    Rules governing termination of employees in India
    The employee termination decision most probably falls under one of the reasons described above. Whatever the cause of firing the employees, certain federal and central rules must be followed by every organization. Here are the 6 important rules that one must abide by before terminating one’s employees.
    A 30-to-90-day notice period is standard for terminating the workforce in one’s organization. Stated under the Industrial Disputes Act of 1947, the law mandates that when terminating more than 100 members working in a manufacturing plant, mine or plantation unit, government approval is required. Terminating employees in other sectors requires only a government notification.
    Under the Indian labor laws, an employee can be lawfully terminated from an organization for one of the following reasons:
    Disobedience or will full insubordination
    Fraud, dishonesty, or theft
    Loss or Damage to the employer’s goods willfully.
    Taking bribes or illegal gratifications.
    Absence without applying for leave for more than 10 days.
    Late attendance.
    Disorderly behavior during work.
    Negligence of work.
    When organizations terminate their workforce for convenience, the policy regulates that the last person to join the organization must be the first one to leave. Also, when the organization rehires for the same or similar job roles, the terminated workforce should be prioritized.

    A company asks the employee to sign an agreement that employee will not sue the company for any grievance. If not, they'll not pay Full & Final Settlement .
    Forcing someone's concent to an agreement by withholding the employee's salary - is this right? Can an FIR be filled?

      You can file a complaint with the police. You will get the final settlement. I had this experience.

    Mere manager ko mere sath problem hain. Kiuki main oiling buttering nahi karta. That's why he transferring me at a remote area so, that i will submit my resignation automatically. But I want to work at the same location. I am a well settled family man. So, change of current location is impossible for me 😢😢. Now what should I do? (He is transferring me only out of 80-90 peoples of my team)

      Same is happening with me in hcl here out of my RMs ego he raised a PIP- but project would come after 3months and they used pip in training period itself dosent make sense itself and the entire hierarchy of Nagpur location is south Indians and south Indians have their own lobby here! Whatever the thing is even in training period I am the best performer- so it's not justified

    I am professionally Quality analyst. I have joined new company in Mumbai. And come to the Bangalore for 45days for training. Now they said I have not given the sale and there is no improvement. In 10 days they asked me to leave. They judge me on sales but I am quality. They have not tell me this in interview or after joining. What I should do. Please let me know.

    I was terminated because they told me that i was not able to clear certification(they ask me some product related questions and I was not able to answer) so they said we can't take you further and they terminated me at my first ever job during training as fresher, and I was told to "kindly mail the resignation to process my salary.
    So in this case do i need to send resignation?

    My friend got pip and his hr said that the last week review will be last working day if pip is not completed. HR said that he will give normal separation if pip is not completed. Is that means resignation or termination? How it affects experience letter and relieving letter? If the last week review day is the last working day. Notice period will there? It won’t there right? How interviewers will take that less notice period or no notice period? What will the bgv and reference checks? Please tell.

      You can't do anything buddy ask them to give you 3 month salary and you can stary looking for another job

    Your channel is very helpful for fresher's.
    I joined a MNC in bulk hiring, completed training but now I am on bench for more than 3 months also there is no further interviews conducted yet.
    Also my manager said that many projects don't required fresher yet and other projects are in R&D stage or later stage. Also there are many candidates of same track are on bench. Do my company can fired me or something.

    Maine ek company join kiya jahan maine pehle hi bataya k 5 years pehle maine ek company me 2 months k liye kam kiya magar mere pas wahan k koi papers nhi hai kyun k family issues k wajh se leave chahiye the magar mila nhi to mere manager ne mujhe office aney se mana kiya...

    Bhai company down sizing ke basis pe resign krne ke liye bol rhi h with proper notice period... But me mna kr rha hu resign ke liye but wo fir terminate krne ke liye bol rhe h... I have only 10 hr to resign otherwise after that they will terminate me.
    What should I do? Should I ask for 4 months salary pay as a big giant company does?

      Start looking for a new job. Termination on performance can be challenged in Court but it will take years. Nobody does that in India.
      You will loose money and time so do the company.

    I joined a product company as a fresher. I cleared all the necessary assessments conducted for all the trainees along with me but after 7 months my technical lead got doubt on my knowledge and conducted exam but haven't shared me any analysis. After that my manager told they'll monitor my performance for a month and I should write weekly assessments. But Within a week, management asked me to resign the company due to my low performance immediately the next week. I feared as a fresher and resigned that company. They provided me a 1 month notice period salary. Can I do anything now to get back into that company or compensate if there's any loss??
