You're allowed to sell firearms out of state private party. But it has to be transferred through an FFL. This has always been legal. People buy used guns on arms list from all over the country. If the firearm is legal to be sold in the state it can be sent there to be transferred through an FFL

    • @daa3417

I can believe it, it wasn’t like that a few years ago. I listed a rifle and a handgun where I foolishly copy pasted the rest of the description after the details about the rifle to save some time. I had noted in that listing that if the seller doesn’t want to use an FFL (legal in my state) I would be happy to see a carry permit and call that good. Private sales of long guns are legal in my state but not handguns. I had several people email me within hours of putting up the listing politely telling me what I already knew. I fixed the listing and ended up selling the pistol to a relative through my local ffl but if they wanted to try and get someone that would’ve been an obvious target.

For Private in state sales The seller has to check with the state police to make sure the buyers FOID Card is valid and get an approval transaction number, then have to do the 72hr waiting period. Used to be 24hrs for long guns 72 for handguns but now it is 72hours for All guns. Soon ALL Private purchases will have to go through an FFL. Makes me sick and I hope it's struck down by the courts along with the BS Assault Weapons ban and mag capacity restrictions. The State will graciously allow us peeons to keep our scary guns and so called high capacity magazines and 50BMG rifles BUT they must be registered and cannot be transferred to anyone in state unless you die you can will it to an heir. You can sell it through an FFL Out of state if firearm is legal in that state. Large part of why I'm in process of selling my home and leaving the State. I put my effected firearms in secure storage at a gunshop in free state I'm moving to. The Gangbangers run around Chicago and the Suburbs with Switch equipped Glocks with extended magazines, Full auto AR and AK pistols and dont get charged any worse than they would with a regular firearm. Many get a damn I-Bond even with a record the size of a phonebook but us law abiding citizens are expected to fight off multiple criminals armed with full-auto firearms with full capacity mags with revolvers and double barrel shotguns.

It's said that politics make strange bedfellows. This is such a case. The Constitution does not stipulate privacy rights. They are inferred by some amendments. They have been implied by certain decisions. In the past half century, no decision more impacted and expanded privacy rights than Roe; and, also, no subsequent decision more negatively impacted and destroyed privacy rights than Dobbs.
In one fell swoop, SCOTUS enabled any sitting administration to ignore privacy rights and intrude upon the sanctity of other Constitutionally-protected rights. That's why the VA can violate HIPAA and turn over medical information to NICS. That's why something like this may be enacted.
For those, who for moral reasons, oppose choice, know that there's no way back to the privacy rights you enjoyed until Dobbs without overturning Dobbs; and while that decision ostensibly transferred decision making authority to the states, the federal government has superseding authority in areas not specified under the Tenth Amendment.
Simply put, regardless of what authorities in your state may think about gun rights, because privacy rights have been cast into File 13, the federal government or an agency thereof may interfere with something which, by rights, they ought have no authority whatsoever to do.
If you are Pro-Life, you should push for Pro-Life legislation, but legislating by the judiciary has opened a can of worms we may never be able to close again in our lifetimes.

@johnqpublic2718 Is it really that hard to show your ID? You already have it on you and that's not restricting anything unless you aren't a legal citizen (which righfully so you shouldn't be able to get one unless you become a legal citizen) and just verify that you are of the state you reside and a US citizen that can enjoy our right to bear arms. That would be kind of contradicting to say "stricter borders so we can identify the people coming in" and "ID to vote" but no ID to buy a firearm that said illegal can just buy without effort and be a potential undocumented immigrant/terrorist. Until we get both of those issues resolved I ain't risking making a sale to anyone without proper Driver's License/ State ID of some sorts.
Yes I know one is a right and the others are privileges but I don't see how just showing a ID that you already have for a private sale is restricting anything unless you are illegal...if anything it is helping us because now Anti-2A people can't use the excuse of "he bought it out of state and then shot up a place" like they try to say happens at gun shows.
