    It never surprises me when incompetent people(the defendants) show up in court with ZERO evidence to defend themselves, then tell the Plaintiff to take them to court, hoping that this prominent doctor would just drop it. They were wrong...
    And I wish that judge Milian could have awarded the Plaintiff the rental fees.
    Let the defendants go after the incompetent attendant that caused the damage & deliberately failed to report it to save his own ass.

    The day after I picked my Audi up from a parking garage I noticed the passenger side dented and scratched . I had picked my car up at night, so I didn’t even notice the damage until the next morning.
    I couldn’t prove that it happened at the garage, their cameras didn’t work, but the owner volunteered to pay the total bill, over $3500.00 and gave us a nice gift card to PF Changs. He owned that restaurant.

    The garage (just like at large dealerships when you take car for service) will have a carbon copy drawing of the car and will check off on the drawing any areas with scratches or dents at the time the car is dropped off. Then they give a copy to the customer. This garage should be doing that EACH DAY.

      It’s NYC. It’s most likely a garage within a few blocks of his high-rise or brownstone. His car is being parked in a section of the garage for people who take out their cars daily, which means there’s a lot of shuffling as cars go in and out. It’s not a self-service parking garage where every car has its own space.

      In NYC, I would strongly advise against it without a private garage. We have to parallel park 90% of the time (people also drive like complete a**holes) so expect rear bumper dings and dents on the regular. Also, most of the private parking lots are run by valets, so you have zero control over who moves your car to a spot once you hand over the keys. It's a huge risk to have anything too expensive in NYC! I drive a beat up Corolla for that exact reason- I come back to a new scratch weekly- after a while you just give up.

      If you drive a luxury car, you take a 360 video of your car before you leave it in anyone else’s hands. Otherwise, it’s very very difficult to prove a valet or garage caused minor damage. The plaintiff is lucky that the garage admits to the things they told him.

    I kind of agree that he should have been recording EVERY interaction after the first scratches and blow off. I usually dislike people that whip out their phones, but after the first time, better to be precautious. The parking attendants clearly seem to be targeting his car because it is a more prestigious, luxury model. I wouldn't bring a moped to the Defendant's garage. Also, the Defendant's witness is full of cr2p. No Maserati owner is going to be shown a scratch/dent that appeared on their car and say, "No problem, I need to go out(so I don't care)".

    Judge--Verdict for the plaintiff because she thinks cardiologists are inherently better than parking lot attendants. Neither side had any evidence. Frankly, the fact that the plaintiff tried to sue for four months' refund AND the fact that he kept parking there despite constant damage to his car lends a bit of a ring of truth to the defendant's claim that all of this was the plaintiff being upset over the increase in parking fees. Change their professions, and I bet she'd be up ther pontificating about how maybe he's just a lousy driver and how dare he come to court without evidence that the defendant was responsible for the damage.

    I never understand why the judge laughs when people sue for emotional damages. He should be entitled to something for having to fix his car multiple times, some of which seemed intentional. Theres nothing stopping them from continuing to do this. They face barely any penalty for ruining a nice car they’ll never be able to afford.

      Emotional damage would imply that his emotional state has had a meaningful impact on his quality of life. Being annoyed is different from life-altering trauma. He obviously wasn’t emotionally damaged enough to stop parking his car there. If you could sue people for annoying you, we’d all be suing each other.

      Considering he complained immediately all three times his car was damaged and had it repaired right after the damage was brought forward I would lean more towards his word being more credible especially since he makes well into six figures per year and drives a $100k car so he has less reason to lie than the defendant.

    Lemme tell you- there are so many complaints where I live of landscaping workers blowing debris, scratching, and bumping against our nice vehicles. It definitely feels like jealousy as we have video footage of them doing it and they still do it knowing they’ve been warned. One of the defendants looks just like our community’s landscaping contractor.

    I used to work for a parking company to record the damage we used to camera of 360 angle of the where you see the to back once you receive the customer car you literally point out the damage for the camera to see in front of the customer it takes literally 5 seconds on the keys they have tags where you mark the camera timeframe how many marks on car and what type of mark honestly the company parking vehicle don’t want to be responsible because the drivers are (not All) careless because it’s not their vehicle

    That defendant manager is really bad at his job. No evidence,just believes what his attendants tell him etc. But the plaintiff tho....why would u keep parking there when u constantly have ur car fucked up? "Its convenience" ok sure,but when u see ur car fucked up 4,5,6 times again and again when does that "convenience" become a liability? And then u wanna sue them for 4 months of ur parking cause of how u felt going to pick up ur car and maybe see damage? That was ur choice to keep going there!
