Everyone keeps mentioning his answer at 45:50 but you need to keep watching till 46:30 because he does get emotional right after he finishes that response. You can hear it in his breath & see it in his eyes. You can also hear it in his voice when he answers the follow up question. It was a great answer but clearly took something outta him to be able to say it.

I think the prosecutor was expecting him to agree with her that “on his best day his father was tyrannical” and she was gonna say but look at all these nice things he did for you. It seemed to throw her off a bit.

It breaks my heart, to think that them being in jail at that time was better than his home life.
And all she talks about is the privilege he had, you can have all the $$ in the world, but being abused at the same time doesn’t cancel out being abused. So she thinks bc he came from wealth, went on vacations and brought the the doctor the abuse wasn’t as bad or important!!! This!💯 Yes he tries very hard to not become emotional, however it's always there in his eyes and brows. This particular time stamp I consider one of his best comments during cross. I think after he said it out loud, his own words hit him in a big way. His life was going well. He helps his brother, made terrible decisions, and lost everything, but at the same time Erik is free from the 12 years of evil and finds prison a better place. This sediment is not the same for Lyle as he stated in 2020 interview. So I wonder which part of his statement got him choked up. It could be that it's everything as a whole. Maybe knowing the possibility he will be in prison for a while. 😞

    • @Tamarahope77
      @Tamarahope77 2 หลายเดือนก่อน +34

I don't know enough about this lawyer and her motives, but it is evident she had little regard for scientific truth. Her line of questioning to Lyle about his professed "love" for his mother and the apparent contradiction in his shooting of her cheeks shows she completely discounted the hours and days of evidence by many experts about the impact of trauma. These days, even lay people know that when your sympathetic nervous system is over-activated, like Lyle's was in the lead-up to the shooting and during the moment of shooting, your frontal lobe, where thinking and judgement resides, shuts down. As Lyle responded, he wasn't thinking, just reacting.
I once heard a male juror say that he couldn't believe that the boys were afraid when the parents were behind a closed door. This juror, like the lawyer, also disregarded what many experts testified to - that their brains' threat centre would have been hyper-active, based on years of experience of threat. If the defense could prove that they lived under those conditions, the last moments would be easy to understand. Withhold that information, and pre-meditated murder is all one can logically conclude.

I just don't think that's exclusive to Pamela. Leslie also asked Brian Andersen the question "when did you decide to remember that" and she also tended to be very argumentative and scream in the courtroom. To me, Pam seemed much more grounded and calm and made pretty good points in her closing argument. I'm not pro-prosecution, just for the record. I just see the case very nuanced.

I’m 48 years old and have had traumatic abuse in my childhood (NOTHING- not a millionth of what the brothers did) and I have been in years of therapy and continue to this day to make excuses for my parents and minimize what they did. Even at 24 years old I still lived with them and felt I could not leave and we had NO MONEY. People understand coercive control much more these days. At 48 years old if my father raises his voice I will start shaking and freeze like I’m a child again and as an adult I have become a kickboxing instructor and can defend myself but I still go right back to a child. Your formative years are as children- it shapes who you are as an adult. Unfortunately I have been with partners my whole life who were just like my dad. It’s really hard to understand unless you have been through it. To actually watch the brothers turn into little boys on the stand when they start talking about the abuse is heartbreaking. FBI behavioral analysts have said the very best actors could never conduct a “performance “ like that. They believe them, as do I. No matter how good of an actor you are- and these are not trained actors- Eric took a drama class in high school and was in a Shakespeare play- that is what we are dealing with here. When you’re lying your body gives unconscious “tells” that you cannot control. Everyone who’s analyzed them said their emotions/behaviors are so consistent with severe trauma that it would be virtually impossible for them to be that consistent unless they were being truthful.

While still attached to one’s abuser he/she feels almost like you share their brain. The prosecutor is asking questions as if Lyle was an “independent “ 19 years old normal college kid used to rebelling instead of a severely abused almost brainwashed guy who could even think the way she’s purporting in her questions to Lyle. Her questions sound as if she’s purposely trying to make him look bad. Only a person who grew up under constant scrutiny and abuses of both parents in their own way would be able to understand. And I can go on and on ,know this fact as well ,after the first trials ended hung lyle menendez was recorded in a jail phone call with a friend and made this statement "WE FOOLED HALF THE COUNTRY THE FIRST TIME ALL WE NEED TO DO IS FOOL THE OTHER HALF " both liars never were they molested and thos hasbeen coming put 34 years later from menudo better beware he can be arrested for false statements and that Robert rand as well pushing his narrative like he teyed to do back in 1990 to one of lyles friends Donavan goodreou, the case is open shut ,they killed for money got away for almost 7 months and boom lwop they so richly deserve bye bye ,help the hungry ,the homeless the poor ,stop looking up to lieing murderers! Fancy vacations, jewelry, cars, clothes, private school, private tennis coaches and housing all paid for their whole lives. This prosecutor said IN THIS TRIAL to the jurors “Boys cannot be r@ped. They don’t even have the right equipment “. That says all you need to know about what everyone thought about sexual @buse against boys at that time and why they were so scared and embarrassed to admit to it. Not to mention we know so much more about coercive control nowadays and why Eric at 18 didn’t just leave. His parents were determining what he was going to college for and that he was staying at home when he thought he would finally be able to escape. The brothers were examined by a psychiatrist in jail who determined Lyle was at an emotional maturity of a 10 year old and Eric an 8 year old and if you watch the trial you can literally see them turn into little boys on the stand. Omg- Lyle naming all his stuffed animals and doesn’t even understand he should be embarrassed about it- he’s laughing and excited about it. Sooooooo many extreme evidence of real abuse. Eric’s extreme mouth injury- nowadays CPS would be involved. The bed wetting- so much. My heart breaks for them. Lastly, every positive thing they have done to help others throughout incarceration when they KNOW, absolutely KNOW there is literally zero chance of release, they are dying in prison and they spend time bettering themselves and becoming advocates of helping other victims of abuse. What psychopath does that?? The odds of having 2 sociopaths in one house to conspire to murd3r their parents is so minuscule I would say impossible. And the quote unquote spending frenzy is completely blown out of proportion. Eric spent $10K and Lyle spent $60K over 7 months- out of millions and every penny had to be approved by the uncle, the executor of the will. The grand jury DENIED the fact they did it over money. The heinous nature of the murd3rs prove there is something much deeper and darker going on than k!lling them for money. Whoever thinks that knows nothing about the case. They had a significant life insurance coming to them in a few weeks time. If it was about money, why didn’t they wait for that? Why do it that weekend? Because Eric told Lyle and rational or not, after years of sadistic abuse and threats if they ever told what would happen, and Eric told and Lyle threatened his father. People who have experienced traumatic abuse their whole lives live in constant fear, trauma and are constantly on alert. The “normal “ person would not see their fears as reasonable but to them, especially Eric, his works from age 6 to 18 was constantly fight or flight, like in prehistoric times when you’re on alert that at any moment a tiger can attack you. You can never relax and you don’t know what is coming next. You have a warped sense of reality. Leslie said she knew he was telling the truth because of how well he adapted to prison because for the first time in his life- in the ultimate environment of confinement, he was finally free and safe. FREE THE MENENDEZ BROTHERS!!! They have paid their punishment and more and are rehabilitated. They deserve to live a decent life for once.

I’ve watched and rewatched both Lyle and Erik’s testimonies and interviews and realized that part of my fascination is with the fact that they both appear to be kindhearted and sensitive guys juxtaposed to their horrific upbringing. Several times I’ve wondered how is this possible, but now I think I know. When they were younger they were very much involved with their extended family, possibly most importantly, Aunt Teri. It also sounds like friends, neighbors, coaches and teachers within their well-to-do community provided positive role models in contrast to their parents. Had all those influences not been available to them, I think we would have seen much different behavior in many ways.

In Germany court system in which i worked as juvenile support worker, under 21 year olds get usually judged as minors due to immaturaty (especially in trauma cases) and maximum prison sentence is 20 years. Character avaluation regarding chances of rehabilitation and level of danger to society are crucial to judge a case. They have left out all considerations which are major factors for making conclusions about which sentencing is proportionate. Inspite of all the experts who witnessed for defence cooperating their story and explaining the issue, and the prosecution having no proof otherwise, some jurors seemed to just dismiss those factors based on nothing but being unfamilar with those topics and "disbelieving" (according to other jurors). Prosecution also went out of their way to twist and distort and ignore some undeniable truth. It definitly was injustice!

Oh god Lyle, ' I haven'r lied here, but I've said a lot of things here I wish I didn't have to say'... to be fair, he has easily been more honest (I feel) than I ever have been in my life...the statement that their lives were not good for the 6 months leading up to arrest, haven't been since arrested, 'our lives never have been great' insinuating they have never had a great life (despite their 'privilege') breaks my heart.... but what gets me is this is CLEARLY the first time he has ever felt supported in his life... look at his face when he says 'I feel like I am very different, than I was then, and I have different people in my life, my family has come and gathered around us....' THIS is the 1st time he has felt supported in his life.... EVER, the first time in his life he has truly felt 'safe' (you can see that in the softness of his face in that moment) enough to tell the truth.
The fact he says about his abusive parents, that there were good times as well as bad times is the absolute 100% truth of abuse (not well known back in 80s/90s) that the reason people stay in abusive relationships is that people don't leave is because 'it's not ALLL bad', so because you had this sliver of 'kindness' YOU should be grateful' grrrrrr! This prosecutor makes me angry, because 'your parents threw money at you, you should suffer ALL of the abuse they threw at you.... be grateful for the money you little 'sh*t' SERIOUSLY!!!!! 🤬🤬🤬🤬

Some jurors didn't even understand the concept of "reasonable doubt", and didn't understand that the prosecution had to prove intent, rather than the defense having to prove the sexual abuse. The men also felt that Erik was homosexual because his father called him a "f*gg*t" (not sure how that was relevant), that the parents were ideal parents, that the expert witnesses were paid and not reliable, that men lie on the stand so can't be believed, etc.

Most children don't kill their parents unless something foul happened in their upbringing or they suffer from severe mental health like schizophrenia. And I've never heard of siblings jointly killing their parents unless abuse is involved. I dont buy the money argument as Lyle was off to college with his own dorm and everything already paid for. He wouldn't throw his life away just for his brother unless something foul was happening. Also the way they shot those parents was out of pure hatred or fear. If it was just about money, they would'nt have defaced them like that. They had no debts or gambling habits, nothing that indicated they needeed money straight away hence why the grand jury threw out the money motive. Statistically, children who kill their parents do so out of fear or abuse. If these boys hadn't had rich powerful parents they would have been believed.

@@MariaPadua-qf1ox Due to the Wealth, if caught, they Had to come up with some very compelling reason as to Why they killed both parents. Firstly though, due to their Ongoing criminal & anti-social behaviours plus the parent's huge concern about a woman who Lyle was dating, in the summer, Jose had told them he was going to cut off their money, change the will & he made the Big mistake of telling them that. Jose had previously worked with & was very close to, his brother-in-law Carlos & he had discussed this with him at the time as Carlos knew quite a bit about what had been going on for ages but more particularly, he knew about the robberies both sons committed in '88, where Jose ended up reimbursing the house owners & the real Reason as to why they suddenly left Calabasas & moved to that house in Beverly Hills. Eric had watched the BBC 2-part documentary The Billionaire Boys Club & due to xyz from '88 & some dodgy friends from Calabasas, that scenario appealed to him greatly & he saw himself as the star of such a plot. He & a friend by the name of Craig, also one of the thieves from Calabasas, had already written a screenplay the year before, about murdering your parents. Due to Craig showing up at the house in Beverly Hills about Jan/Feb '89, Jose had kicked him off the property & a severe threat was made if he ever came back near his sons. Their lives had always revolved around constant tennis training & the travelling for the tennis circuit & their education. They didn't have many friends before & in Beverly Hills, they were even more so, ducks out of water. The tennis was to finish, Lyle had been thrown out of Princeton, Lyle being accepted to any Ivy League college was a figment of his bs artist imagination & instead, he was supposed to be actually working with his father. Having access to his office, gave both sons the opportunity to go through paperwork & the point being, knowledge of Jose's finances & insurance policies. Jose had a policy for $15 million But, they were to find out this was Not a personal insurance policy but in relation to the business loan. There was another for $5 million but Jose hadn't taken the medical for that & so, it was not in place.
Of course they knew about the Arnel Salvierra case of '86, where in '89 he was given 5 years probation only, because his lawyer argued abuse by the father who he shot 3 times when he was asleep. That abuse-excuse lawyer went on to be Erik's lawyer, Leslie Abrasom. Clearly she coached these mongrel brothers Very well for the 1st trial, 4 years of practice with all their feigned tears, face pulling & long pauses before answering their Lawyers' scripted questions. They didn't do so well when the time came for the Prosecutors questions because they couldn't foresee how Those questions & rebuttals would be coming at them.
The trial shows some Very interesting information about Jose's sister Marta & Her involvement, in relation to his finances, his will & an insurance policy she had written up for him in Jan '87. Though not one of the executors for Jose's will, her actions from the minute she arrived on Monday 21st August are more than questionable & more so as she went straight to his office. From her very long testimony in defence of the brothers, it is quite clear that she was the instigator in bringing family from both sides onto the witness stand to run both Kitty & Carlos right down to the ground because really, Everything was about the Money as well as the Envy of the money, Before, many years worth. The pages of Jose's insurance policy that She had written up for him as an agent, disappeared from his office, where She had basically resided for days from the moment she hit town. As suspects, those brothers had no right to any insurance money but she sent the application off immediately, via Her 'secretary' & they got a whole load of $$ & so, the exorbitant spending spree very soon down the track. In the meantime, they lived in swanky hotels due to Marta & her persuasive ways in pressuring Jose's boss for instant cash & their mode of transport was limousines for all. She told a story about the sons Not knowing about that policy & that they'd told her that they were disinherited, so the gist was, the murders Weren't about the money & so, she & certain family members were defending them to the 9th degree. It came to light that she'd lied about When she had a meeting with Jose's business partners where the sons were in attendance. She never mentioned at all, the meeting on the Tuesday evening with Carlos, the partners & Lyle. She pulled a face when the prosecutor brought up the Fact that Lyle purchased 3 Rolex watches with a credit card on the Wednesday. Basically she said "so?" The other sham was talking about the will not being found. Carlos later told the court about the other Carlos family member finding the will on the Tuesday & it was supposedly found in a box in Kitty's bedroom cupboard. Certain items were Staged in that bedroom. Just saying for Your information.
The plan, if caught, was Always to accuse their father of severe mental & physical abuse. Obviously Shapiro informed them they were up for the 1st degree murder of Two people. In jail together, a new plan was forming as something Had to have happened Very recently & it had to be Extremely compelling. Whatever they had told Shapiro, he now Had to go & his services were dispensed with. In came abuse-excuse expert, Leslie Abrasom. There was absolutely Nothing else except an incest abuse storyline & she hired a particularly dodgy psychiatrist to go 'analyse' them in jail & now there had to be some sort of self defence scenario which was going to be a bit difficult, because no weapons were found with the bodies.
Next plan as something Had to have happened to cause them both little 'boys' to fear for their lives in the days preceding the killings. So, the first story was that nearly 19 years of age 6 foot tall & Very fit Erik, had forced sex with his father 2 weeks prior & he had told Lyle about it who threatened the father not to do that again. The story had to evolve because the mother was slaughtered also. So, the 'boys' found out that the mother knew about the incest that had been going on for years, because she'd told them, the week before. Not quite right because the Autopsy report was in so, Why the direct blast to the mother's face, committed by Lyle. They'd told Dr Ozeil that Kitty was moaning when they went to leave & to put her out of her misery, Lyle went back to finish her off & This was on the tape recording. Hmm, so next, the mother was committing incest with Lyle & That's why he got a shotgun too.
They were never going to purchase hand guns, as they vehemently stated they tried to do as weapons to protect themselves, the plan was always the pump action shotguns, as if a mob hit upon their parents when the 'boys' were at the pictures. The knee-capping of both parents was the MO for the mob, according to Lyle & Erik Menendez & so, that's exactly what they did, along with a point blank blast to the back of their father's head & 4 other shotgun hits for him. After 8 blasts, their mother was still alive when they ran out of cartridges & so they had to go back to the car where Erik handed Lyle one more cartridge & he ran back to the den & point blank shot his mother in the face. They then commenced to pick around all the blood & gore & the Sight of their once pushy parents, for the shell casings.
Monday 21st August '89 - info about a will was seen on the computer in the parent's bedroom but same family members plus Joan, Kitty's sister, said they couldn't access the 'index'. That sister went on to do the exact same to Kitty & Jose for the defence as the others involved & she is front & centre for news conferences at this time today, still lying, whilst she Never mentions that her darling 'boys' also accused her Sister of incest. Both of Kitty's brothers always said those mongrels did it for the Money. Very much unfortunately, Brian is deceased.
On the 1st September '89, using cloak & dagger actions & separately, Lyle & Erik rushed back to LA from their parent's funeral in Jersey. Lyle said he'd hired a 'computer expert'. This male had gained access to the house via the lane at the back, thwarting the security guard at the front. He was at the house all by himself. Was this Craig? As the police allege. The police later found out that the hard drive for that computer was destroyed.
For xyz reasons come end of October '89, Erik ended up telling Dr Oziel what they'd done. In my opinion, Erik had become fearful of his brother. Before that day of 31st Oct, Erik had told Craig what they'd done. Who went on to tell His friends in Calabasas, at some stage. When was Lyle going to find out that Erik had blabbed to Craig & which of the friends was going to tell the Cops first, what had been said.
Even though they'd plotted out another story line which was a snow-job for that psychologist, & a Very good one, what they talk about, the 'reason' for killing both parents is Very interesting indeed & that alone, shows what high end Psychopaths, obviously they Always were.
The sad sacks who have been sucked in by the sleazy Dirt that those mongrels Still say about their parents, should take note of the fact - when Dr Oziel made Erik call his brother to tell him that he was suicidal & to tell him that he had disclosed their premeditation plot to Him, the first thing Lyle did was drag Erik down to his brand new jeep & told him that that they would be killing Dr Oziel.
N.B. Please don't get rich, your kids will be more than capable of making up the exact same despicable lies about You too.

It's almost horrible how the prosecutors treated these two boys as if they were normal adults, asking if he thought that way, when you don't understand that when you grow up in an abusive home you don't grow up as a normal child. She treats Lyle as if he were a normal adult college student who sometimes messes up and makes mistakes. The situation here is so different and few can understand it. Their whole lives were not like the lives of other children who had a healthy home at home, they only knew one world. I pray they get out of jail soon, 35 years is so unfair.

In a tape-recorded therapy session months after they shotgunned their parents to death, Lyle and Erik Menendez said that they killed their mother to put her “out of her misery” and that their father deserved to die because his infidelity had driven her to despair.
During just over an hour with their Beverly Hills psychologist, the brothers never mentioned sexual abuse or self-defense--now the cornerstones of their defense against murder charges.
On the tape, Erik Menendez sobs. But Lyle Menendez speaks coolly of the slayings as a carefully calculated “meeting of the minds”--and as an accomplishment of sorts.

There's nothing the Proscution can say at this point to convince me these boys have not already done their time. .since they were born. I'd let them off completely, the parents got what they deserved & the boys have suffered enough (since birth).
The fact Lyle thinks the SA with his Mother (who didn't meet the bare needs of a baby/child) is consensual tells me he needs therapy, not jailtime.
As it is, they should be let out immediately since the Menuedo man came forward saying Jose drugged & raped him as a child.

He was also brought up to conceal secrets and lies and therefore feels like not only did he kill his parents , but also betrayed them by revealing their life nationally. The pictures from now look like more alive and like he’s made peace.

His command of language is remarkable. The prosecutor keeps trying to lead him into traps, but he remains calm, composed, and seemingly sincere, revealing a sharp intellect. His responses are detailed, and the way he articulates his thoughts clearly shows depth of intelligence. People have said Lyle was manipulative-if that’s true, you can see it right here. His intellect and verbal skills are undeniable. He presents himself as entirely honest-and I’m not saying he’s not-but when you consider what he said to the woman who contacted him in prison right after the first trial - and with whom he had phone conversations for a long time - and who recorded them - it’s striking how skillfully he could manipulate people into believing he was completely honest. This does not take away from my opinion that both brothers have paid their dues at this point and should be resentenced.

Where was he not honest? You aware that the Norma tapes did not incriminate him and that it was just another spin by media? Also have you considered that the crime would have reflected their intellect but didn't at all and that is even more evidence additional to other evidence that it was impulsive and in high emotional state blacking out rationality and calculation!?

@@Salee-ze7qt I don't disagree with you. I believe their lives were hell, and they should receive parole at this point. But they did kill two people. I sense that Lyle was the mastermind in everything that happened, and Erik was more of a victim of his brother's power over him. Regardless, their sentence of life without the possibility of parole was, as in Leslie's words, exceedingly cruel.

He is very believable in here. 'Good things came out of these', and he starts to cry. He is honest. She is asking about the money, the cars, vacations, private schools, soooo what? Ffs. This is actually laughable. How many people have the same type of wealth and they are miserable because they go through similar shit or some other sick stuff. Her argumentation, that some things were good is so weak. The abuse cancels it all. These things mean nothing when you are constantly 'punched in the stomach' by your father. If it mattered, or was more important or equally important to the abuse (I know it may sound weird) the parents wouldn't be dead.

I'm always amazed at the amount of pro prosecution people who actively seek out videos about this case. I myself find the case interesting (mostly from a defense point of view) to analyse so I like to revisit videos to refresh my memory or check new conversations happening. I always see some of the same pro prosecution names pop up and it genuinely confuses me. It seriously must be some sort of mental health issue to continually express hatred towards two people who have no effect on your life whatsoever and even more so in a case where the murder victims family support and stand by the killers and have said they DON'T FORGIVE THE PARENTS. There's something about this case that attracts some really insane individuals who just have a hard on for crime and punishment.

I totally agree with this. I realize it's the prosecutions job to defend the parents, but at the same time, the people were absolute monsters. The defense couldn't have had a better case. The witnesses they brought in, the testimony they brought out. In my mind, because of the defense in this case, there is no question those two were abused terribly. The defense were the real heroes.

This prosecutor is so blessed! She’s fortunate never to have experienced abuse. However, when you’re given blessings and misuse them by acting self-righteous, karma will catch up to you eventually. Karma doesn’t always affect you directly-it can impact your kids or loved ones, leaving you to witness their pain.
Also, I find her comments about Leslie’s financial issues uncalled for and unprofessional, especially when she follows them up by mentioning her own houses. It comes across as insensitive and boastful, which only undermines her credibility and integrity.
Lastly She also mentioned in an interview that there was a joke between her and her colleagues about the Menendez brothers and their attorney, Leslie.
They joked about having two bullets and debated who they would shoot. She allegedly said she would shoot Leslie, the attorney, twice. This kind of remark seems unprofessional and highly inappropriate, especially given the serious nature of the case.

I think this is so complicated bc these 4 people have built up such a hyper toxic system, that was unfortunately working, so that u simply got used to it, that the boys simply snapped in a few days. Not bc this one thing happened, but bc all those years happened before. And while she’s always talking about them being adults - I don’t think so. These were still kids. And the way they saw their family was still highly childish. And it also seemed like the two never really had great friends they socialized with and only had each other - and then you lose yourself in your tiny little world with all these unspoken elements and interpretations - and then there’s that one point where „it“ doesn’t work anymore
