The sad part is, that the settlements also come from taxpayer money, and not from the salaries or pensions of those police officers who broke the laws they should be enforcing.       ​@tbls0 Qualified Immunity is very hard to remove. They have to prove the officer KNOWINGLY violated their rights. In order for that occur, there either has to be video evidence that the officer was aware that he or she was violating these rights or something that is known as legal precedence. This allows the courts to tell the officer that since it has been upheld in a court before it can be upheld now.

    Former professional window tinter here. I have that same meter it works perfectly fine at that window height and that window was absolutely not measuring 2%. Glass must be cleaned on both sides prior to using the meter , and you should always do the test minimum 2 times.

How do we know that, also idk if his backup could see through the window, all I know is the guy got pulled over and had window tint (obviously neither of us know just how dark or if it could be seen through) but it has been ruled an officer can have you roll down tinted windows, also if the officer wants they can ask you to step out of the vehicle, so idk why you wouldn't roll the windows down, it doesn't effect your safety at all.

      This is not illegal, that’s part of the problem. People assuming what the officer did being illegal are also part of the problem.
      If you want this crap to be illegal we need laws to narrow down LEO powers from the states side of things. So far law enforcement has things like the safety clause and qualified immunity. Safety clause is one of the biggest reasons they are allowed to legally order you around during a detainment.

      Retirement funds are governed by federal and state laws. No one can just get into those.
      You should look up qualified immunity, which clearly protects officers in unclear points of law or malicious acts. Courts decide in each case if it's applicable.       There is actually no law in Texas that requires you to roll down your window during a traffic stop, but the officer DOES have the legal authority to ask you to roll down your window, and you DO have to comply with "any lawful order or direction given by a police officer. This is straight from google.

    As a Retired Texas State Trooper, this Police Officer violated the driver’s 4th Amendment. The Amendment protects people from illegal search and seizure.
    This officer needs to be fired and he needs to receive training on the 4th Amendment. This is a pretty simple case, of what Police Officers should Not do.

      I’m an insurance adjuster. These municipalities have self-insurance, or Retentions (kinda like a deductible, but not). Anyway, within that amount, usually $500,000 to $3,000,000 on average, they are in charge of defending these lawsuits.
      Also, unless you live in Louisiana, you can’t sue another persons insurance company

I think that many of them, if not most, truly believe that they can give any reasonable command and it must be followed as.a "lawful order". If it's not followed, they resort to threats and intimidation. When that doesn't work, they feel like they have to follow through on their threats (usually arrest, and jail). Sometimes I wonder if the "threats and intimidation" part isn't actually taught at the police academies!

I do think intimidation tactics and a lot of other bs stuff they do is taught but police officers fired for doing stuff like this would never happen if it was taught as that would be grounds for them to sue.
