I used to watch the Jim Sterling vs. Digital Homocide stuff once in a while, something about people ranting and thinking they have the law on their side just gets me off.
This "man" is treating all of us like little kids, but he is the actual big baby himself, not understanding what is considered Fair Use is actually about. Let's say for instance I would do a parody of The Gallows and they said if you say Charlie in the theater it's bad luck and I would add the actors from Blackadder the Third (season 3), their Macbeth bad luck ritual, because it's funny and fair use. Go to 99 Designs and look at the article he shows. In the _Cariou v Prince_ case he shows he has to specifically crop out the bottom portion of that section of the article because it reads, quote: "Update 4/25/13: Not two weeks after this article was published, the original decision in this case was overturned and the judge ruled in favor of Prince for the majority of works in dispute, claiming that Prince's work transformed the work in a way that it was aesthetically different, and thus acceptable under the argument of fair use." So Mr. Savage's own examples included one where it was found to be Fair Use and he just cropped out that inconvenient detail.

Unfunny Dilbert 1876 Can't say off-hand since his tweets are now protected, but as best as I can make out he had a bit of back-and-forth with YMS and Adam gave him some constructive criticism which Derek took on board, altering CCStK for its next release. For example the guy in the background who walks out of his house and then backs away is removed and Cool Cat now looks both ways when he crosses the road while chasing the bully.
(I know, I'm pretty late here, but still.) Is it just me, or does this guy somehow seems like a big...child? Y'know, naive, somewhat innocent, oblivious to a fault, can't realize his own mistakes, throws a fit over something he clearly doesn't understand (even though he believes otherwise). I might be wrong here, but this guy seems pretty childish and immature in just all the wrong ways. Like some kinda sheltered, spoiled brat who doesn't really know how the outside world works, and thus fails a ton because of that ignorance. The same day this video was uploaded, Jim Sterling uploaded a video about some kind of new "Fair Use Protection Program" for TH-cam partners. Apparently, TH-cam is actually going to start providing legal backing to partners who are hit with spurious DMCA claims.
+Dr Shaym You have to acknowledge that google is in a pretty sucky position though. More content is uploaded to the site an hour than anyone could ever check. There's no shortage of infringing content on TH-cam (songs, mainly) and people would looooove to sue Google for the $$$. So unfortunately you do have to take a protective stance, but it would be good news if they started helping partners deal with false claims.

Essentially, what TH-cam is going to do, is select specific videos that Google staff consider to be perfect examples of "Fair use". It'll then offer the content creator a million dollars in legal defense if a lawsuit is ever filed over that specific video, and also use that video and others like it as a thing to show companies EXACTLY what Google considers to fall within fair use.

Until 1 1/2 years ago I used a laptop made from 2003-2005. I tested the difference between those browsers on there. IE loaded a TH-cam video in under a minute. Chrome took 17 minutes to load the same video's page, the audio skipped and the framerate was awful throughout (even at 144p). Comment on the fact he was recording his screen with an actual camera instead. That's a legitimately unprofessional thing to do, whereas using IE is looked down upon by people who've never had to make do with old technology.

Let's say for instance I would do a parody of The Gallows and they said if you say Charlie in the theater it's bad luck and I would add the actors from Blackadder the Third (season 3), their Macbeth bad luck ritual, because it's funny and fair use. In the _Cariou v Prince_ case he shows he has to specifically crop out the bottom portion of that section of the article because it reads, quote: "Update 4/25/13: Not two weeks after this article was published, the original decision in this case was overturned and the judge ruled in favor of Prince for the majority of works in dispute, claiming that Prince's work transformed the work in a way that it was aesthetically different, and thus acceptable under the argument of fair use."
So Mr. Savage's own examples included one where it was found to be Fair Use and he just cropped out that inconvenient detail.

Can't say off-hand since his tweets are now protected, but as best as I can make out he had a bit of back-and-forth with YMS and Adam gave him some constructive criticism which Derek took on board, altering CCStK for its next release. For example the guy in the background who walks out of his house and then backs away is removed and Cool Cat now looks both ways when he crosses the road while chasing the bully.
(I know, I'm pretty late here, but still.) Is it just me, or does this guy somehow seems like a big...child? Y'know, naive, somewhat innocent, oblivious to a fault, can't realize his own mistakes, throws a fit over something he clearly doesn't understand (even though he believes otherwise).
I might be wrong here, but this guy seems pretty childish and immature in just all the wrong ways. Like some kinda sheltered, spoiled brat who doesn't really know how the outside world works, and thus fails a ton because of that ignorance. The same day this video was uploaded, Jim Sterling uploaded a video about some kind of new "Fair Use Protection Program" for TH-cam partners. Apparently, TH-cam is actually going to start providing legal backing to partners who are hit with spurious DMCA claims.
+Dr Shaym You have to acknowledge that google is in a pretty sucky position though. More content is uploaded to the site an hour than anyone could ever check. There's no shortage of infringing content on TH-cam (songs, mainly) and people would looooove to sue Google for the $$$. So unfortunately you do have to take a protective stance, but it would be good news if they started helping partners deal with false claims.

Essentially, what TH-cam is going to do, is select specific videos that Google staff consider to be perfect examples of "Fair use". It'll then offer the content creator a million dollars in legal defense if a lawsuit is ever filed over that specific video, and also use that video and others like it as a thing to show companies EXACTLY what Google considers to fall within fair use.

Until 1 1/2 years ago I used a laptop made from 2003-2005. I tested the difference between those browsers on there. IE loaded a TH-cam video in under a minute. Chrome took 17 minutes to load the same video's page, the audio skipped and the framerate was awful throughout (even at 144p).
Comment on the fact he was recording his screen with an actual camera instead. That's a legitimately unprofessional thing to do, whereas using IE is looked down upon by people who've never had to make do with old technology.

People on here just want want to express themselves and create -- meaning OF COURSE opinions are going to clash. But that's life... If only people were willing to DISCUSS ideas and opinions instead of feel personally insulted and resort to outrageously childish attacks. What Derek did WAS bullying; no matter what he in his deranged mind believed. It was borderline emotional abuse, to me. The hypocrisy leapt off the screen. @@naenaeman1135 I disagree, he was being bombarded with Derek's messages INCLUDING him faking a legal notice. IHE did very well throwing the truth out there rather than hiding it and ending up in Derek's hands.
It is still hard to watch this video, Adum. You did a fantastic job of thoroughly debunking Derek Savage's claims...but when Derek talks it so very heavily hurts my brain to listen. I lost weight from the repeat cringing.
