Good afternoon, thank you for your explanation, but as I know the huge difference it is in case resignation employee needs to pay some amount to the employer, which of my point of view is illegal. As per the offer letter if 2 years were not completed employee needs to pay some compensation for visa costs, medical and sometimes flight ticket. Everybody knows that it is against the UAE law to charge worker for visa. Nowadays HR created new reason for taking money - for the trainings, which as per them are expensive. They never describe in the offer letter for what and how much you will pay, but after resignation the amount is huge. For example the basic salary is 1500 AED and the amount to pay is 3500 AED which is unbellievable. Please make a video regarding unreasonable charges from employer side in case resignation and the contract is limit. I believe all people need clarificstion from the lawyer side. Thank you.
If it's a limited contract then yes you need to pay 45 days gross salary to the employer as that would be considered as a breach of contract. If they terminate you they will have to pay 3 months of Salary to you. No matter what do not resign even if they force you to do so they will say "according to our company policy", don't believe them. They will even ask you for visa costs, expenses etc which is illegal against UAE Labour Law. I have filed a complain to MOHRE as my employer is forcing me to resign and also pay the visa costs. Dispute is still going on but I'm going to fight for my rights 💯

@@ronnielaymendoza3014 thank you for your comment. Still it is better to serve notice of resignation. Depending on if you are on probation or you have passed the probation the notice period should be 14 days or one month if otherwise is not stipulated under your employment agreement. Regards

Hai, if you are resigning during your probabtion period which must not exceed 6 month according to uae law, you have to provide the compensation to employer if the contract state, the contract may state to bear the loss in case of resigning during probabtion which the employer has to bear the cost of recruiting new employee.

After 5 months of joining i came to my country on emergency leave and i extend my leave because of some family reasons. hai, if u are in a residence visa, the uae provide upto 6 month you can overstay with overstay fine, if you are in visit visa, 10days with overstay fine.

Just to be more specific. Contract was from August 2022 till August 2024, but they insist to cancel in July 2024. The teacher wants work till the last date of contract (which is till end of August 2024) and mentioned the notice period in the resignation, but they don't agree and insist on changing last date to July 2024... And since the school is closed during summer vacations, does the teacher need to service that time as notice period as well?
Appreciate your comment, usually you have grace period of 30 days, however this period of mentioned in the cancellation paper, if the visa was cancelled after expiry date immigration might not grant days to stay. So to be sure I’m your situation check cancellation paper. Regards

No do not sign any cancellation papers without receiving your full dues, gratuity etc. If they refuse or threaten you, complain to MOHRE.

What about buying out the NP? Where does it say in the UAE LAW that the employee cannot buy-out the NP and only serve a shorter period?
