Check for other Estate Planning attorneys on TH-cam that practice law in Florida. It is state administered, just as Medicaid is also state administered. You both should set up a trust, jointly or separately. Do it asap! Medicaid has a 5 Year Look Back Rule, so setting up your estate asset protection plan early enough is key. I'm also looking for useful answers on this topic. From what I've been able to find so far is, that if only one of you is in a nursing home and the other is still living in the primary home, that home is protected for the time being. Time being means, until the surviving spouse is no longer living in the primary home or until that surviving spouse passes. Then, Medicaid will come to your heirs or estate executor and seek repayment for the "loan" fronted by them for the nursing home care costs. I'm not sure if that also includes at-home care. Good luck.
Sad...now people donot take good care their parent....we have to take good care aur old parent and they should not pay nothing in their old age. Nurshing home is just a robber.
