5 Tips on Writing Character Letters to Influence the Judge in a Criminal Case.

  • Reference or character letters have great potential to influence the sentencing court. Judges review these letters before the sentencing hearing. Depending on the author and content, some letters are more easily dismissed than others.
    1. Who Should be writing the letters? Family members, spouses, friends, community members. Letters from unexpected writers, including ex-employers, are always great to have.
    2. Accountability. Focus on the defendant and not the conduct. Do not tell the judge that the person is innocent and could not have committed the crime. Do not tell the judge how much time in custody or fine the defendant deserves. Watch the tone and keep the message concise.
    3. Community support is a crucial component of success. Specify specific examples of how you are willing to help the defendant.
    4. Proper grammar and punctuation (children's letters are an exception). No more than 2-3 pages. Address the court, date, and sign. Explain your relationship to the defendant.
    5. Do not write generic letters. Do not write multiple letters in the same font and format. Do not give letters to the probation, prosecution, or the court directly. Please have your attorney review the letters first.
    I wish your loved one a fair outcome at the sentencing proceedings. If you are my client, you are welcome to ask for sample letters that I've compiled over the years. These letters are always confidential and identifying information is removed.

What about when one has been broken down energy-wise and psychically-phýsically in health care for decades, then got late diagnoses and searched for adequate personal assistence but been deceived into false promises of help which has not yet been given, (only pretense, false, fake ones, for the record)then they schemed and took not only my health and life-time, but my home unlawfully, my good name, legal rights by a false guardian, where I need, was recommended and applied for a Good Man, please? He has stolen all my life's savings, the 10 000 Dollars I borrowed for health treatment abroad, as well as my tiny sick pension. I need legal support and advice, and really - help, if possible. Í think the mistreatment, abuse and torture of 40 years, particularly the latest 5,5 years, would amount to damages at the level of 5-7 million.
      I have studied enough law , but they didn't follow the law so far. Even harder for em is, the social security people seem to have got all other instances to falsely protect and help them instead of me, in order to have control over me an put me in some small institution,. this is in the opposite direction of what I want with myself and my life, as well as I was promised to have "doors opening" and be able to start living an adequate life at last, corresponding to my personality, interests, abilities, professional trainings and choice.
      The reason of their fatal acts against me, is, according to the lawyer who helped me 5%, that they found me difficult to manage and that I was too independent. This was never said to me. They have manipulated a false doctors note about "me" which is totally unlawful and quite preposterous, and can hardly have been read by a judge. Can I demand to know on what grounds the judge said I was to be put under guardianship and stolen everything? Do judges have to do as social security want, even if they are unlawful , immoral, unjust and inhumane? Evereyoone knows that guardianship is put on categories of quite different sorts than mine, and that a guardian is to be trustworthy, honest, suitable for and - accepted by the client. None pf this is the case, and he has not even met me, and not done anything at all for me.

    Thank you so much for your valuable knowledge in writing a character letter. I'm currently in the process of writing the most difficult letter of my life. My boyfriend is currently waiting to be since in federal court in my letter needs to be perfect making impact on the judge. This entire situation is HEARTBREAKING and unwarranted. Do you have any support groups for loved ones that you could recommend?

    What about a probation revocation hearing? After serving the full term but being short on court fines, went in to supposedly extend only to be arrested and told probation was revoked. Not a single violation prior, 5 years served of a 5 year probation sentence. I'm unable to afford a lawyer as I support my two kids but I have a whole community who would be willing to write letters.

      You need to hire an attorney or go to your local bar association to seek pro bono counsel. The State may not use as the sole justification for imprisonment the poverty or inability of the probationer to pay the fine and to make restitution if he has demonstrated sufficient bona fide efforts to do so. You cannot be arrested unless your failure to pay is willful. Check Bearden v. Georgia, 461 U.S. 660 (1983).

    so are character letters only applicable after conviction? Can they be submitted before trial to influence that decision?

      This is a great question! In federal court, judges are not permitted to participate in plea negotiations. So until trial or sentencing, the Judge will not know much about your criminal case and you will not have a chance to influence her decision. The United States Attorneys Office can however dismiss or negotiate cases before trial/sentencing. I often ask my clients for character letters to include in my mitigation packet to the prosecutor if my client has a shot at receiving an alternative disposition.       It will be definitely similar, however, California allows both sides to meet with the judge in chambers to discuss the case. It is often a good opportunity for your attorney to bring up good fact on your behalf to the judge. It is unlikely that the judge will accept any character letters, but your attorney can certainly mention them and even show them to the judge. Ultimate, the prosecution still holds the key to any alternatives. But you can plant a seed with the Court on your good deeds, history and characteristics, and post arrest rehabilitation. ~ Anton
