    I DON’T WANT TO SAY THAT SABAH IS OWNED BY THE PHILIPPINES BUT FOR SURE SABAH IS OWNED BY THE SULTAN FROM SULU WHICH MAKE SABAH UNDER THE JURISDICTION OF PHILIPPINES EVEN MALAYSIA KNOW’S THAT.       You're lacking the real information Sultan owned Sabah under his sovereignty and not only sabah but also mindanao island and the whole Philippines under his reign before the spanish came to rule. Jolo Sulo was the capital during the pre-Spanish colonial period. When the spanish came to the Philippines they set their own capital city in Cebu then Manila. Therefore when the sultan loses his power he was now surrendering Sabah to the government of the Philippines under the Philippine government jurisdiction as a part of sovereignty but still sabah was owned by the sultan.

      The Sultanate of Sulu does not necessarily under the Jurisdiction of the Philippines. The Sultanate of Sulu chose the Philippines rather than other countries, to be a part of the country; making it wholly a part of the now named "Philippines". Sabah is a part of the Sultanate of Sulu, and the Sultanate of Sulu resided its jurisdiction to the Philippines. Then the Heirs of the of the last Sultan give the Jurisdiction of Sabah to the Philippines Government making Sabah under the Jurisdiction of the Philippines not Malaysia's.

    Most of the existing territorial dispute in the world right now, you can bet the british were involved or the cause of it in some way or another. And fun fact, in 1961 there was a proposal to change our country's name from PH to Malaysia but was foiled when current country of Malaysia was formed in 1963 and claimed the name.

      The Heirs of SULU just Wanted to involve the Philipines government regarding the dispute to COLLECT MORE MONEY FOR THEMSELVES. The heirs of sultan dont have the military power to push their rights. 5000 ringgit or 70,000 pesos they get from the rent is nothing compared to the billions of money generated by the malaysian government by getting its resources like oil. Sultan heirs want more money, so they tried to invade sabah.
      If the 14.6 billion dollars award to sultan Heirs by the arbitral ruling doesnt benefit the Filipino people and only exclusive to the heir of the sultan. . then its not worth the bloodshed. Let the sultan fight their own fight and not involve the entire Philippines government.

      It was because Sulu had got nothing to do with Sabah anymore except as recipient of "cession money" annual payment which was merely a consolation for the Sulu Sultan. Why? Because on 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory.
      Then in 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain.
      Even though Britain, as the new owner of Sabah, had full control, they still honoured the annual cession money payment stipulated in the 1878 "pajak" agreement as consolation for the Sulu Sultan. So did Malaysia when formed, still honoured the annual cession money payment as consolation for the Sulu Sultan.
      Sulu Sultan could not claim anything because he had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain. What ever happened to Sabah after that was under Britain's jurisdiction.
      On 31 August 1963, Britain gave independence to Sabah. And then the people of Sabah and Sarawak had made decision of self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report Final Conclusion of the Secretary-General 14 September 1963. The last sentence of the report says:
      "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia".

    In the ancient time Kingdom of Sulu was already a rich thriving Sovereign Kingdom acknowledged by other kingdoms including China. The Southern Philippines was a center of trade. Also Spain never conquered Kingdom of Sulu and Mindanao. But later the Sultanate of Sulu ceeded its authority and became part of Philippines. Hence the union of Luzon, Visayas at Mindanao.

      Latest as in June 2023:
      1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate.
      2. June 27th - Dutch Court of Appeal had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling and dismissed an attempt to seize Malaysian assets.
      3. Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost.
      4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision.

      Malaysia had spent around RM32m, equivalent to about USD6.6m to deal with this Sulu claim cases in various European courts, in Madrid, Paris, Luxembourg and Netherlands. Apart from the €100,000.00 Sulu has to pay to Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m spent.

      Even if Malaysia concedes (which they will not), what will the Philippines do about Sabah?
      It has 4 million people who by virtue of plebescite have voted to be Malaysians. In the Philippines' history, what do Filipinos do if they are dissatisfied with the government? They REBEL.
      We've seen that in CPP- NPA in Central and Southern Luzon and BIFF in Mindanao. Do you really think Sabah people will just "let this go"? They voted to be Malaysians for obvious reasons that they view the Philippines as a Third World beggar wretched country racked with civil disobedience. Malaysia is a DEVELOPED, FIRST WORLD COUNTRY. No way in hell that they would side with us since people from Sabah views us as CONQUERORS.
      If the Philippines forces its arbitration win, we will lose big time. Some would argue that we would gain oil supply that could augment the shortage in our country but that is BS. You really think that Malaysia has not used it all up? We will be left with a SCORNED Sabah population that will be another group of terrorists with no benefits to gain from it.
      The Filipinos would ALSO lose ANOTHER TYPE OF OIL that Malaysia will stop supplying us: PALM OIL! Palm oil is used as an ingredient for ALMOST ALL FOOD AND COSMETIC PRODUCTS! Soaps, Shampoo, Makeup, Chips, even cooking oil. Malaysia is the LARGEST exporter of Palm Oil IN THE WORLD! That is why they are a developed country. About 80-90% of Palm Oil is FROM MALAYSIA.
      You really wanna piss off the nation that supplies products that create or cook your food, manufacture your shampoo and soap? Can you live everyday without those?
      Just require Malaysia to pay the Sultan of Sulu the past rental fees. Talk of possible selling Sabah to Malaysia completely then we move on. Let's use this leverage to gain other favors from Malaysia. Period.
      Stop looking for headaches to screw us over and start focusing on our countries' biggest problems. Economy? Rebels? Food Supply? We cannot even solve those yet so we should stop adding more.

    So therefore two arbitration sided with the sultanate of sulu heirs namely the french and spanish arbitration court. Although, malaysia was able to request for stay order from the seize malaysian asset in Luxembourg and azerbaijan. This is really a big move, especially in the Philippines-malaysia relationship. Hopefully, this can't cause another global problem.

      The sovereign state Malaysia stashed a real estate owned by a private person (Sultan of Sulu). Why wouldn’t there be any right by an International Court to decide on the matter specially if the sovereign state Malaysia is rogue?
      I don’t think there is anything left unclear by the Court when they declared that Sabah belongs to the Sultan and by transfer rights- to the Philippines. The Court does not have to say that Malaysia has to surrender its ownership rights to the Sultan. It is clear enough that Malaysia do not own Sabah and should depart.
      What this court decision does now is, give the moral high ground to the Philippines when it decides to take Sabah by military force, and when finally taken over, the International community will recognize the expanded boundaries of the Philippines. Any attempt by Malaysia to take it back by force will be frowned upon internationally.
      Malaysia now has to decide whether or not to give back Sabah or risk war with the Philippines. With the current military modernization of the Philippine Military and its economic assent that’s much faster than Malaysia, a military takeover by the Philippines should be regarded as serious and legitimate.

    THE HAGUE, June 27 (Reuters) - A Dutch court of appeal dismissed a bid by eight descendants of a former sultanate to enforce a $15-billion arbitration award they had won against the government of Malaysia, a judgment released on the court website Tuesday showed.
    "The court dismisses the requests of the Filipino nationals" to demand to execute the arbitration award, the judgment said.
    Last year, the Filipino heirs to the last Sultan of Sulu were awarded $14.9 billion by a Paris arbitration court in a long-running dispute with Malaysia over a colonial-era land deal. They have since sought to seize Malaysian government assets in France, Luxembourg and the Netherlands, in a bid to enforce the award.

    Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. In this agreement, Sulu “lease” North Borneo to BNBC (Tausug version - missing during his majesty trip to Singapore) while the English version is “grant and cede”. This information will easily be cherry picked in any of their discussion or debate. But what they will not revealed are those that can refute their claim. The followings are few of the information that had been kept secret:
    1. The agreement between Sultan Brunei that grant and cede North Borneo to BNBC on 29 December 1877 which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC (22 January 1878). This will deny that North Borneo was a gift to Sulu from Brunei. Show undisputable proof that Brunei (original owner) give Sabah to Sulu as a gift.
    2. 2. On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation agreement).
    3. 3. On the same day, 22 July 1878, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the 22/1/1878 agreement between Sulu Sultanate and BNBC. Thus, the agreement is null and void.
    4. 4. On 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement.
    5. 5. Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid.
    6. 6. Finally, the issues on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol.
    7. In addition, during the US colonization of PH, 2 agreements (Bates 1899 and Carpenter 1915) were signed by the Sultanate of Sulu which relinquished its temporal sovereignty of Sulu and its dependencies.
    8. Later, the 1930 Anglo-US border agreement acknowledge the boundary delimitation between PH and North Borneo that belongs to the British.
    Most of the above documents are kept either in Public Record Office in London or General Archives in Madrid. It can also be accessible from the Philippines official website with Spanish to English translation

      @@2460z_htdja Most probably Malaysia's strategy is to ignore the court case as it has no merits in arbitration as it did not comply with the Spanish Arbitration Law, and the New York Convention 1958. Later when the Madrid court made the mistake of appointing Dr Gonzalo Stampa as the arbitrator, then Malaysia came in to question the appointment. It turned out to be true when the Madrid Court withdrew Dr Gonzalo Stampa's appointment and later confirmed by the Spanish Constitution Cout in 2023 stating the appointment was unconstitutional. The rest of the courts in France, Netherlands, and Luxembourg too rejected Sulu's claim.
      In my opinion, as long as there is no agreement or clause between Malaysia and Sulu regarding arbitration, it is a gone case for Sulu. Because it did not comply with Articles 2 & 5 of the New York Convention of 1958.

    The Sultanate should be firm and consistent on their claim, even if the Malaysian gov't refuse to recognize the arbitral ruling there's nothing they can do to overturn that decision. The Malaysian gov't has no firm legal grip to their claim except to their citizen who are living on the said territory.

    As of 29 Sep 2022, lawyers for the Sultanate heirs sought permission from a court in the Netherlands But as of the 1st of January 2015, the New Dutch Arbitration Act entered into force, replacing the Dutch Arbitration Act of 1986. The New 2015 Act is still contained in book 4 (arts 1020-1077) of the Dutch Code of Civil Procedure (DCCP). For an arbitration agreement to be valid under Dutch law, the dispute that must be settled must arise out of a contractual legal relationship (article 1020 DCCP). The arbitration agreement must be in writing. Even under Section 4 of the RA 876, PH Arbitration Law require an arbitration agreement or clause. Do Sulu have that arbitration agreement or clause? If not, the court cannot proceed. Court hopping again.

    This is land dispute by Sultanate of Sulu and not territorial dispute. Sultanate is not sovereign state but Philippines. So Sulu Sultanate is land owner of Sabah but still under PH territory.

    If the whole Sabah belongs to a Filipino Citizen and the Title is most likely Registered in the Philippines so Technically the Island or Land is under Philippine Sovereignty. Sabah only became their State as they proclaim it bcoz that time they insist its their own. With this Ruling it make sense that it belongs to the Philippines.       The descendants of a 19th century Malaysia sultanate are looking to take control of Malaysian government assets globally to enforce a $14.9 billion arbitration award, despite a stay by a French court, their lawyers said.
      A French arbitration court in February ordered Kuala Lumpur to pay that sum to the heirs of the last Sultan of Sulu to settle a row over a colonial-era land deal.
      Malaysia said on Wednesday the Paris Court of Appeal had stayed the ruling, after finding that enforcement of the award could infringe the country’s sovereignty.
      Law minister Wan Junaidi Tuanku Jaafar said the stay would prevent the award from being enforced as Malaysia works to set aside the ruling.
      Malaysia had not previously participated in the arbitration.

    Sulu and Brunei empire existed even before Malaysia and the Philippines had ever been recognize as sovereign nations. International laws and legal arbitration are executive and binding and the British government knows it. Put it simply Malaysia federation cannot just stop paying rent and kick out the original and lawful owner of Sabah just because the old sulu sultan died. The heirs of the sultan of sulu has full legal rights over the property left behind by their ancestors.

      The claim over Sabah from the Sulu Sultanate originates from the Pulau Chermin Civil War and Kinarut Wars which was an internal civil war within the Brunei Sultanate that lasted for 12 years from 1661 to 1673 between two opposing members of the royal household who claimed the throne; Sultan Abdul Hakkul Mubin and Sultan Muhyiddin.
      The claim over Sabah from the Sulu Sultanate is that either all of Sabah (or some territories within Sabah) was promised to them for aiding Sultan Muhiyiddin in the war.
      During the final battle in 1673 at Pulau Chermin, Sultan Mubin was defeated but there are conflicting versions as to if the Sulu warriors did indeed fight in the battle or if they merely waited for the battle to be over before ransacking the royal palace at the end of the battle.
      Prisoners were taken by the Sulu including a son from Sultan Mubin before they departed back for Jolo Island. No demands were made until 15 years later in 1688 when the very same son, named Datu Dakula was sent back to Brunei to claim what was promised to the Sulu Sultanate.
      There is also a suggestion that the Sulu claim over Sabah comes from Datu Dakula’s heritage as being a surviving son of Sultan Mubin, who therefore inherited all of Sabah as including six territorial dependencies since his father had died and Sabah was presented as a gift to Sultan Mubin’s parents during his wedding by the previous Brunei Sultan, Sultan Saiful Rijal.
      Sadly, there exists no historical evidence or agreements to support these claims by the Sulu Sultanate that Sabah was given to them by Brunei or if promises were indeed made by the Sultan of Brunei. And so, the Sulu claims appears to have no merit historically in this respect.
      The Sulu Sultanate were responsible for encouraging bands of pirates under the leadership of various datu’s loyal to the throne to commit acts of piracy, kidnapping and the capturing of natives from coastal villages along the shores of Sabah from the mid-1700s till the late 1800s to be sold as slaves at slave trading markets in the Sulu archipelago.
      Kidnapping of natives and selling them as slaves was part of a greater economic trade that was incredibly profitable and a lucrative business; slaves provided manpower for plantations, manpower as rowers on war ships, house maids as well as skilled craftsmen for many traders in the Sulu Archipelago as well in foreign lands. And slaves could be used to settle personal debts between various datu’s and businessmen in the Sulu region.
      The British avoided conflict with the Spanish in the Borneo and Philippine regions but did attack and capture Manila for a short period of time in 1763. They were happy to trade with the Sulu by selling them guns and ammunition which helped them sustain their war with the Spanish until their defeat in July 1878.
      Balambangan and Labuan islands served as important trading posts for the British to sell guns, ammunition and to barter trade with the Sulu for jungle products and opium.
      The Spanish, who had ruled much of the Philippines since 1570 had struggled to end the Sulu insurgency in the south for 300 years. They had previously signed many peace treaties after defeating the Sulu Sultanate in battles between the 1600s till the late 1700s but in every instance, once the Spanish had left, the treaties were torn up and completely ignored.
      The Sulu Sultanate then went back to committing acts of piracy, kidnapping and slavery against not only native villages in Sabah under Brunei rule as well as against Filipino villages in the Philippines under Spanish rule.
      All this changed by 1875 as the Spanish navy decimated villages loyal to the Sulu Sultan on islands surrounding Jolo Island and then introduced a naval blockade which prevented trade access to the Sulu Kingdom. The Sulu Sultanate were no longer the naval power they once were as the Spanish defeated them comprehensively in many battles and they suffered heavy losses in men and ships.
      The Sulu were not able to commit acts of piracy, kidnapping and slave trading as the British Navy were directed to stop these pirate attacks in Sabah and to destroy the pirate bases at Marudu Bay and on the east coast of Sabah in the mid-1800s.
      This too contributed significantly to the decline of the Sulu economy which in turn saw reduced wealth in the royal treasury.
      ADVERTISEMENT
      For the Sultan of Sulu, he only had two options in January 1878; surrender to the Spanish as he was on the verge of total defeat or surrender Sabah to Dent and Overbeck and negotiate a deal to re-arm and to be able to continue fighting the Spanish.
      By establishing a relationship with Dent and Overbeck, he also hoped to have a territory to escape to in the event of defeat and a yearly payment of 5000 pesos to sustain himself and his family for the rest of their lives.
      By signing the agreement of cession in January 1878, it meant the sultan was willing to sacrifice any claims he may have had on Sabah at a time when the Sultanate was desperate for money and weapons to continue the war against the Spanish as the terms offered by Dent and Overbeck were for a total cession and not for a lease on the territory.
      It is for these reasons we now understand the pressures the Sulu Sultan faced in 1878 and why he agreed to give up all claims of ownership over territories he claimed in Sabah.
      Baron Von Overbeck and Alfred Dent saw a business opportunity and signed the agreement to purchase Sabah from the Sultan of Brunei.
      They then negotiated a similar agreement with the Sultan of Sulu who had overlapping claims over Sabah for 5000 pesos including three shiploads of guns and ammunitions which included a modern American weapon called the gatling gun that could fire 1000 rounds per minute.
      These historical facts are well documented by Don Carlos Cuarteron, the prefect of Borneo who documented these historical events in his personal diaries which can be viewed today in a book published by Mike Gibby titled “Crowned with the Stars.”
      It is because of his diaries that have been translated by Mike Gibby that we are now able to establish the real intentions of the Sultan of Sulu with regards as to why he agreed to the terms proposed by Dent and Overbeck and signed the agreement in 1878.
      The Sultanate of Sulu was forced to surrender to the Spanish in July 1878 after 300 years of bloody war and bloodshed. This final surrender brought about an end to any influence the Sulu would ever have again in the region.
      So, on what basis did the Sulu Sultanate ever have any claim to Sabah as the royal household were neither originally from Sabah, never lived in Sabah nor had any ancestorial claims to the territory in any capacity going back in time.
      There were no palaces, no cities and no centres of administration of the Sulu Sultanate in Sabah unlike the Brunei Sultanate who were based in Borneo and historically ruled most of Borneo for almost 6 centuries and had vassals and administrators and Bajau Samah armies based in Mengkabong, Putatan, Abai, Kinarut and even in Marudu. Until the cessation of Sabah in 1877, the entire west coast of Sabah was controlled by the Brunei Pangerans and their Bajau Samah warriors.
      In the 18th century, any Sulu claims over the east coast of Sabah was simply by the force of arms after the decline of Brunei hegemony with no proper transfer of sovereignty.
      Much of the controversy of “was it a lease or cessation” begins with Jamalul-Kiram II, the son of Sultan Jamal ul-Azam who had signed the agreement on 22nd January 1878. He replaced his elder brother as Sultan after the passing of Sultan Jamal and began to challenge the British by stating the agreement was a lease agreement and so this confusing narrative that the agreement of cessation was a lease begins, especially within the Philippines.
      But in the eyes of the Chartered Company and the British Government, there was never any question of the validity of the cessation: Sabah was not the property of the Sulu Sultanate any longer and there was nothing more to discuss on the matter.
      One aspect of history that further erodes arguments that the Sulu had some form of ownership over Sabah is that is the question of kidnapping and slavery; why would any royal household who claimed to rule over a people subject the very same people to a life of misery and slavery for the rest of their lives?
      The other historical issue we have found with claims made by the alleged claimants of the Sulu Sultanate today is that the identities of these Sulu claimants are also considered to be very doubtful as they do not allegedly come from a lineage that is linked directly to the Sulu Sultan from the 1800s.
      Having translated the agreements of cessation signed by the Sultan of Sulu from Jawi into English and Bahasa Malaysia in 2020 whilst researching the agreements, our discoveries were as follows:
      1: There does not appear to be an escape clause or exit clause in the agreement, meaning the Sultanate is bound by the agreement forever.
      2: There are no penalties for late payment(s) of the annual 5,000 pesos and/or the ability for the Sultanate to cancel the agreement if there is a breach of the agreement due to non-payment by Dent and Overbeck.
      It is an agreement that does not in any way suggest it is an agreement of lease but rather, what we would today call a “sale and purchase agreement.”
      the agreement did not appear to favour the seller but favoured the buyer as all rights are given to the buyer for as long as he desires, which essentially means, forever.

      That Sabah or North Borneo was once part of the Brunei empire is not disputed. But the Philippine claim to Sabah rests on the assertion that Brunei gave the territory to Sulu in return for assistance in the 1660-73 Brunei Civil War. However, the sources supporting this notion give the year of transfer as either 1658, two years before the Civil War broke out, or 1704, 31 years after it ended. The span of time covers the rule of different Brunei sultans.
      Brunei has never accepted or acknowledged that North Borneo was given to Sulu. A narrative in Brunei states that although an offer of land may have been made in exchange for military support, that support never came so the deal was never concluded. No Sulu sultan or other authority has been able to furnish proof of ever receiving the territory from Brunei, or of having governed it since.
      Britain annexed Sabah as a crown colony in 1946, after the chartered British North Borneo Company acquired it through a sale from the German magnate Gustav Overbeck, who had obtained the cession from the sultan of Brunei in December 1877. Since Sulu was making representations to the territory then, Overbeck also went through the motions of a cession with the sultan of Sulu some three weeks later. Two competing title deeds were obtained, signifying rival claims to ownership and sovereignty being given away.
      Both title deeds were for a permanent cession, but only Sulu has tried to overturn the agreement. Sulu representatives have since tried to use the title deed granted to Overbeck as proof of Brunei having ceded the territory to Sulu. Even before the founding of the Republic of the Philippines, successive Spanish and US colonial administrations had already rendered the Sulu sultanate defunct. Any credence in the Philippine claim today is highly contested and purely historical in nature, which is rejected in international law.
      The Manila Accord of July 31, 1963 facilitated the formation of Malaysia with Sabah without hindrance from the Philippines, while granting Manila the option of continuing to entertain its claim. However, conditions were set by both the Philippines and the descendants of the defunct Sulu sultanate. Manila wanted a UN-approved plebiscite of Sabah residents endorsing the creation of Malaysia, and the Sulu partisans wanted the continuation of the RM5,000 annual cession payment (later increased to RM5,300) from Malaysia.
      Malaysia met both conditions. However, after the February 2013 attacks on Sabah by armed militants from Sulu which violated their part of the agreement, Malaysia discontinued the payments. Philippine partisans have also described the annual cession payments as “rent” to support their claim of ownership.
      The persistent claims to Sabah, whether from Manila, Sulu or both, are disreputable and without foundation. They are a continuing irritant to the Philippines’ ties with Malaysia and risk a rupture in otherwise healthy relations. They cannot continue to be a weighty albatross because no sovereign nation can accept such blatant and baseless claims on its territory. As with his immediate predecessor Benigno (“Noynoy”) Aquino, President Rodrigo Duterte had said he would study the Philippine claim before proceeding with it. That has been some years now and he, like Aquino before him, has decided not to pursue it.

    Paris Court: On 12 July 2022 Malaysia obtained Suspension (Stay) Order from the Paris Court of Appeal to suspend Exequatur Order issued by Paris Court. A Stay Order obtained in the French Court of Appeal pending application to set aside an arbitration award in an arbitration proceeding also to be filed in the French Court has a high probability to be allowed since the arbitration proceedings itself was held ex-parte (one sided) which is deemed deficient and defective. Also, this court has no jurisdiction on a sovereign state. Soon it will just be like Spain that rejected the claim.
    French arbitration court: Under the French Arbitration Law, original arbitration agreement or a copy thereof must be provided when settling a dispute through arbitration in France to proceed. This is in accordance with the more precisely Article 1504 of the Code of Civil Procedure or CPC. This is also in compliance with Article 2 of the New York Convention 1958. So, is there any arbitration agreement exist between Sulu and Malaysia? If none, the court cannot proceed.
    International Court of Arbitration: It is an institution for the resolution of international commercial disputes based in Paris. It operates under the auspices of the International Chamber of Commerce and consists of more than 100 arbitrators from roughly 90 countries. Contrary to what its name suggests, the ICC does not issue formal judgements. Instead, it provides judicial supervision of arbitration proceedings
    Luxembourg arbitration court: Read the Luxembourg Arbitral Act particularly in Article 1224 to 1251 of the New Code of Civil Procedure (NCPC). Pursuant to Article 1226 NCPC, arbitration clause or arbitration agreements can be made before the arbitrators, by deed before a notary or by written agreement. Article 1227 of the NCPC provides that the arbitration agreement must specify the intention of the parties to submit their dispute to arbitration, the subject of the dispute and the arbitrators’ names to be valid. Do Sulu have that arbitration agreement? If not, then the court cannot proceed.

    On 31 August 1963, North Borneo attained self-government. The idea for the formation of a union of the former British colonies, namely, Malaya, Singapore, Sarawak and North Borneo was mooted as early as the late 19th century, but it was Tunku Abdul Rahman who officially announced the proposal of wider federation in May 1961. It also seemed that this idea was supported by the British.[40] There was a call for complete independence on that date by it was denied by the British Governor who remained in power until Malaysia Day.[41] In 1962, the Cobbold Commission was set up to determine whether the people of Sabah and Sarawak favoured the proposed union. The commission had found that the union was generally favoured by the people but wanted certain terms and conditions incorporated to safeguard the interest of the people. The commission had also noted some opposition from the people but decided that such opposition was minor. The Commission published its report on 1 August 1962 and had made several recommendations. Unlike in Singapore, however, no referendum was ever conducted in Sabah.[42]
    Most ethnic community leaders of Sabah, namely, Mustapha representing the Muslims, Donald Stephens representing the non-Muslim natives, and Khoo Siak Chew representing the Chinese, would eventually support the formation. An agreement was signed by Tunku Abdul Rahman, Harold Macmillan, the British Prime Minister, and William Goode, the last Governor of North Borneo, signed on behalf of the territory on 1 August 1962 putting to paper the agreement to form the union. The intention had been to form Malaysia on 31 August 1963 but due to objections from the Philippines and Indonesia, the formation had to be postponed to 16 September 1963. At that point North Borneo, as Sabah, was united with Malaya, Sarawak and Singapore, to form Malaysia.[43][44] To safeguard the interest of North Borneo in the new federation, a 20-point agreement was entered into between the federal and the state government.

      ​@@NotLikeWhatYouThink, because Sulu had got nothing to do with Sabah anymore except as recipient of "cession money" annual payment which was merely a consolation for the Sulu Sultan. Why? Because on 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory.
      Then in 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain.
      Even though Britain, as the new owner of Sabah, had full control, they still honoured the annual cession money payment stipulated in the 1878 "pajak" agreement as consolation for the Sulu Sultan. So did Malaysia when formed, still honoured the annual cession money payment as consolation for the Sulu Sultan.
      Sulu Sultan could not claim anything because he had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain. What ever happened to Sabah after that was under Britain's jurisdiction.
      On 31 August 1963, Britain gave independence to Sabah. And then the people of Sabah and Sarawak had made decision of self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report Final Conclusion of the Secretary-General 14 September 1963. The last sentence of the report says:
      "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia".

      Impossible maging province ang Sabah. Kasi ang Sabah ngayon sa division ng Malaysia ay binubuo iyan ng 15 provinces kaya baka maging 4th island ng Pilipinas yan kung sakaling ma-claim ng Pilipinas.

    28th June 2023, the Hague Court of Appeals in Netherlands has ruled in favour of Malaysia.
    Now the Hague is the third court of appeals that The Citizens of PH have lost its case.
    The annulment of all Stampa’s doing would eventually left the Sulus with nothing.
    When the money dries up in their sponsors’ pockets..court hopping would stop too…then Malaysia will counter sue and these people would end up in jail.

    Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia.
    Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate give North Borneo to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to BNBC. These agreements exist and keep in the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned Sabah into British Charter (1881), Protectorate (1888), Colony (1946) and finally incorporate into Malaysia in 1963.
    Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish its territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement 1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing.
    Rebut with facts and references. Not hearsay.

    Why not divide it into 2 so both countries should be benefited, Malaysia has been there digging mineral resources for a long time so the Philippines should rule the territory too, for the same years as how many times they did. So the people who live there have nothing to worry about but slowly move to the other side of the land while processing each family's rights.

    Based on the context of attachment of UN General Assembly 1541 (XV), number 4 principal 9, and evaluation of UN Secretary General (at that time held by Bhutan); the three countries, Malaysia, Philipine, and Indonesia HAVE TO WAIT SABAH STATUS DECISION BASED ON TERRITORY OWNER VOICE (FROM SULU SULTANATE), OR RESULT OF LOCAL PEOPLE VOTES IF SULU SULTANATE WITHOUT BEING FORCED HANDED OVER THE DECISION OF SABAH STATUS TO LOCAL PEOPLE WHICH WOULD BE SUPERVISED BY UNITED NATION; because it is related to law order of territorial tenure or decolonization (on the basis of rent document as a proof, SABAH IS NOT BRITISH COLONY, or IS NOT OWNED BUT RENTED BY BRITISH, SO THAT SABAH IS OWNED BY SULU SULTANATE, and BRITISH HAS NO RIGHT TO HAND OVER SABAH TERITORY TO ANOTHER COUNTRY).
    Generally, INTERNATIONAL LAW, decision to certain Sabah status (attachment of UN General Assemby 1541 (XV), number 4 principal 9) MUST BE BASED ON ONE OF THE ALTERNATIVES BELOW:
    a. return back Sabah teritory to Sulu
    Sultanate as the owner of Sabah,
    or
    b. (if) Sulu Sultanate without being forced
    handed over voice right to local people
    for voting Sabah status certainty, then
    the decision of Sabah status would be
    certainty by one of the following choices:
    - join to Malaysia
    or
    - join to Philipine
    or
    - join to Indonesia
    or
    - establish a new country.
    BUT MALAYSIA DIDNOT OBEY THE AGREEMENT and IGNORED UNITED NATION RULE ABOVE through DECISION TO ESTABLISH FEDERAL STATE OF MALAYSIA AT SEPTEMBER 16, 1963; ANNEX SABAH WITHOUT RESPECTING THE OWNER VOICE, OR LOCAL PEOPLE WILL (if Sulu Sultanate handed over the decision of Sabah status to local people) AND WITHOUT RESPECTING UNITED NATION RULE ABOVE THAT WAS COMMITTED IN THE AGREEMENT. This Malaysia’s decision ignite anger of two countries (Philipine and Indonesia), so that in 1963 Philipines and Indonesia cut off diplomatic relations to Malaysia, and was followed by conflict and confrontation by Indonesia that was called “Ganyang Malaysia” at that time. Generally, INTERNATIONAL LAW (based on attachment context of UN General Assembly 1541 (XV), number 4 principal 9), enforces rule that TAKING OVER A TERITORY TO BECOME A NEW COUNTRY MUST BE OBEY THE RULE BASED ON ASPIRATiON (VOICE) OF THE TERRITORY OWNER’S DECISION. IF NOT, THEN THAT TERITORY IS PERMANENT BELONG TO THE OWNER. Because British was not the owner (rent document as a proof), then SABAH IS STILL OWNED BY SULU SULTANATE (British only as a renter to Sulu Sultanate according to agreement). SULU SULTANATE AS THE SABAH TERRITORY OWNER HAS THE LAW RIGHT TO DO ANYTHING RELATED TO HIS OWN TERRITORY.
