- On August 22nd, 2022 I was peacefully exercising our First Amendment right to record in public and publicly accessible areas in Downtown Schenectady, New York. I you want to give compliments or would like to redress your grievances to our government about the conduct in my video, the information is below.

The camera person has counteracted the effect of the tinting of the window by pressing the camera up against the window. The tinting on the window prevents one from seeing inside when viewed from a normal position on the street. The camera person may well be inside the property boundary when pressing the camera up against the window. He could, technically, be trespassed for doing that. They understand how glass works. Do you understand the purpose of window tinting?

These audits are working. The cops know the deal. They may not like it but they understand that what you are doing is 100 legal. I think you should try to get the BWC footage.

At 7:03 I see here is another place that has the gang sign. I am so sick of seeing that thin blue line flag. It is to the point that when I see it I get on the defence. I no longer see the police as an open association of law enforcement officer. I see them as a gang and the thin blue line flag is their sign . Just like anyother street gang that paint their gang sign all over the citys, You see that thin blue line sign everywhere.

@ NY State Audit - Is it possible the property is indeed privately owned? However, because the services offered are government provided and/or funded, the area then becomes "public"?

If the Supreme Court says that flag right there is protected under the same amendment that gives me the right to video anything I can see in public then that's good enough for me why wouldn't you want to know that people think that way about that kind of stuff that's the beauty of freedom of expression we don't have to ask people if they're somebody we disagree with if we're willing to just look peacefully and politely
But the camera person is not videoing what the average person can see in public. In order to see inside the building, the camera person needs to press the camera up against the window, and he also zooming in to get a better look. That is not possible with he eyes. On that basis it is quite clear that the camera person is not being polite. Also, by pressing his camera up against the window, the camera person may well be inside the property boundary.
I don't think the 1st Amendment says anything about the flag at all. When did SCOTUS make that ruling? Can you cite the case?
PRIVATELY OWNED PUBLIC ACCOMMODATIONS SHOULD BE TREATED THE SAME AS IF THEY WERE PUBLIC PLACES. THAT IS WHAT CIVIL RIGHTS LEGISLATION IN THE 1960'S WAS SUPPOSED TO ACCOMPLISH BUT APPARENTLY THAT WAS NEVER REALIZED AND HAS ALL BEEN FORGOTTEN.
@@davem9572 IN THE SITUATIONS YOU DESCRIBE, THERE IS A DENIAL OF DUE PROCESS AND ESPECIALLY OF THE RIGHT TO APPEAL AND SEEK REDRESS FOR BEING DENIED ACCESS TO PUBLIC PLACES AND PUBLIC ACCOMMODATIONS. ALSO, THE PRACTICES YOU DESCRIBE ALLOW DISCRIMINATION AGAINST MEMBERS OF PROTECTED CLASSES TO OCCUR IN VIOLATION OF LAW. ANYWAY, I COMMENTED IN REGARD TO WHAT I FEEL SHOULD BE WHEREAS YOU ARE DESCRIBING AN UNACCEPTABLE STATE OF AFFAIRS WHICH YOU SUGGEST ACTUALLY EXISTS.
Civil Rights Act only covers protected groups. Media, is not a protected group. Sorry.

Anybody who audits is a hero in my books.
Every auditor will get arrested.
Practice these lines ahead of time outloud and be comfortable saying them:
1.
Am I being detained?
2.
I do not waive my 1st, 4th, and 5th amendment rights
3.
I am not resisting.
Say each multiple times at the appropriate time.
Take care. Have a security plan. Let someone know your plans.
Do not film on your primary phone. Phones and cameras are regularly seized and held for no reason other than to hassle the auditor. Any equipment seized by the popo may be infected with malware and tracking software.
Back up your videos off site.
We live and learn.
Watch lots of other experienced auditors.

The tinting on the window is creating privacy from normal viewing. You cannot properly see into the building from a normal viewpoint.
You mentioned the blue line flags but didn't say a word about the red line flag......
That isn't true. I stated that I didn't know what the Thin Red Line flag meant and if someone knew to put the information in the comments section. I was told that it is for the firemen and women.

You have no right to film inside private property. That requires permission. But you can film from the sidewalk.

Have you thought about checking out schools. With the school shootings and guestions on safety measures ect in place that dont seem to be working it be extremely illuminating see. They are after all public. Especially before school starts or when it's on break.
There are school shootings all the time in blaq neighborhoods but you don't hear about that do you? More than 20 this year alone.

Yep, as I have replied to supporters of the tactics of this "auditor", by tinting the glass, the owners of the business have created privacy. The only way to negate the tinting is to press the camera up against the glass. In doing so the "auditor" may well be inside the boundary of the property. I agree totally; they invaded the privacy that the business had created.
