  • The plaintiffs rented a store in the defendant’s gas station, but it went out of business. The defendant is refusing to return the plaintiffs’ security deposit, so they’re suing. The defendant insists the plaintiffs left behind a broken door and vanity, so he owes nothing.

      I can’t imagine a busimess in Florida not having hurricane insurance and then whining & blaming someone else when their business is impacted by a hurricane. In real life, other people don’t have to bail you out for your recklessness.

      It’s not about money it’s about stupidity and inconvenience. Why should I spend $1200 on another phone when a $50 case will prevent it. Now I have to be inconvenienced without a phone to go get a phone that may not even be on stock. It’s common sense @1993rufus so don’t think it’s about money. It’s logic. Instead of attacking iPhone users like those of us that use Androids are better you made us sound worse. I have an Android and iPhone for personal and work. Speak for yourself

      @rufus You must not have kids, a job that relies on you or your own business. You also must not have anyone that relies on you. If you did this wouldn’t be a foreign concept. You sound like someone that doesn’t really doesn’t have money to spend or you’re using your parents money. My guess is the latter because you have too much time on your hands if you can be without your phone for an extended period of time to replace it and transfer it. You also don’t make decisions like someone that understands money or making decisions that impact many.

      Tbh, I felt like the son was a very well-mannered and upstanding young man. I think his dad was the greedy bully here , and probably pressured his son. He was even trying to tell his dad to shut up when he started having his temper tantrums. That kid is going places, as long as he leaves his dad in the dust. Defendant seemed like a really nice man. I feel sorry for him. And he probably would've given the son his deposit back if the dad wasn't such a d-bag.

    I laugh at the plaintiffs dad. The owner gave his son numerous breaks but he is too ignorant to see that. Owner was under no obligation to reduce rent at any time and yet he did. His greed showed when he upped his lawsuit trying to get more from the owner. Most businesses fail within the first year or two. Get a clue dad.

      The thing that should have happened is that the loss of the rent should have been submitted to the insurance. This would allow for the landlord to make up for lost rent, and the business owner has a couple of months to restart his business.

    I understand the Landlord because anywhere I have rented I have been responsible for keeping the area clean and safe.

    I know she thought the son saying thay "as a lady", you wouldn't want to pull up to a dark gas station and go in. However, it's kind of true. As a woman, I am always cautious of dark parking lots and stores that look empty. I'm sure men may also be cautious, but as a woman, precautions like that are practically ingrained in my instictual behaviors. On another note--I feel for the Defendant. I believe he absolutely was bullied by the Plaintiffs. They took advantage of the hurricane damage. Even after the Defendant gave them a 50 percent reduction in rent(which he didn't have to do), they tried to get more and more from him. Crazy case.

    12:20 The man is a landlord. He is in it to MAKE MONEY. He cannot afford to be giving massive discounts like this. Hurricanes happen. The repairmen cannot come immediately, they have thousands of places to repair. They did what needed to be done to make the place safe and contained and would come back later for the other work. The rent could not be reduced forever. A couple months of reduction was more than fair. The tenant should have had INSURANCE.

    I understand the defendant is upset or a little angry with them, but he has to calm down just a little ,so he can tell his side of the story , because otherwise she’s not gonna understand what he’s saying because his accent…. Anyone that rents should return property as given to them unless wear and tear over the years, Though the landlord should know they might not get their property back in the same shape they gave then renters …And renters should know that’s why they pay security upfront and they will only get it back if they don’t leave a disaster behind…And seems like the plaintive might’ve left some behind going off the pictures….     The owner had assistance from the Fed Govt and his insurance. He was out $0. The intent of the Fed Assistance was for the owners to assist their tenants to get their businesses back up and running after the weather disaster. The landlord got reimbursed by the Gov't for the rent and pocketed it. If the repairs took longer b/c of the hurricane . . . then he should have passed that savings on to the tenant.

    The saddest part of all of this is that the defendant may never give a tenant a compassionate break again. They messed it for anyone following them. The defendant was probably thinking that something was better than nothing and that he could possibly write it off.

    So the landlord place gets ruined by this storm and the repairs take what they take but in the mean time the tenant is required to pay full rent?! I don't think that's right. The landlord has a duty to provide a completely usable space as originally advertised otherwise the tenant isn't getting what he's paying for.

    I think he meant he was already giving him a deduction on the Jan & feb rent in the new month to month lease and that was less than the previously year. Sorry judge I think you got it wrong

    I lived in Florida for many years and during hurricanes, people would have tarps on their roofs for over a year waiting to be repaired. Honestly, they were lucky to get any sort of repair done within a month. Hopefully the names of these morons got out there and other retail landlords will know not to rent to them.

    Judge talk so much she miss the facts. She had read where the guy said he already gave them a cut on rent and he wouldn't continue to do so. Then she acts like on the letter they had that's not what he meant. He was clear his whole testimony and they shouldn't have gotten a dime back.

      It’s like a mortgage. It’s still due even though you can’t live in it due to hurricane damage. The landlord made the emergency repairs and was working on the rest. South Florida life!!!!!

      When you have greedy little thugs trying to jip you out of money they don't deserve, I would be super annoyed as well. The Plaintiff wasn't insured properly to cover losses that are inevitable. Like say...hurricanes in Florida. They had the nerve to want to put that on the landlord because the building didn't get fixed fast enough after a major hurricane⁉️ They signed a lease where they were getting a huge break on rent until the start of the year. Then he still took a couple hundred off, but the Plaintiff wants to insist on the rent break to continue. That's not how it works in the real world son.

    If a hurricane destroyed their business, till the repairs wee made no rent should of been charged. And Business should close till then. Cleaning up the old roof is not the renters job it was the contractors, and if the D3efendant let the contracctyor out of the work then he has to pay for it not the renter. This was not maintenance.

      Nope. Should have had renter's insurance, at least. They didn't even have enough sense-- or decent business plan-- to insure the contents. No wonder they failed.

    The defendant is acting like he’s doing a favor by reducing the rent. That place was destroyed by the hurricane and inoperable- he shouldn’t have gotten any rent at all until the place comes in operation. Plaintiffs made a big mistake by agreeing to pay half , and then full for the rest of the months.
    For the defendant- looks like he has a big family. If the plaintiffs leave , hire a family member to run the place .

    The judge always says “ if it needs to be done by a certain date and time, than put it in the contract “ yet they did and she still doesn’t care 🤦‍♀️ they should of gotten back February too she was wrong and bias

    The plaintiff did not cause any damage. That can be blamed on a hurricane & the contractors that were hired should have cleared the debris. Ultimately & unfortunately this poor guy lost his business.

      Too bad the plaintiff didn't have the proper insurance, or any insurance....... Especially with that gas station being in Florida of all places. Some of that debris outside was from the contractors.
