In my state, Western Australia, a commercial came out this week on radio. It was a police recording playing the victim of how they are mistreated by the public. They are lied to, spat on, assaulted, disrespected blah blah blah. My thought was, awwww, isn't that just too bad. I have been pulled over by cops twice for simply driving down a street slowly (as I used to own my real estate agency) checking for any new developments. When they pulled me over the way they treated me was as if I was a criminal. They poked, prodded, fished and tried to fabricate that i was acting suspiciously, even after I told them what I was doing. They also complain they are overworked and underpaid. Pity party.

The cop who arrested him said she felt her life was in damnger because of his camera. By the end of the trial the arresting cop had lost her job, she cost the city tens of thousands in law suits. The guy also sued her personally in a civil suit and was awarded everything she owned including her home. ONE DAY COPS WILL LEARN.

I have taken HIPPA classes and I am currently HIPPA certified. He is correct, there is no way he can be in violation of HIPPA law. That law is all on the hospital staff. They are solely responsible for patient information. It is on them to make sure that information and the gathering of that information is safe. If he were to get patient information from her while she is doing her job, she would be in violation not him. Health Information Patient Protection ACT. HIPPA is the acronym. If you have not taken the class and passed the test and signed a form stating you will do your due diligence to keep patient information private. Then you can not be held liable under HIPPA Law period.
If she can show she has made a private place and he intrudes then she can have him removed. If she is taking information in a place where the general public can hear or see then she is in violation by doing so. It is upon the medical staff to create this privacy. HIPPA -
    Privacy Rule
Protects all "individually identifiable health information" (PHI) that is held or transmitted by a covered entity or its business associate. This includes information in any form or media, such as paper, electronic, or oral. The Privacy Rule gives patients the right to request and receive copies of their medical records, with some exceptions. It also protects against unauthorized disclosures, such as to family members or personal representatives, and requires patients to give written consent for these disclosures.
    Security Rule
Regulates the security and protection of specific health information that is transmitted electronically. The Security Rule includes three parts: administrative safeguards, physical safeguards, and technical safeguards. Administrative safeguards include things like assigning a security officer and providing training. Physical safeguards include computer back-ups, equipment specifications, and access restrictions.
    Enforcement Rule
Sets civil financial penalties for violating HIPAA rules. It also establishes procedures for investigations and hearings, and requires entities to take corrective measures if noncompliance is found.

Those medical staff don't understand that HIPAA only applies to those who are employed by insurance or medical providers. A journalist can't possibly violate HIPAA. If a medical provider violates HIPAA and releases medical information, anyone who shares that already shared information doesn't violate HIPAA.
