      @@vester7104 yeah suit him. The Spanish court already rejected his arbitration but he went to Paris and gave the final award after Madrid court rejection. That is court contempt and professional intrusion. Found guilty and jailed.

      The native and indigenous people of Sabah never accept or never submit to Spanish rule. The inland people never meet even one Tausug originally from Jolo island. Brunei never gave sabah to sulu. In 1877 sultan of Brunei signed 4 agreement documents with Overbeck to cede Sabah. This agreements is proof that Brunei never gave sabah to sulu sultanate. In 1963 the natives choose to be part of Malaysia not Philippines because they never submit the sulu sultanate, never rule by Spanish and never rule by Filipinas.

    This is the fault of the British empire that created this dispute between the two countries. They should have stopped the lease of the territory and returned it to the rightful owner before they granted Malaysia"s independence.

    Sabah is a Philippine territory owned by Sultanate of Sulu. Malaysia rented Sabah for more than 100 years & grabbed it from the real owner which is the Sultanate of Sulu. Don't be so greedy Malaysia because greediness must have KARMA. Now, you're facing Karma by exploiting Sabah Island natural gas then paying rent to the sultanate of Sulu only 5k+ rinngit, is that fair? PETRONAS earned billion of dollars yet paying only a small amount to the real owner of Sabah? Be human & be ashame of yourselves for being too greedy.

      @@maharirajak5513 it's your narrative but one thing of advice please do your research because knowing something is an advantage. Sabah Island was given by the sultanate of Brunei as a reward by helping them during a civil war caused by communists through the help of the soldiers of Sultanate of Sulu the invasion of communists never prospered in return the favor the sultanate of Brunei gave Sabah to the sultanate of Sulu as a gift. In 1890's a British company rented Sabah Island with an amount of 5k+ Mexican dollar proof of payment did by British company and Malaysian government is an legal evidence of the sultanate of Sulu. So, who do you think a greedy one? Please dig deeper the issue don't jump into an issue which you don't know. Is there any issue around the world that the Philippines grabbed islands? Know your history too because Sabah is part of Brunei territory before it was given to the sultanate of Sulu.

    Which ever side has a strong evidence proven the claim is the legal owner of the territory. As of now, the heirs from Sulu and the Philippines in general has clear evidence that supports the claim. Now, if Malaysia failed to present necessary proof for its claim then, it should be given away peacefully to the righful owner.
    Whatever the final decision from the international court, both sides must deal with utmost respect.

    When I was yet a grade 4 student, around 1966, I can still remember that the Philippines Map included Sabah... When I was already around 3rd year High School student, the Map did not include Sabah anymore.. I did not know what happened coz it was seldom discussed, until just recently and now that it is making headlines...

    One thing missing is Indonesia. Indonesia is the the one who know sabah position better, because indonesia was the one challange british into war to stop sabah and serawak join the federation. And Philippine depend on indonesia at war because indonesia is Big Brother. While indonesia war not to claim over sabar or serawak but to settle down the right of the of owner of 2 state before them join malaysia federation.

    The fact that Malaysia paid rent to the heirs of the Sultanate of Sulu means, the Malaysian Government agreed that they are renting "Sabah". By refusing to pay rent just recently exposed them to default proceedings in Court. A valid agreement between two parties prevail over unilateral decisions. Malaysia wants to own Sabah, but they can't deny they are party to an ancient agreement. They have to go and read what was agreed and do what is right.

      The fact is
      Sabah, north borneo is an independent state
      In 1963 as an independent nation, north borneo later sabah has decided to form a new federated country named Malaysian federation together with other independent nation
      1.malayan federation
      2.singapore(separated in 1965)
      3.sarawak
      4.sabah(new map north borneo)
      if sabah decided to separate from the federation it will become independent nation that automatically will be recognized by the united nation just like singapore.
      My question is, will the philippine accept the situation? or will they takeover sabah by using military force?
      My assumption is they will choose second option.why? You should ask the sabahan people for the correct answer.

      Btw Ilocano or Ilokano is a dialect here in the Philippines that is spoken in the northern part of Luzon.

      Real owner are the descendants of the Sultanate of Sulu. But the heirs they gave Philippines authority to get it back. So technically Sabah is part of Philippines.

      In February 2022, the Paris Court ruled that Malaysia had violated a treaty signed in 1878 of annual cession payment and would have to pay at least US$14.92 billion (RM62.59 billion) to the descendants of the sultanate of Sulu.[100] In March 2022, Malaysia again filed an application to annul final award over claims by Sultan of Sulu's heirs since the appointment of arbitrator Dr Gonzalo Stampa was itself annulled by Madrid High Court in June 2021, rendering any decisions by him to be invalid including the 2022 award.[101] Lawyers for the heirs indicated that they will seek the award’s recognition and execution, citing a 1958 U.N. Convention on Recognition and Enforcement of Foreign Arbitral Awards.[102][103]
      In July 2022, court bailiffs in Luxembourg served Petronas Azerbaijan (Shah Denis) and Petronas South Caucus with a "saiseie-arret" or a "seize order" on behalf of descendants of the Sultan of Sulu. Petronas said it would defend its legal position, and further clarified that the entire said asset had been divested in 2021 and all the proceeds had been repatriated,[104] rendering the actions baseless.[105][106] In the same month, the Paris Court of Appeal allowed the Malaysian government's application to obtain a stay order against enforcement of the French arbitration court, since the enforcement of the award would infringe on Malaysia's sovereignty.[107] This effectively suspends the enforcement of the award in any country until a final decision by the Paris court is decided upon.[108]

    Lots of people in Sabah are stateless. Even if they were born there, Malaysia does not grant them citizenship. They don't have rights, cannot be employed, not accepted in schools. These people suffered for decades.. the reason is... They are not born in Malaysia but in Sabah. Hope these people will have their freedom and live as Filipinos.

    The Incorporation of Sabah into the Federation of Malaysia is illegal because they are just renting Sabah which obviously is an admission of non-ownership of Sabah. Malaysia is trying to maintain that what they are paying is cessation. Malaysia does not have the right to interpret the contract because they are not party to the contract done between the British North Borneo Company and the Sultanate of Sulu. If the money given is payment for purchae of Sabah what is the agreed total Sale price of the land of Sabah stated in the contract. There is none! The abscence of an agreed Total Sale Price of Sabah shows that the annual money being given to the Sultanate of Sulu (Philippines) is obviously rent money.

    They must also filed a lawsuit against this North Borneo Company which is responsible of not returning Sabah to the Sultanate of Sulu since they are the first tenants of Sabah instead they cheated and incorporated Sabah on the formation of federation of Malaysia disregarding Sultanate of Sulu.

      on the east, and thence along the whole east coast as far as the Sibuku River

      This treaty is written in Sulu, at the Palace of the Sultan Mohammed Jamalul Alam on the 19th day of the month of Muharam, A.H. 1295;

      In the agreement it was clearly stated lease in perpetuity. Also, in the agreement stated the lease can change hands with the consent of the Majesties. When Malaysia was formed and Sabah invited it must with the consent of English ruler otherwise it will not happen.

    Enforce the 1878 North Borneo Treaty and treat Malaysia's non-payment as a breach of contract. Since Malaysia lost their appeal in the Madrid High Court of arbitration, it has no choice but to pay up and eventually surrender the claim to the Sultanate of Sulu / Sabah. Malaysia owes the Heirs of the Sultanate 14.92Billion $ and accruing. Either way, Malaysia is screwed. Remember that Malaysia is a signatory in the New York Convention of nations and is expected to respect the ruling since it participated in the arbitration proceedings in Madrid and France. Historical documents and the High courts of arbitration prove that Malaysia is at fault and is too butt-hurt in denial. Here's the billion dollar question - So can you Malaysians prove that your government does not actually consist of a bunch of liars and cheats or will you ultimately respect the International High Court's ruling? 👎

    There was NO TREATY and CESSION it was a private contract... The claim of Malaysia is based on the manipulated interpretation of the original contract. British Monarchy forcefully took Sabah without regard to the true owner of the land, the Sultan of Sulu. And, the decision of the commission totally ignored the owner Sultan of Sulu. Therefore, the British Monarchy illegally grabbed Sabah and owned her. What can Sultan of Sulu do with few fighters against the powerful armies of the British Monarchy? This was an invasion and grabbing of land. This was British Monarchy's SIN against the Sultan of Sulu. Therefore, Malaysia must respect the truth. How can a British Monarchy own a foreign land except by force or by deception???

    There’s no more controversy as to owns Sabah. This issue has gone through International Court and the Philippine claim has been proven as legitimate while Malaysia’s claim have been exposed as a hoax.
    My suggestion is that Malaysia face the facts, become a country of good citizens and turn over Sabah peacefully. If Malaysia continues to give the Philippines a hard time, they might just invite Sarawak in joining the Philippines as well since they have been a victim of British coercion (with Sabah) in joining this invented and fictitious Malaysia. Yes, Sarawak had been forcefully included in this made up Federation without their consent.
    These Sarawakans are predominantly Christians and might be interested in joining in with another Christian country.
    Goodbye Malaya! That’s who you really were from the beginning.

      @@facewall9252 Technically speaking Sabah is a private property of the Sultanate of Sulu. Therefore those living there are just trespassing/ squatting in the land. Keep that in mind. Sabah is not Malaysia nor Philippines, but since the heirs of Sultanate of Sulu chose the Philippines as its successor of its property which is Sabah, therefore the Philippines need to step up to get Sabah from being part of Malaysia. Learn English to be more educated. :)

    Being Filipino who visited Kota Kinabalu, Sabah, I really admired how Malaysian government run the territory. I never expected it to be a great city, clean and progressive. Way far better than southern Philippine capitals of Bongao and Jolo. I just pray that if ever the land will be returned back to the Philippines, this will be managed well and will never lose its reputation as a top tourist destination in Southeast Asia. I love my country, and I love Malaysia too.

      I'm glad you like the tour of Sabah, but we will most likely not join The Philippines as most Sabahan would most likely rebel against them. Either Malaysia or independence, never the Philippines.
      I don't hate the Philippines, it's a good country, it's just that Sabah will not be in good hands if it does fall to the Sulu's hand. We know what will happen to us and we will fight to the end for Sabah.

    Clear as day light, this is very clear, Sabah belongs to the sultanate of sulu and the sultanate is in the Philippines so Sabah is Philippines. After all, when all this undertakings took place, there was no Malaysia, if not only for the meddling of the British govt, who is allien to this part of the world and allien to the culture, decided to include north Borneo, now Sabah, the piece of land whom they understandably leased from the sultanate of Sulu for several years, in the formation of Now Malaysia. It’s time to pay the past dues and return Sabah to its rightful owner

      Why didnt the Sultan Sulu take the land before the formation of Malaysia? or even before Sabah achieve independence? maybe the Sultan didnt have power over the people living in his land. Why? because it was Brunei who is more involved and Sulu just took the land as gift. and Brunei was the righteous owner. Also if the British was not here the Japanese would have take over it anyway. After years of sovereignty, now Sabah is more establish than the Sultan's place. The 2013 attack was claimed not associated with the actual family but who knows. After the attack Malaysia stopped paying. Why was there no issue about the payment before? who knows maybe to gather all the evidences only to enter a court that is not recognized by our Govt. so let the legal matters to the court.

    The arbitral ruling is a final an irrevocable decision. If Malaysia will continue not to pay the heirs of sultanate of sulu then they can just sieze after sieze Malaysia's state owned companies. Malaysia should start and be willing to have Bilateral talks to the Philippines soon. The fact that Malaysia Honored and continued Paying for the rent means that the real owner of the land is the Sultanate of Sulu.

      Real owner is only for Sabah people.. because the Sabah country have a native/original race which is “Kadazan dusun, Bajau, Malay brunei, sungai, and others” according UNESCO, Kadazan dusun is originally race in SABAH country. And half of non-native race in Sabah stay in Sabah it’s called foreigner, from sulu territory at Phillipines. So, when follow my logic opinion is, the owner and the rights is more belongs to SABAH PEOPLE only. Sultan sulu is just come to SABAH . But the real race and the real owner is native race from Sabah country. So, SABAH PEOPLE more have rights to make decision to create their own country.

Prior to that lease agreement it was Sultan Abdol Momin of Brunei (their ancestor) who first leased Sabah to the BNBC, the contract was said to be renewable kaya that time kung sino nakaupo Sultan ng Brunei they can renew the contract with BNBC nasa Brunei library yan.
      The was also evidence that Sulu is part of Brunei when the son of the Sultan of Brunei Pengiran Muda ak.a Datu Jamasali was appointed Governor of Sulu in 1888 and got married to a Sulu woman and they had one child born in Brunei Palace and grew up in Sulu, said royal Princess was kept in Sulu for her safety due to the constant invasion of the British forces in Brunei in early 1900s. She was one of the legal heiress of Sabah and Sulu up to Brunei, Datu Jamasali became Regent Sultan of Brunei appointed by his father Sultan Jalilul Hashim Alam Aquimiddin who was in the advance age and cannot anymore carry the responsibility as Sulan of Brunei. As per Brunei Museum records Dayang Dayang Piandao Jamasali Bolkiah was the legit only child of the regent Sultan of Brunei and Sulu. Actually meron gustong umagaw sa Jamasali Sulu throne.

      Sabah belongs to Malaysia not Philippines. The former Presidents of the Philippines Ferdinand E. Marcos, Corazon C. Aquino, Fidel Ramos, Benigno Aquino III and others already drop the Sabah claim and surrendered its claim already since 1970s after UN court ruled Sabah belongs to the Sultan of Brunei. The Sultan of Brunei gave Sabahans chance to join Malaysia in 1966 referendum since Brunei did not join the Federation of Malaysia instead chose to be separated.
      Philippines failed to present evidence to the UN court such as cessation agreement, it is one of the best evidence for a Nation to claim a certain territory. This case was brought by Sultan Hassanal Bolkiah before the UN Court over his territorial rights over Sulu after the U.S. invaded Sulu and never gave Sulu back to the Sultan of Brunei instead the U.S. Illegally annexed Sulu to the Philippines without the consent or in the absence of a cessation agreement from the Sultan of Brunei. The UN court has favored the Sultan of Brunei and obligated the Philippines to return Sulu to the Sultan of Brunei.

    Malaysia participated in the arbitration. They lost but made an appeal.
    Sabahans were surprised about this development. I understand Bahasa Malaysia. Reading the comments in Malaysian websites showed that many Malaysians were caught by surprise and demanding the government clarity.

    So much human righs violation in Sabah when Malaysia refused to give papers to the local Filipinos there--a million of them. Most of these Filipinos are the descendants of Filipinos living there even before Malaysia was formed. They are stateless, which mean they cannot get jobs and go to school and legally own a home--their homes are always torn down. This is creating a massive human rights problem--under the Malaysian government these people will always have a grim future and will always be oppressed. Watch the video "Sabah's stateless: Who are Malaysia's invisible people?" of CNA insider. As a Filipino I previously didn't care about Sabah but hearing about the million of my brothers and sisters that are treated as lower than dogs, I now hope that Sabah will be under the Philippine laws once again so that these oppressed people will have a chance at life.

      Me as sabah people have to say those filipinos who came to sabah illegally is problematic.. They committed a crime such as robbery, kidnap, raping and more.. I still remember the incident that happened to me few years ago, they use their kids to beg for money and when my car stopped because of the traffic light, those filipinos kids knock the window and ask for money, so i give some to them.. their friends suddenly rushed to my car and ask for some money too and was shocked and scared at the same time.. So i closed my window then some of them showed middle finger to me lol.. Of course, the video u have watch before didn't show about the bad things what filipinos did here because they want to hide it.. Tbh, those filipinos who owned malaysia citizenship is more better than those filipinos who come illegally to sabah. I also have some filipinos friends and we are such a good friend

    I suspect the real reason why the British seized Sabah, when merging Sabah into Malaysia, was to create a protective buffer zone all around Brunei, which by then was known to have vast reserves of oil both on and offshore. The Malay word pajak is without doubt to lease, or rent or pawn. In any case, a treaty to lease this vast state of Sabah in perpetuity with 2 bloody nobodys from Europe / England has no validity. This treaty must have been signed under coercion, though it doesnt say so. Where does the Sultan of Brunei store his vast gold reserves - in the Bank of England ? The dishonest Anglo Saxon rabbit hole is much deeper than you think. The Falklands, Gibraltar, Cyprus, Palestine, Singapore, Diego Garcia, Cocos Keeling Islands and many more signs of Anglo Saxon, Dutch, French, Spanish, German and Belgian duplicity still in place in the current world order. Tear it all down and redraw the borders.

      The claim over Sabah from the Sulu Sultanate originates from the Pulau Chermin Civil War and Kinarut Wars which was an internal civil war within the Brunei Sultanate that lasted for 12 years from 1661 to 1673 between two opposing members of the royal household who claimed the throne; Sultan Abdul Hakkul Mubin and Sultan Muhyiddin.
      The claim over Sabah from the Sulu Sultanate is that either all of Sabah (or some territories within Sabah) was promised to them for aiding Sultan Muhiyiddin in the war.
      During the final battle in 1673 at Pulau Chermin, Sultan Mubin was defeated but there are conflicting versions as to if the Sulu warriors did indeed fight in the battle or if they merely waited for the battle to be over before ransacking the royal palace at the end of the battle.
      Prisoners were taken by the Sulu including a son from Sultan Mubin before they departed back for Jolo Island. No demands were made until 15 years later in 1688 when the very same son, named Datu Dakula was sent back to Brunei to claim what was promised to the Sulu Sultanate.
      There is also a suggestion that the Sulu claim over Sabah comes from Datu Dakula’s heritage as being a surviving son of Sultan Mubin, who therefore inherited all of Sabah as including six territorial dependencies since his father had died and Sabah was presented as a gift to Sultan Mubin’s parents during his wedding by the previous Brunei Sultan, Sultan Saiful Rijal.
      Sadly, there exists no historical evidence or agreements to support these claims by the Sulu Sultanate that Sabah was given to them by Brunei or if promises were indeed made by the Sultan of Brunei. And so, the Sulu claims appears to have no merit historically in this respect.
      The Sulu Sultanate were responsible for encouraging bands of pirates under the leadership of various datu’s loyal to the throne to commit acts of piracy, kidnapping and the capturing of natives from coastal villages along the shores of Sabah from the mid-1700s till the late 1800s to be sold as slaves at slave trading markets in the Sulu archipelago.
      Kidnapping of natives and selling them as slaves was part of a greater economic trade that was incredibly profitable and a lucrative business; slaves provided manpower for plantations, manpower as rowers on war ships, house maids as well as skilled craftsmen for many traders in the Sulu Archipelago as well in foreign lands. And slaves could be used to settle personal debts between various datu’s and businessmen in the Sulu region.
      The British avoided conflict with the Spanish in the Borneo and Philippine regions but did attack and capture Manila for a short period of time in 1763. They were happy to trade with the Sulu by selling them guns and ammunition which helped them sustain their war with the Spanish until their defeat in July 1878.
      Balambangan and Labuan islands served as important trading posts for the British to sell guns, ammunition and to barter trade with the Sulu for jungle products and opium.
      The Spanish, who had ruled much of the Philippines since 1570 had struggled to end the Sulu insurgency in the south for 300 years. They had previously signed many peace treaties after defeating the Sulu Sultanate in battles between the 1600s till the late 1700s but in every instance, once the Spanish had left, the treaties were torn up and completely ignored.
      The Sulu Sultanate then went back to committing acts of piracy, kidnapping and slavery against not only native villages in Sabah under Brunei rule as well as against Filipino villages in the Philippines under Spanish rule.
      All this changed by 1875 as the Spanish navy decimated villages loyal to the Sulu Sultan on islands surrounding Jolo Island and then introduced a naval blockade which prevented trade access to the Sulu Kingdom. The Sulu Sultanate were no longer the naval power they once were as the Spanish defeated them comprehensively in many battles and they suffered heavy losses in men and ships.
      The Sulu were not able to commit acts of piracy, kidnapping and slave trading as the British Navy were directed to stop these pirate attacks in Sabah and to destroy the pirate bases at Marudu Bay and on the east coast of Sabah in the mid-1800s.
      This too contributed significantly to the decline of the Sulu economy which in turn saw reduced wealth in the royal treasury.
      ADVERTISEMENT
      For the Sultan of Sulu, he only had two options in January 1878; surrender to the Spanish as he was on the verge of total defeat or surrender Sabah to Dent and Overbeck and negotiate a deal to re-arm and to be able to continue fighting the Spanish.
      By establishing a relationship with Dent and Overbeck, he also hoped to have a territory to escape to in the event of defeat and a yearly payment of 5000 pesos to sustain himself and his family for the rest of their lives.
      By signing the agreement of cession in January 1878, it meant the sultan was willing to sacrifice any claims he may have had on Sabah at a time when the Sultanate was desperate for money and weapons to continue the war against the Spanish as the terms offered by Dent and Overbeck were for a total cession and not for a lease on the territory.
      It is for these reasons we now understand the pressures the Sulu Sultan faced in 1878 and why he agreed to give up all claims of ownership over territories he claimed in Sabah.
      Baron Von Overbeck and Alfred Dent saw a business opportunity and signed the agreement to purchase Sabah from the Sultan of Brunei.
      They then negotiated a similar agreement with the Sultan of Sulu who had overlapping claims over Sabah for 5000 pesos including three shiploads of guns and ammunitions which included a modern American weapon called the gatling gun that could fire 1000 rounds per minute.
      These historical facts are well documented by Don Carlos Cuarteron, the prefect of Borneo who documented these historical events in his personal diaries which can be viewed today in a book published by Mike Gibby titled “Crowned with the Stars.”
      It is because of his diaries that have been translated by Mike Gibby that we are now able to establish the real intentions of the Sultan of Sulu with regards as to why he agreed to the terms proposed by Dent and Overbeck and signed the agreement in 1878.
      The Sultanate of Sulu was forced to surrender to the Spanish in July 1878 after 300 years of bloody war and bloodshed. This final surrender brought about an end to any influence the Sulu would ever have again in the region.
      So, on what basis did the Sulu Sultanate ever have any claim to Sabah as the royal household were neither originally from Sabah, never lived in Sabah nor had any ancestorial claims to the territory in any capacity going back in time.
      There were no palaces, no cities and no centres of administration of the Sulu Sultanate in Sabah unlike the Brunei Sultanate who were based in Borneo and historically ruled most of Borneo for almost 6 centuries and had vassals and administrators and Bajau Samah armies based in Mengkabong, Putatan, Abai, Kinarut and even in Marudu. Until the cessation of Sabah in 1877, the entire west coast of Sabah was controlled by the Brunei Pangerans and their Bajau Samah warriors.
      In the 18th century, any Sulu claims over the east coast of Sabah was simply by the force of arms after the decline of Brunei hegemony with no proper transfer of sovereignty.
      Much of the controversy of “was it a lease or cessation” begins with Jamalul-Kiram II, the son of Sultan Jamal ul-Azam who had signed the agreement on 22nd January 1878. He replaced his elder brother as Sultan after the passing of Sultan Jamal and began to challenge the British by stating the agreement was a lease agreement and so this confusing narrative that the agreement of cessation was a lease begins, especially within the Philippines.
      But in the eyes of the Chartered Company and the British Government, there was never any question of the validity of the cessation: Sabah was not the property of the Sulu Sultanate any longer and there was nothing more to discuss on the matter.
      One aspect of history that further erodes arguments that the Sulu had some form of ownership over Sabah is that is the question of kidnapping and slavery; why would any royal household who claimed to rule over a people subject the very same people to a life of misery and slavery for the rest of their lives?
      The other historical issue we have found with claims made by the alleged claimants of the Sulu Sultanate today is that the identities of these Sulu claimants are also considered to be very doubtful as they do not allegedly come from a lineage that is linked directly to the Sulu Sultan from the 1800s.
      Having translated the agreements of cessation signed by the Sultan of Sulu from Jawi into English and Bahasa Malaysia in 2020 whilst researching the agreements, our discoveries were as follows:
      1: There does not appear to be an escape clause or exit clause in the agreement, meaning the Sultanate is bound by the agreement forever.
      2: There are no penalties for late payment(s) of the annual 5,000 pesos and/or the ability for the Sultanate to cancel the agreement if there is a breach of the agreement due to non-payment by Dent and Overbeck.
      It is an agreement that does not in any way suggest it is an agreement of lease but rather, what we would today call a “sale and purchase agreement.”
      the agreement did not appear to favour the seller but favoured the buyer as all rights are given to the buyer for as long as he desires, which essentially means, forever.

    The fact that Malaysia participated in the arbitration proceedings, this means that whatever the decision of the arbitral court, they are bound to respect it. It's time for Malaysia turn over Sabah to the Heirs of Sultanate of Sulu. And Sabah will be at the disposal of the heirs as they pleased.

      Its not clear whether they participated or not what is clear is they are a member of the arbitration court and many of their overseas assets are in the hands of its members and they are obliged to respect the arbitration court rulings, so ignoring the rulings is not a wise option or a way out of the mess.

    No company have that rights.
    Only possible from state/country/kingdom to other state/country/kingdom.

    Malaysia didn't have any sovereignty on Sabah because they can't get it from just a British company who leased the land.
    The only solution to the people who already live in Sabah is a negotiation to the Philippines on what will be their status if the Philippines already in full sovereignty of the land.
    People living there should retain their rights to live on the land under the sovereignty of the Philippines.
    They already no obligation to pay any taxes to Malaysia all their Malaysian document will be replaced by Philippine documents.
    That's how it should be done.

    Lots of people say that the claim of Sultanate of Sulu are baseless, they say that the Sabbah is really belongs to Malaysian Government but for me what really matter here is not the peoples opinion but the decision of arbitration, whatever people say about Sultanate of Sulu at the end of the day the justice of international court will be service soon, why because Malaysian Government is one of the signatory of arbitration, so they are obligated to obey that decision wether they like it or not.

      In February 2022, the Paris Court ruled that Malaysia had violated a treaty signed in 1878 of annual cession payment and would have to pay at least US$14.92 billion (RM62.59 billion) to the descendants of the sultanate of Sulu.[100] In March 2022, Malaysia again filed an application to annul final award over claims by Sultan of Sulu's heirs since the appointment of arbitrator Dr Gonzalo Stampa was itself annulled by Madrid High Court in June 2021, rendering any decisions by him to be invalid including the 2022 award.[101] Lawyers for the heirs indicated that they will seek the award’s recognition and execution, citing a 1958 U.N. Convention on Recognition and Enforcement of Foreign Arbitral Awards.[102][103]
      In July 2022, court bailiffs in Luxembourg served Petronas Azerbaijan (Shah Denis) and Petronas South Caucus with a "saiseie-arret" or a "seize order" on behalf of descendants of the Sultan of Sulu. Petronas said it would defend its legal position, and further clarified that the entire said asset had been divested in 2021 and all the proceeds had been repatriated,[104] rendering the actions baseless.[105][106] In the same month, the Paris Court of Appeal allowed the Malaysian government's application to obtain a stay order against enforcement of the French arbitration court, since the enforcement of the award would infringe on Malaysia's sovereignty.[107] This effectively suspends the enforcement of the award in any country until a final decision by the Paris court is decided upon.[108]

      I think it was not unanimous, opposition was noted but it was considered by the commission as minor, unlike in Singapore where a referendum was conducted, no referendum in Sarawak and Sabah

    Malaysia will really be in trouble if PH Government take this seriously. I remember before, even Taiwan try to advance it's Teritory in the north part islands of the Philippines. Then the Scarborough Philippine China standoff not to mention the widespread drug problem proliferated by Chinese and Taiwanese Syndicates. Previous Leberal Party lead government doesn't seem to care. Filipino people had enough they elected Duterte a known tough guy as President. During the Duterte Administration Philippine foreign policy change drastically, it build a military base near Batanes Island near Taiwan. The Leberal Party has been obliterated in the Philippines Political Arena , they are just a very small minority now. Expect PH to continue expanding its military based in Palawan and Pag-asa Island. An Island near Palawan. It plans to counter China in the South China Sea inside in there EEZ (exclusive economic zone) . it acquired Spyder Messile System from Israel and Indias Brahmos medium range Land Base Messile System to be installed in strategic locations. Pag-asa Island will definitely be militarized because Brahmos range is 300km export limit but if India agrees to build it in PH it exempt the export rule it unlock its 700km maximum range. China's Artificial Island and Sabah is definitely inside it's striking distance capability. PH has currently have joint oil development with Israel in Palawan and British Oil company in Mindanao for Natural Gas. Projection of PH economy is said to expand even bigger with the current Marcos Administration. An Administration of a combined force of the Duterte and Marcos family. The first in PH history with the landslide mandate by the people. Both Family known to hire very competent administrators. ✌️

    If the British and the Malaysian government pays a yearly rental up until 2013 that means they didn't own the area concluding that the owner is Sultanate of Sulu. They have all the receipts and all the transactions are documented that's why the Sultanate won the arbitration.

    Since SABAH is paying its annual rental to the Sultan of Sulu, in a very simple thinking, SABAH is owned by the PHILIPPINES since Sulu where the Sultan reside is evidently province of the Philippines. The world is full of Hypocrites, no respect to the elders of our Land. The much affected in this issue was the Filipino's working in Sabah, they were treated badly by the Police, jailed in simple cases like expired working permits and no food inside those jails. Some already died of hunger. If the Sultanate of Sulu really is the rightful owner , then please help your land and its inhabitants so heaven help us.

    The lease of Sabah from Sulu Sultanate by Baron Overbeck in 1878 was transferred to British Prospector Alfred Dent. He then turned Sabah over to the Royal Crown of Britain which was vehemently protested by then US Governor General to the Philippines F.B. Harrison. The British colonizer then included Sabah in the newly formed Malaya Federation with total disregard to the rightful owners.. The Sulu Sultanate..
    Senator Jovito Salonga "Our claim is mainly based on the following propositions: that Overbeck and Dent, not being sovereign entities nor representing sovereign entities, could not and did not acquire dominion and sovereignty over North Borneo; that on the basis of authoritative British and Spanish documents, the British North Borneo Company, a private trading concern to whom Dent transferred his rights, did not and could not acquire dominion and sovereignty over North Borneo; that their rights were as those indicated in the basic contract, namely, that of a lessee and a mere delegate; that in accordance with established precedents in International Law, the assertion of sovereign rights by the British Crown in 1946, in complete disregard of the contract of 1878 and their solemn commitments, did not and cannot produce legal results in the form of a new tide."

      The remaining territory mentioned in the grants is actually under Sulu rule, and occupied by Sulu Chiefs, and it was only because the districts were mentioned in the original American grants that they are again included, and Mr. Overbeck will now have to make a separate agreement with the Sultan of Sulu for them".

      In September 1878,
      Count de Bylandt, the Dutch Minister in London, handed a note to the Permanent Under Secretary of the Foreign Office, Sir Julian Pauncefote, setting forth the legal rights of The Netherlands~~. Pressed fürther by Count de Bylandt with respect to the request for a Royal Charter by Dent and Overbeck and as to Britain's intentions concerning north-east Borneo, the
      British Foreign Secretary,
      Lord Salisbury, replied that his Government respected the rights of the Sultans of Sulu and Brunei and did not intend to do anything in derogation of those rights.
      Lord Salisbury added:
      "Probably, even if our response to Messrs. Dent and Overbeck was favourable, Her Majesty's Government would not go fürther than was justified by the precedents of Sir James Brooke at Sarawak, or of those
      chartered commercial companies which in former times it had been the policy of this country to establish in various parts of the world without any aim of territorial acquisition.
      CLEAR STATEMENT IS MADE IN UNAMBIGUOUS TERMS:
      "The object of Her Majesty's Government was not to set up any dominion, or to enter upon controversy with respect to territorial
      claims, but simply, if we saw an opportunity, to promote the development of the resources of the country under discussion"~
      THERE WAS NO INTENT TO TAKE CONTROL OR RULE OVER LANDS ONLY TO DEVELOP LAND!
      FUTHERE MORE:
      In any event, the Netherlands Governrnent was not unduly concerned by the BNBC company's activities in North Borneo since, as the Dutch Colonial Minister noted in reply to an enquiry raised by the Parliament in 1880, this was "simply a question of the establishment of a private Company"(By the British). Moreover, the Minister felt that the Dutch interests had not been affected by the grants given by Brunei and Sulu
      (grants to develop the land not to buy or control or rule over them!)
      THE BNBC OWN CHARTER STATES AS FOLLOWING:
      The BNBC's Charter stipulated a policy of respect of the local customs and internal
      affairs. Historical studies of the BNBC's administration confirm that the Residents were carefùl not to interfere in the life of the indigenous populations. Notably, judicial administration over the natives was exercised by their own chiefs and headmen and carried out by the village courts in accordance with local customs. Similarly, the collection of taxes was carried out by local chiefs and other native collectors. In any event, even if the BNBC had wanted to carry out a different strategy, it lacked both the staff and the financial resources
      to administer properly such a vast and diverse expanse of land5'.
      - the charter states the judicial administration of civilians was in the hands of the local rulers not the BNBC, only the real rulers have right to decide judicial matters and did not delegate them to the BNBC (the BNBC was there to develop land not to rule and make judgments)

      even her queen majesty clears states through her foreign secretary of north borneo at the time

FOR BNBC TO GO AGAINST THEIR QUEEN WOULD MEAN THEIR CHARTERS AND LICENSES REVOKED.... thus is was always a lease...

    In an article entitled “The Sultan of Sulu Award: Is it enforceable in the US under the New York Convention?” published in the ITA in Review [2022] Vol 4, Issue 1, arbitration specialists Gary J. Shaw and Rafael T. Boza observed:-
    “The Award against Malaysia is one of the largest awards ever issued against a state, surpassed only by the Yukos Award. It arises out of a 150-year-old contract with very ambiguous terms. It was issued in the context of a highly disputed ad hoc arbitration, in which neither the alleged arbitration clause, nor the conduct of the proceedings was accepted by the parties or the courts of the seat, Spain. The Arbitrator took actions which may be considered unreasonable, extreme, or even defiant, such as relocating the seat of arbitration, to ultimately issue a polarizing Award. Any enforcement effort, in any jurisdiction will likely be met with substantial resistance.”

      It doesn't matter what you copy paste...that's a non-binding opinion...what is binding and what matters is the judicial ruling of a court...and that court has ruled that Sabah was only leased to the British North Borneo Company which means the British and subsequently the Malaysians do not own Sabah.

Your daydream is no longer be realistic because the international courts recognized our claim on Sabah..It's now your time to pay for a having a rent and at the same time, bring back Sabah to its legal owner, the PHILIPPINES my country🇵🇭 Take note: if you are paying for the rent, means you are not the owner..     First: Sultanate of Brunei never 'gifted' Sabah to Sulu. No document existed. It's weired right? Because when the sultan of Brunei hand over Sarawak to the Brooke there was an agreement between them. Sulu just claim Northern part of Sabah as promise by Sultanate of Brunei, but there is no black and white, and the Sultanate of Brunei even made lists of agreements with the British East India company for the Sabah Territories. So the idea of North Borneo was given by the Sultan of Brunei was only a promise but never materialised, reason for it simply because Sulu did not help with the sultan of Brunei to fight against the rebels. The Sulu army run away from the battle and only come back when the battle has already won. LoL
    Second: The agreement by the British and Sultan of Sulu was made simply because the British didnt want any trouble from the so called 'Claimer' of the territories. Did you pinoy even bother to read the actual agreement? If you do, it was written in Malay not your Tagalog, so I assume it was hard for you, pinoy to understand the term and conditions which was written in malay.
    The tenure of this 'pajak'/leasing was valid until there's no stars and the moon hanging in the night sky (selagi ada bintang dan bulan). Do you know how long the tenure is? In Malay we called it 'sampai kiamat' (until the end of time! ).
    Thirdly: Madrid Protocol was sign between your ex master, the Spanish and British to renounce any claim over the territory in Borneo. Means, the Sulu Sultanate claim over sabah were dropped by the Spanish, your ultimate ruler.
    Lastly: Cobbald Commission was held by The United Nations and the majority of people of Sabah agrees to join the Federation Of Malaysia. So, shame on you, the Sabahan don't want anything to do with you.
    In conclusion :
    The only possible viable claim was from the so called 'owner' himself i. e. the heir of already non existence Sultanate of Sulu. So if one citizen owns a land outside of his country DOSEN'T MEANS the country he resides now is also the owner of his personal land overseas if he was even the 'legitimate owner'. So, why on earth this other citizen of Philippines claim it's was theirs also? Hahahah. Imagine if you neighbour have a peace of land in the United States, so everyone in you country and even your own country claim the piece of land belong to the whole nation. So, to the Philippines people, you can be poor and have some pride, but don't be poor and stupid at the same time.
    So, to my brothers and sister in the Philippines, we are ready to fight for Sabah....

    the settlers of Sabah can choose to join Malaysia., so Malaysia have full authority over the settlers or residents of Sabah., BUT THEY ( MALAYSIA) DONOT HAVE THE RIGHT TO CLAIM OWNERSHIP OVER SABAH BECAUSE IT BELONGS TO THE SULTANATE OF SULU.

      Many of the people if Sabah are stateless. The Malaysian government do not recognize them as Malaysian citizens, that is why some do not have the same rights as other Malaysian people, like rights of education.

    With all due respect, the british were very much complecit in this issue due to their decision to transfer the control of sabah to the newly created malaysian federation in 1963, the british having leased sabah from the sultanate of sulu very well know the ownership of said territory, the british make the malaysian believe that everything is ok no problem whatsoever on the issue of sabah, well, malaysia should demand an explanation from the british how did this happen that they have to pay almost $15 billion to the heirs to the sulu sultanate for occupying sabah but not owning it...✌

      Nice idea. But the thing is Malaysia continued paying the rental fees of 5300 ringgit since 1963 until 2013. That clearly means that they know it is rental. They know that it is not theirs.
