  • Convicted murderer, Oscar Pistorius is back in court today for a bail hearing. A date will also be set for new sentencing procedures for his murder conviction. Last week, the Supreme Court of Appeal overturned an earlier ruling of culpable homicide. Pistorius has been under house arrest at his uncle's home in Pretoria since October.

Mr. Pistorius, If you believed you were in a life threatening situation why did you stand in front of the toilet door?

10,000 SA Rand Bail is about £430,very odd Bail amount for a convicted wealthy murderer.Where are they attaching the electronic monitor ? Surely not on the ankles as normal, maybe OP just leaves his monitor on a spare artificial limb in his uncles house .

+Paul Bentley No, have no fear, they attach the monitor to his wrist and I too was surprised at the low amount of bail.

At 12:10 the judge says that being in the house for the whole day would amount to a punishment on its own. Yes!! He's a convicted murderer. Should he not be punished?!

Oscar could start by selling that obviously expensive watch he's wearing and adding the proceeds to his bail amount. I don't believe he has no money;' it's simply been moved into the accounts of other family members. Someone is obviously paying Barry Roux. I don't dislike Roux - he's just doing his job, but he doesn't strike me as the kind of philanthropist who is doing all of this extra work pro-bono! I mean, he's not exactly working in an area of the law that includes advocating rights for the underprivileged.

Masipa version 2. A new, equally incompetent judge.

+Ncom Ncom Mrs. Masipa was absolutely correct and Mr. Roux is doing his best.

+Susanne Müller The 5 Appeal Court judges declared Masipa's verdict incorrect. What planet are you on?

+Susanne Müller - have you been actively listening and keeping up with developments? What did Justice Leach (SCA x 5 judges) declare in his rationale last week? Does the term "fundamentally flawed" ring any bells? Sometimes you could draw you people a picture and still you would fail to conceive.

+ Müller - hell will freeze over and the bewildered will suddenly see the light before that happens - ain't ever no escapin' where he's agoin'. Just a matter of time. Something Reeva no longer has....

+Cosmic Kitten - it depends on which area of the world you are from; your culture and outlook; social status etc. These judges might be 'called' judge, but they are not of the quality and comprehension one has come to expect in the developed world i.e. if they were a judge in London say, they would have to be of a higher calibre. The other part of the coin is that, this is a high profile case - many are ambitious (to their own level of incompetence one might add) and sadly this is the case here. Both seem to enjoy the limelight, performing and appearing self-important in front of the worlds cameras - and give some people a little power and it goes to their head. Sadly again the case here.

+Ncom Ncom well the Supremes were amazing in their arguments and questions I so enjoyed that engagement they had w/the law and questions of law, it was truly awesome to watch. And that coming from an American trial watcher in both local, appeal and Supreme level. So > w/that said its confusing to see the Judges at this level make these rulings.

+Cosmic Kitten - absolutely (some) of the SCA judges were impressive, actually they were effectual which is why people were ultra impressed. We can no longer expect a high level of effectiveness as the norm. And of course, let's not forget that Nel is a man to respect. So we can't generalise this complex question to be sure. But as to the other 2 lower court judges (apparent clones of each other's implacable stupidity) I do think it needs a deep consideration of historical and sociological issues. I think many would say they are simply not up to the job - but in a Country emerging from the apart era and seeking to integrate all factions of society and develop greater commitment to equality legislation - I fear we are inevitably going to make mistakes along the way as we help some people along the way...

Ncom Ncom Yes I see, America was the same way when we separated from British rule. It will get better as time goes along. Took us 200 years ;-)

+Cosmic Kitten - another key point for consideration...I have always detected, ever so slightly and remotely lingering around, a strong sense that both lower court judges were rather intimidated by Nel and he got up their nose somewhat. This is what happens when you pitch competence against incompetence. Look at the first rial, it was never clearer to some that Masipa was reacting to Nel on some level (a smouldering contempt lingering) while to the oily Roux (all smiles and charm) she responded quite differently. She would frequently chastise Nel. She would frequently laugh with Roux. Judges are only human beings, no matter what they tell you and humanistic mechanisms I fear influenced both judges, and their practice on some level.
