TO ESTABLISH FEDERAL STATE OF MALAYSIA AT SEPTEMBER 16, 1963; ANNEX SABAH WITHOUT RESPECTING THE OWNER VOICE, OR LOCAL PEOPLE WILL (if Sulu Sultanate handed over the decision of Sabah status to local people) AND WITHOUT RESPECTING UNITED NATION RULE ABOVE THAT WAS COMMITTED IN THE AGREEMENT. This Malaysia’s decision ignite anger of two countries (Philippines and Indonesia), so that in 1963 Philippines and Indonesia cut off diplomatic relations to Malaysia, and was followed by conflict and confrontation by Indonesia that was called “Ganyang Malaysia” at that time. Generally, INTERNATIONAL LAW (based on attachment context of UN General Assembly 1541 (XV), number 4 principal 9), enforces rule that TAKING OVER A TERITORY TO BECOME A NEW COUNTRY MUST BE OBEY THE RULE BASED ON ASPIRATiON (VOICE) OF THE TERRITORY OWNER’S DECISION. IF NOT, THEN THAT TERITORY IS PERMANENT BELONG TO THE OWNER. Because British was not the owner (rent document as a proof), then SABAH IS STILL OWNED BY SULU SULTANATE (British only as a renter to Sulu Sultanate according to agreement). SULU SULTANATE AS THE SABAH TERRITORY OWNER HAS THE LAW RIGHT TO DO ANYTHING RELATED TO HIS OWN TERRITORY.

    Sabah is clearly part of the Philippines. The government should step up and help the true heir of Sabah. The British had no rights to turn Sabah to Malaysia. United States liberated Great Britain too so the US should have turned Sabah to the Philippines because they are the true owner. Great Britain turned in Hong Kong to China as part of the lease agreement, so Malaysia should do the same. The French Court should make a decision and award it to the heir of Sulu. Malaysia could be lobbying to win because they have the money.

      If i'm not mistaken US gave Philippines independence in July 4, 1946. The British made North Borneo a Crown colony a little bit week later on July 15, 1946 with a strong protest from the Sultanate of Sulu. The British had no right to give it to Malaya, they didn't the owned land. It was leased to the British. The best thing the GB should do when they left was to give it back to its original owner, the Sultanate of Sulu. And why would Malaysia accepted it, when they knew it was not owned by the British Crown. It was only leased.

The Paris Court said we don't have jurisdiction over sovereignty issue, so better go to the proper court for that. What the Paris arbitration court ruledwas the propriety of the case where the Kirams won. The decision of arbitral court is final and executory.😆😅😂🤣

    As Sabahan, born and raised, where this is our ancestral home, WE WILL ALWAYS BE MALAYSIA.
    No private foreigners, nor countries may claim us. The lease money which should have been paid IN PERPETUATY (forever), is no longer valid when they attacked us in 2013. Thus, the deal made between the Brits and the Spaniards is no longer binding, but our rights of Self-determination in 1963 does.

    The French Court tackle only the propriety of the case not the sovereignty. The award of $15B still enforced. Mal Aysia is insisting on sovereignty while court decided on the propriety of case. The arbitration was about the propriety not the sovereignty of the case. The $15B is still enforced.

    If Malaysia is leasing (Tenant) Sabah then that proves that Sabah was not their. The Owner of Sabah is the Sultanate of Sulu. You cannot claim an area to be yours when you are only a Tenant, and you cannot give it to someone to be theirs if you are only a Tenant. Thats common sense.

    I find it hypocritical for Filipinos to claim Sabah as their territory due to a historical document that existed way back 1800's. And When China claims the spratly islands since they also have historical basis which is the 9 dash lines. Filipinos call that foul. And number 2 if you try to compare the development of luzon and the development of mindanao particularly the muslim territory. The difference is pretty clear like night and day, Mindanao gets a pretty small piece of the pie specially the muslim territories, while luzon get's the majority of the development. Where is the justice in that?. And lastly, the sabah people have spoken they rather be part of Malaysia than be part of the Philippines.

      @@ralphskielarrakov1597 Dude you should read more about the history between the sultanate of sulu and sultanate of brunei. Perhaps you'll be at least enlightened to what really happened. You see, Filipino version of history, according to them. The sultan of brunei asked the help of the sultanate of sulu to fight along side him to crush the civil war or rebellion and as a reward, the sultan of brunei will give Sabah to the sultanate of sulu. However their is 1 vital missing info. By the time Sulu has come to aid the sultan of brunei, it was already too late. The civil war was almost done in favor to the sultan of brunei and they we're winning. So the deal that was offerred by the sultan of brunei, that ship has sailed. So in essence, it was never given to the sultan of sulu. And secondly, There are no historical documents and evidence to support that Sabah was given to the Sultan of Sulu like a land title or agreement or whatsoever. The only document that was shown was the agreement between the dutch east indies and the sultan of sulu. Which is questionable. Why would you ask for payment of that land, while it was never yours in the first place. And FYI I'm a Filipino by the way

    It was a British Protectorate in 1888. The Spanish did agree to this and it was called the Madrid Accord. It should be noted that the claim only covers part of Sabah as the other parts were transferred by Brunei to the British. It should be stressed . that part of Sabah claimed by the Kirams was actually part of Brunei. When I worked there a local historian absolutely refuted the Kirams claim as they turned up to a battle late. It should be noted that rulers up to Manilla used to send tribute to the Brunei Sultans. Incidentally part of the land claimed by the Kirams actually went into Indonesia. No claim so far from the Kirams to Indonesia.

      The Sultanate of Sulu was never conquered by the British nor their poodle Malaya. It was in 1913 when the Sultanate of Sulu lost to the Americans (Moro-US War) the Sultanate of Sulu then gave their allegiance and domains (including North Borneo) to the US gov't of the Philippines. US gov't of the Philippines didn't administer North Borneo in respect to the British. US honor the private and commercial lease agreement betwen the Sultanate of Sulu and BNBC. US knew that North Borneo belongs to the Sultanate of Sulu.
