He owned that restaurant.

The garage (just like at large dealerships when you take car for service) will have a carbon copy drawing of the car and will check off on the drawing any areas with scratches or dents at the time the car is dropped off. Then they give a copy to the customer. This garage should be doing that EACH DAY.
It’s NYC. It’s most likely a garage within a few blocks of his high-rise or brownstone. His car is being parked in a section of the garage for people who take out their cars daily, which means there’s a lot of shuffling as cars go in and out. It’s not a self-service parking garage where every car has its own space.

In NYC, I would strongly advise against it without a private garage. We have to parallel park 90% of the time (people also drive like complete a**holes) so expect rear bumper dings and dents on the regular. Also, most of the private parking lots are run by valets, so you have zero control over who moves your car to a spot once you hand over the keys. It's a huge risk to have anything too expensive in NYC! I drive a beat up Corolla for that exact reason- I come back to a new scratch weekly- after a while you just give up.

The parking attendants clearly seem to be targeting his car because it is a more prestigious, luxury model. I wouldn't bring a moped to the Defendant's garage. Also, the Defendant's witness is full of cr2p. No Maserati owner is going to be shown a scratch/dent that appeared on their car and say, "No problem, I need to go out(so I don't care)".

Judge--Verdict for the plaintiff because she thinks cardiologists are inherently better than parking lot attendants. Neither side had any evidence. Frankly, the fact that the plaintiff tried to sue for four months' refund AND the fact that he kept parking there despite constant damage to his car lends a bit of a ring of truth to the defendant's claim that all of this was the plaintiff being upset over the increase in parking fees. Change their professions, and I bet she'd be up ther pontificating about how maybe he's just a lousy driver and how dare he come to court without evidence that the defendant was responsible for the damage.
I never understand why the judge laughs when people sue for emotional damages. He should be entitled to something for having to fix his car multiple times, some of which seemed intentional. Theres nothing stopping them from continuing to do this. They face barely any penalty for ruining a nice car they’ll never be able to afford.
Emotional damage would imply that his emotional state has had a meaningful impact on his quality of life. Being annoyed is different from life-altering trauma. He obviously wasn’t emotionally damaged enough to stop parking his car there. If you could sue people for annoying you, we’d all be suing each other.
