  • Breaking News : US Supreme Court says US citizens can't sue over foreign spouses' visa denials!!!
👉 In this video Immigration Attorney Jacob Sapochnick will talk about If you are a US citizen married to a foreign national, going through the green card process, there's an update for you. A new decision by the supreme courts has made it impossible for you to sue the U.S embassy in court over visa denial.
This rule may impact how these green card cars move on from now on. This means your constitutional rights are not extended to this aspect of visa denial no matter how long you've been in the U.S citizen.
In this video, I explain everything you need to know about this new law.
Notes: Be careful when applying for marriage visa interviews. And be very transparent during the processes.

This is some bullshit! So, so unfair. I am absolutely sick of these agencies having the power to keep couples a part without cause.

hmmm interesting. Does this mean consular officer decision is final on just foreign spouses or all family based categories and employment categories?

This is so sad! So the US Government gets our TIME & FREE MONEY ! This is horrible news
Thank you for the information. The is absolutely terrible!
Being a U.S. citizen is pretty much irrelevant to the process!
The system is broken in so many ways!
The U.S. government is making this process even harder and harder to be united with your spouse.
Human ERROR HAPPENS ALL THE TIME!
This makes me very sad to know a consular officer hold that much authority and power over our lives. 😭
    😢

What if the sponsor (US citizen) says or writes on line anything that the interviewer does not agree. Can that be reason to deny visa?

Hi. For adopted child of us citizen who turn 29 at the time the petition was filed, is it same process with the biological child of us citizen? After approval of I-130 does the adopted child go directly for interview at us embassy or have to wait for a visa in visa bulletin?

There are all sorts of very valid reasons to deny a visa to a USC spouse. There is a valid governmental interest in keeping different classes of aliens out of the US, and being married to a USC has never been a legal reason for an automatic issuance of an immigrant visa. Be careful who you marry, if your spouse is not a USC.

I get it - consular officers need to have non-reviewability for security reasons. I went through this process. If your spouse has no issues with US immigration and don't have any criminal issues/ties, they are almost guaranteed a green card. Not sure why people are so angered over this.

Advice is not giving them any reason, but sadly if they want they will find one , even if it’s a personal preference, you can’t provide anything,

Thanks for your posts. I wanna ask how long you think it will take to receive an Interview Letter from US Embassy Accra Ghana on a CR1/IR1 with a Priority date of 8th August 2023 and Documentarily Qualified on 8th February 2024. When can I get an interview appointment letter in Ghana?
