When the phone recording of Nicolae Miu during the Apple River tragedy in Wisconsin surfaced, many were quick to view his actions as self-defense. However, police had yet to release all footage needed to draw a final conclusion... Until now.
This video shows no physical harm or injury. Our content is made with education as the main objective.
We worked night and day to get this video out to you guys.

Why is it that 9 times out of 10 the emergency responder sounds like they've NEVER had a conversation before?
I was thinking that same thing. The one lady told them exactly what was happening and she dispatcher says “stop stop stop. What’s happening?” Like they just fuggen told you if you stfu.
It has to be some kind of distraction tactic. Keep the person from going into shock and to get the most information possible.
@@theworldsonheroinwe are trained to stay as mellow last we can and to try and get the caller to focus/de-escalate if possible to get as much info as possible…if they are using EMD/EPD software, they have to read particular questions exactly and cannot move on without an answer most times. Sometimes when the callers blurt it all out, it is hard to understand or get clarification right away so they can get basics out to the responders then Get more info going forward.
@@theworldsonheroin i thought that too. But its kinda annoying when a major event is happening to some people, call for help, and person sounds like they have their feet up enjoying a bag of chips as they caually get the info. I dont stick around though. Got stuff to do, you got the address.
@@KnottyNerd This seems rather inefficient, I understand they want to have a basic template of information build up from those questions and put it in the system - which is why she probably was like "stop stop - what's happening". But in stressful/panic situations you don't wanna feel like it's a questionnaire. I personally only every did callcenter work for an internet company, they had a script. I never followed it - it usually ended up in sending a technician over lol. Instead I just listened to that what was being said - answer within my knowledge. And I think it's a case within this kind of work as well - the people that call have a story to tell - listen and extract information necessary - take action. I don't think being forced to read particular questions and not being able to move on from them increases accurate response time. For example: people will tell a story in a different order: some may start with stating the location, others with what is happening etc.. It's very hard to automate such a process as every human responds differently.
Probably not an important point, but golly whoever described this guy as "about 30" needs to get glasses. Holy shit.

Y'all folks don't seem to understand that this is exactly what they should do.
The last thing you want a dispatcher to do is go "OH MY GOD! WHAT HAPPENED?!?! ARE THEY OK?!?!?"
They're specifically trained to stay as calm as possible and not show emotion, because showing emotions mirroring or even remotely similar to that of the caller, you only make it worse.

Edit: hi yes it is me. It's clear I ruffled some feathers and I'm sure it's been buried, but I did admit to having watched the first minute or two of the video, scrolled down to see a bunch of goobers commenting on the dispatcher's conduct, and made my comment.
I will admit, not the best way to handle it on the dispatcher's end, having listened to the specific part you guys are referring to, but I still stick with what I said for 99% of scenarios.

@bobcreature2127 I think what he is referring to is the fact that they've already said what happened. You should start getting location information or ask if the person is in a safe place at the moment. I understand if the person did not catch what they were saying, which would explain the response. But if you hear someone's intestines are coming out of someone's body, you should probably start asking the questions to get someone out there ASAP.
Just my thoughts on what everyone's thoughts are. I understand that they are supposed to be calm and collected, which I agree is good, but sometimes telling someone to "Stop. What is happening," when they've just told you all you really need to know to get someone out there, it seems like they are not being very effective.
Hope this makes sense. Im not trying to harp on you at all, just explaining how I see it.
@@bobcreature2127 as someone who works in alarm dispatch (not as an operator, but I do listen in on calls) they were probably trying to work their equipment and needed the person to stop and repeat what happened to be able to properly document it. So yes, they did exactly what they were supposed to.

Teens are guilty of antagonizing him, what he did was absolutely an overreaction but the teens aren’t innocent either.
The teens most definitely were in the wrong. However murdering a bunch of people over getting bullied is not what you do.

@@xXsharpiescarsXxThey attacked him, pushed him in the water and were behaving aggressively. He was surrounded and believed he was in danger. What happened is sad but I’ve seen the whole video and I can clearly see why he thought his life was in danger.
This video is all over the place with it's facts. I've seen a lot of evidence in this case from both sides. Here's what happened. Nikolai was looking for his friends phone in the river, as he did this, a group of teens came floating towards him in the direction he was wading and looking in the water. Nikolai continued looking for the phone, using snorkeling gear and a mask. Some of the teens said he was trying to look at the girls underwater. When accused of this he said no, he's looking for a phone. They were uncooperative and accusatory which made him suspicious. He started to ask to see their phones. Some of the group said he wants explicit photos of the girls now. The teens were amping everything up and creating a massive story about him and his behaviour. Nikolai wasn't explaining himself very well and they were mocking and jeering at him. He became defensive and confused by their behaviour and was confronted by a female who poked at him and screamed in his face. He pushed her away and that's when some of the boys came at him and he was pushed under the water. There were two knives on the teens and at least one was presented. Nikolai surrounded and sensing escalation brought out his own knife and began slashing at anyone who approached him from the group. In the end he was guilty of using unnecessary deadly force which was true. He took it too far but it was at least somewhat understandable given the situation. Both parties are guilty and often that is the case. It's not always black and white, one side good one side bad. Unfortunately the teen who was the youngest of the group at 17 years old, died and this was unjustifiable to everyone.
However this video, while trying to appear balanced, is doing exactly what the twenty somethings were doing to Nikolai, insulting and bullying. Making him look like the only culprit.
Edit: one knife belonging to the group was not brought into the river but was left onshore. It was debated whether another knife was on one of the twenty somethings. It was not disproven or proven except by Nikolai's own assertion. He lied about many things, particularly his own knife being used which was to his detriment. Don't lie folks.
I agree with nearly all of that except the teens having knives. Otherwise, nice summary.

The teens were also drunk, they had been drinking all day while on the river. Which none of them were of legal age to do so.

If 13 young ADULTS surrounded me in a river while I'm looking for a lost phone, putting their hands on me, calling me sick shit, WHILE assaulting me...this video is a prime example why you get a lawyer before you talk to investigators, the recording shows these ADULTS singled out an older male and FAAFO. The recording speaks for itself and the investigators are not honorable, getting the guy to lie himself into prison while, the video gives more accurate details than any of the lying people on the scene, this showcases how fucked up our justice system is, cause this would have never happened if the young ADULTS had acted like adults and helped the man find his phone...bet anyone $1k that one of the people in the group found the phone and was hiding it the whole time and only threw it in the river again, after they realized it hurt their story. We know there was a missing phone, it's in evidence, we know there was other weapons on the scene, we know the were surrounding him and assaulting him. 13 to 1 seems like the kind of odds where you fear for your life and not so much whether people who attack you live... This guy is the Romanian Kyle Rittenhouse.
I don't think that's unpopular bc a lot of people think that about the original group of boys (before Maddy comes to tells N to leave) but I gotta say I agree yea, he should have just approached them honestly and said he was trying to find his phone if he actually was... not refused to answer and stood there glaring. But yea in the video he could have walked away multiple times. But he instead punched and stabbed people which 🚩🚩🚩

I wonder, though, if that type of reception might disarm and calm the victim or witness calling? Probably not if you’ve just seen someone stabbed, but I could see myself frantic, calling, getting the typical customer service “how may I help you?” and sighing a breathe, then better explaining the emergency.

The lady that answered the 911 call needs to be fired. She delayed proper treatment by continually telling the called to stop talking. What a joke.
I only saw the call of the lady at 3:05 but it only showed her asking once. did I miss the full clip where she kept interrupting?
At 2:46 I noticed the male dispatcher say that help was already on the way, so I guess even if the female dispatcher wanted to delay treatment, it was impossible for her to actually delay it.
They had sent units within about 8seconds of the phone call commencing
They dispatch as soon as they get a location. She didn't really delay anything. The only reason they do that is because these 911 calls are key evidence and very likely to be used in court. They try to get information as clearly and as orderly as possible. It's so the defense won't be able to poke holes in the recording. Example, if someone is speed talking and not forming complete sentences (panicking), the defense will try to say this person was in a state of shock. They'll try to have it deemed inadmissible. The 911 dispatch knows it's not easy in such a situation. They still have to try. No one wants to see someone get off lightly because of technicalities.

thats her job. Her job is to stay calm under all circumstances and to hear what happened and there was already help arriving.
I'm not defending his actions, but had the group of teens not ganged up on and bullied him, none of this would have happened.

@@PunchBuggyDreamslots of people bring knives onto the river. We fish, and carry a knife to cut our lines if they are stuck, or to cut ropes to tie our rafts together. Grown adults carrying a knife is neither unusual or a crime.
I also saw an interview with his family that talked about who he was and where he came from.. certainly shines a different light on the situation.. and I think that context matters. I wish we had heard about it in the trial.
I’m deeply sorry for what happened to those kids; but they started it, escalated it, and ended up with the worst results possible. And that man paid the price of his freedom for it.

Funny how they blurred out the face of the lady who said she was punched in the face, only to have shown her unblurred minutes earlier in the video. SMH.
If I’m correct it’s bc she’s underage. Anyone who is underage on body cam is normally blurred out when it’s released to the public whereas the video of the incident was on a personal phone of another minor. That’s the only thing I can think of as to why she was blurred on body cam but not in the evidence video.

That witness wasn't necessary "lying". Normally the human perception gets distorted when under stress and trauma. The claim "he wore a hat" might've been the result of his memories playing tricks on him under pressure
I totally get it. I was in a minor crash where my tire blew out on a rainy day and my car got totaled. I probably only banged my head a little but not too hard. Never even bruised. My car in the fast lane veered to the left when the tire blew for a split second before going right and crashing. But when cops came I said my car veered left, and for some reason I believed I hit the barrier in the median (I did not), before going off to the right and crashing. I did not realize until a couple hours after when I actually thought about it and anxiously worried if cops saw me as a liar
Edit to add: I knew I didn’t hit the barrier. But something in my mind must’ve flipped when I got bombarded with questions like “did you hit the barrier?” and it was like I totally forgot I didn’t hit it and my mind instantly believed I did

He started the altercation. He went up to the kids first, they told him to leave and he decided to hit a innocent woman and then the group went to defend each other.

What I believe happened is the teens decided to pick on this man because they thought he was using the snorkel to look at the girls from under the water when in reality he was looking for a phone. He thought the teens stole the phone and the teens thought he was being creepy there was a misunderstanding and both sides got violent. Thats when the man enraged went on a violent rampage.
How do you just think someone is creepy alone in the river …totally alone. The teens were disgusting human beings and IF they had they just got in their tubes and moved down river …nothing would have happened. Minor football players and one old guy.

She starts out saying very flattering things about a coworker, it's not until the last moments of the interview when her tone changes and she makes comments that suggest she feels betrayed that he didn't admit he had a knife and stabbed people.
Her head movements and voice are the keys to see she is struggling to reconcile the man she knows and the man in the video she probably either saw or heard about.
So she definitely would not have been a good defence witness. Her testimony would be the same as the neighbour who had no idea their neighbour was a killer.
He really effed himself by going to toss the weapon after the fact, putting on clothes to make himself less recognizable, tried to avoid police, pretending that he did not know what went on during the altercation, and lying to police like when he said he took the knife he used from one of the teens. All those things scream someone who knew they did something wrong.
Imagine if HE had called 911, gotten out of the water, called and told them everything, and waited until the police and EMTs showed up. I don't think he would've gotten life.

Yeah under the law that doesn't matter when deciding whether he committed a crime, it only matters when determining the penalty.
@@berenonehand Normally I would agree, but this particular trial was more or less about whether or not he acted in self defense. We all know he is the one that stabbed them, but then the question became did he legitimately feel he needed to defend himself. Those actions he took after the fact most likely led the jury to believe that he knew he was in the wrong.

This is an actual technical point of jurisprudence, that was probably included in the jury instructions, not that it ended up mattering.
The number one thing wrong with social media? People declaring a conclusion with absolute 100% certainty, while having about 2% of the evidence.

Just imagine a group of teens accusing you of being a predator and trying to look at girls under the water. What if you really were just looking for your cell phone? Then a woman comes yelling in your face while you’re under distress and being falsely accused of something very serious, she won’t leave you alone….you wouldn’t even think about physical force? Then before you know it, you come up from the water and there are now 13 people surrounding you and you know you’re alone. You’re not swinging a weapon at everyone? I sure am.

@@ShubhamSingh-u7i a 250 Lb man in his 50s is not chasing around and moving faster than teenagers. They were all attacking him for 4 of them to end up stabbed. Regardless their lies were hiding plenty, so we don’t know what happened even if it makes the most sense. That being said, if you fear for your safety which anybody would when outnumbered 13:1, I don’t believe there’s any such thing as “excessive force” at that point. What are you supposed to wait until it’s too late to be able to protect yourself? Excessive force would be chasing them if they are clearly trying to get away or nobody is touching you. Obviously that’s not the case.

We know why he lied about everything he lied about. If he was asking the girls for nudes or doing anything creepy/violent, they all would’ve had that in their story. So for them to lie it would only make sense that they were in the wrong. They fucked around and found out.
If this guy didn't lie in his interrogation he would have had a legitimate self defense case.

When accused of this he said no, he's looking for a phone. They were uncooperative and accusatory which made him suspicious. He started to ask to see their phones. Some of the group said he wants explicit photos of the girls now. The teens were amping everything up and creating a massive story about him and his behaviour. Nikolai wasn't explaining himself very well and they were mocking and jeering at him. He became defensive and confused by their behaviour and was confronted by a female who poked at him and screamed in his face. He pushed her away and that's when some of the boys came at him and he was pushed under the water. There were two knives on the teens and at least one was presented. Nikolai surrounded and sensing escalation brought out his own knife and began slashing at anyone who approached him from the group. In the end he was guilty of using unnecessary deadly force which was true. He took it too far but it was at least somewhat understandable given the situation. Both parties are guilty and often that is the case. It's not always black and white, one side good one side bad. Unfortunately the teen who was the youngest of the group at 17 years old, died and this was unjustifiable to everyone.
However this video, while trying to appear balanced, is doing exactly what the twenty somethings were doing to Nikolai, insulting and bullying. Making him look like the only culprit.

In another uncut video, the group of teenagers initially appeared unsettled (the man was in the wrong) but soon realized they had him on film/outnumbered him and could humiliate him. They began calling out to him, surrounded him, and pushed him around in the water as he tumbled and rolled. They continued to push him down and ran in to slap him while laughing. The man eventually stood up, but this is the result. Lesson, don't get carried away. Even if someone was initially wrong, it doesn't mean you should humiliate them for fun.

As some people explained in comments that it's not that unreasonable. If the caller is in shock and starts jumping around with his/her statements it is not admissible in court if the lawyers poke at it.
Also the the operator wanted to know what's the PRESENT situation to know what's there to be done by the police, not hear a story so she can actually do her job, THEN go into details as things calm down.
What's immediately important once they know the crime:
"Is the attacker still present?, Is he on the loose? What's happening now with the victims?, (aka do we have to call an ambulance) Where are you? (duh) Describe the attacker (if police has to search or shoot down someone, to not mistake a disturbed victim with a raging lunatic)" Etc etc.
And not tell a whole story about the altercation. They need the info directly required to do their job then listen to the incrimaning details about what happened before the call.

To keep them on the line as long as possible at least until help reaches them. Also to make sure they get all the facts they can as possible, as well as sometimes the audio in these calls is shitty so you gotta ask things over, it sounds clearer when listening to the recordings than it doesn when actually on call (a friend of mine works for a call center taking phone calls and this happens often) so you might hear the first time "I got stuck in a car" in a panicked voice, but when repeating themselves you can actually hear "I got stabbed by my car" so you know to actually send in paramedics, then as they're talking and explaining over you're making sure they won't lose consciousness but they can also add in that "my former coworker ___ stabbed me when I got off work" so there are already some details for an investigation

Nikolai was being filmed looking under the tubes for the phone that was lost. Why would they film him doing that unless they were going to start something with him? Then they antagonised him and stole his goggles. He did lie about bringing the knife out because he was scared he would incriminate himself as the protagonist which he clearly wasn't. He was just looking for the phone and the group of teens assumed he was perving, then made up a story to make themselves look innocent.

He may have anxiety, ptsd, & felt a certain way looking up seeing all these yapping/yelling people calling him names, etc. For God’s sake, a person can’t even as much as look for something they dropped in a certain area (which it usually does stay exactly where you dropped it.) at the springs, because I know personally, glasses, 🔑’s, etc, will stay in said place. He was despicable for lashing out & using a 🔪 on these people. Horrific situation. But you have to look/see just how /why/when it began to occur to begin with? And if these young people weren’t drinking? That’s actually worse for their character.. because it’s proving they were being complete JERKS to a man who literally stated to them, that he was just looking for something.. Also if they felt SO uncomfortable 🙄with one man, (even though they had young men in their group?) WHY didn’t they just quietly move their rafts, or selves up steam.. Apple River.. ? I know that’s EXACTLY what myself & my girlfriends (in a group of like 5-7) did whilst at the pool, Wet-N-Wild (I miss that place 😢) lol Springs, Beaches, clubs, etc. Common sense isn’t very common these days amongst the younger gen. Not all of them, by far, just a lot that I notice. We avoided conflict.., it seems they seek it. 🤔 Sry I wrote a book. I was just venting, thinking back, etc. have a blessed weekend. ✌️
This is not 1st degree murder. This is 2nd degree or manslaughter. They just throw 1st degree around a lot when it is not warranted. 1st degree is when you plan and contemplate a murder. Killing in the heat of a situation is 2nd degree.
That's exactly what I was thinking. He's an older guy clearly looking for a phone in an area that he thought it may have been dropped, and nobody was near. The teens looked to be going after him, not the other way around, and he asked to see their phones because he thought someone had picked his up. It really was self-defense, but he went too far in the heat of the attack... I think once he realized that, he tried to clear/help himself by saying they had a knife also.

In Wisconsin, first degree intentional homicide is when you cause the death of someone with intent to kill; there is no specification requiring you to plan it beforehand. Based on the stab wounds he inflicted, I think it is fair to say he was aiming to kill.

If he were honest and up front about what actually happened, and hadn't lied to police, he probably would have been given at least a lighter sentence. He used too much force, but he was the initial victim. Pretending the knife wasn't his made him look even more guilty than he was.

I remember watching the full cell phone footage when it first surfaced. What was frustrating to me was that the teens were asking him what he was doing. He'd been lurking around the water (which we now know was because he was apparently looking for that cell phone). The teens didn't know what he was doing, and just saw some older man lingering around their group in the water, acting generally strange. He never said a word.
I feel like if he just said "Hello! I am looking for a cell phone my group lost" everything would have been copacetic. As the teens got more and more irritated, he stayed silent the entire time with a unsettling look on his face. Even as things got heated. The fact that he left immediately and lied to the police and his friend/family is the most damning thing in my mind. This implies he knew he was in the wrong and in deep trouble. Mens rea, guilty mind.
I would have been bothered by a strange man lurking about and acting suspicious too. The teens were shitheads and initially escalated things, but that doesn't give anyone the right to slice open child's stomach and put three more kids in the hospital. Even if he felt using the knife was justified, use the knife as a warning. Display the knife, say "Stay back! I have a knife!", etc. Nobody in their right mind would fuck with a strange man with a knife. There's so many ways this could have been avoided.

I didn't realize how ridiculously biased this video was until I saw the actual video on TH-cam. There's no logical reason for this video not to show the full video because it's extremely damning against the kids... there are approx 5 kids pushing him into the water and slapping him in the face continuously before he pulls out the knife. And the first kid gets stabbed as he shoved the guy in the water (it's difficult to see how the others got stabbed, the one girl comes at him from the left and next thing you know she's stabbed (this is the moment where they start saying you hit a girl, before realizing she was stabbed). When you see that video, self defense becomes even more apparent.
It's sad because English isn't this guys first language and it's likely what made the difference and obviously he should have just owned to everything and took the self defense position because it was. There was a cluster of them surrounding him and they were coming at him and smacking him in the face and pushing him in the water... it's looks horrible what they were doing to him. This is 100% self defense. And the guy was just looking for a phone and thought they may have had the phone which is why he asks to see their phones which got turned into him wanting to see their phones for nude pictures. There is no evidence that this guy did anything perverted... not even slightly. The guy is a 54 year old mechanical engineer who's never been in trouble in his life.

This video is all over the place with it's facts. I've seen a lot of evidence in this case from both sides. Here's what happened. Nikolai was looking for his friends phone in the river, as he did this, a group of teens came floating towards him in the direction he was wading and looking in the water. Nikolai continued looking for the phone, using snorkeling gear and a mask. Some of the teens said he was trying to look at the girls underwater. When accused of this he said no, he's looking for a phone. They were uncooperative and accusatory which made him suspicious. He started to ask to see their phones. Some of the group said he wants explicit photos of the girls now. The teens were amping everything up and creating a massive story about him and his behaviour. Nikolai wasn't explaining himself very well and they were mocking and jeering at him. He became defensive and confused by their behaviour and was confronted by a female who poked at him and screamed in his face. He pushed her away and that's when some of the boys came at him and he was pushed under the water. There were two knives on the teens and at least one was presented. Nikolai surrounded and sensing escalation brought out his own knife and began slashing at anyone who approached him from the group. In the end he was guilty of using unnecessary deadly force which was true. He took it too far but it was at least somewhat understandable given the situation. Both parties are guilty and often that is the case. It's not always black and white, one side good one side bad. Unfortunately the teen who was the youngest of the group at 17 years old, died and this was unjustifiable to everyone.
However this video, while trying to appear balanced, is doing exactly what the twenty somethings were doing to Nikolai, insulting and bullying. Making him look like the only culprit.
If he told the truth he could have gotten a lessen sentence on self defense. No idiot just walks up to a group of teens and asks for pictures... even creeps. It's true he was looking for a phone and it did become self defense 13 on 1.

It started with misinformation right from the start. The kids claimed he was trying to look at the girls under the water with his snorkel. He claimed he was helping his friend look for a lost cell phone. They kept harassing and attacking him about it. He was surrounded and couldn't get away from the situation. They could have left any time they wanted. He couldn't. I'm kind of astounded that he got 20 years for defending himself. They should have called the cops if they honestly thought he was doing something wrong, instead of attacking him.
To be honest, I think a lot of that stacked due to his actions after the crime (evading police and trying to flee). There are so many ways this could have gone, but he took the worst route possible while in a panick to avoid accountability, it seems.

Juries and judges are only human and if things were "clear cut" we wouldn't need a jury or a judge to...well judge. The laws may be clear cut but applying them rarely is.

The blonde girl that was punched explained perfectly on what he looked like. a lot of the 911 operators need to get fired on the spot. people were obviously scared and I bet they pushed all of they're words out. most people freeze up and don't know what to do.
