  • First trip into my famous gold claim called Pickerton for the season, and I found Claim Jumpers had hit the site yet again. This time they left their equipment. I also found some great gold!

    The Mines Act says the claim holder is responsible to remove all equipment from their claim. You obeyed the Act.

      @@tonymontana3742 you ask. Uou check with the local authority (ministry of mines in the case of BC). Look for signs. Don't work the area if you're unsure.

      @@tonymontana3742 *EVERY* claim is a specific designated area, with GPS down to to centimeters (Or less accurate inches if your a bit slow) your ''claim'' (A legally registered one) is inviolate, these were claim jumpers, 101%. Not only that, the fact they left their equipment there meant they intended to reoffend, and continue to illegally claim jump. It's probable that they are local, saw Dan's prior vids and decided, ''Hey, we can be rich too, since we are too dumb to actually work''.

      The Mineral Titles Online web site will tell you who owns it and may contain contact info. I do not mind people panning on any of my claims, just ask and clean your garbage up.

    By all means dan, take their gear. Dont feel bad, they were stealing from you. As far as giving it back, that is a really tough decision, by giving it back to them they can simply continue stealing gold from either you or someone else. By confiscating it permanently, they'll have to go out and buy new gear, thereby teaching them a costly lesson.

I look forward to the day that everything on the earth is "owned" and new humans will simply have to work in perpetual servitude for the "owners" of everything.
      Again, by what right is is his? Because he paid money to the local gang that has monopolized violence in his area? Literal natural resources that you can't pick of the ground because it "belongs" to someone else. Wild shit they convinced you all is perfectly normal. What happens when that whole river is "claimed?" Everyone else gets to just stare at vast stretches of unused river under threat of violence if they actually try to pick up any rocks?     I think your Idea in regards to the equipment left by the claim jumpers is a brilliant solution! I would be interested in an update in a future video especially if they ever contact you!
    I also love that you could use this bad situation for something good, by talking through the situation you were able to drive channel engagement with all the comments people have left with their opinions on what you can/should do. Well done making the best out of a frustrating situation!

      Infringing ignorantly on another persons claim is a tiny offence. Theft / larceny and possibly even conversion are serious crimes and torts. You're dangerous if you think finders keepers isn't just a spiteful thing children say to defend their theft of property.

      Only an idiot would call him up and risk or force being exposed over a few pans which are only a slight expense compared to most of the other equipment prospectors use. It's not worth it. Just claim it and be done with it. Were they to be exposed though I would demand the courts require them to clean up all the trash there under the watchful gaze of an armed mountie.

    Thank you for the episode! Take the equipment. It is on your claim, and compensates you for the clean up of the trash they left. If they contact you, give them the bill for trash cleaning.

    I agree with the caveat option. One of the most effective ways to deter these types of people is with personal interaction. Just calling them out isn't enough. They need to put their "big boy" pants on and fess up to their mistakes. Accountability is key. Good luck.

      I agree with all those who say you are ENTITLED to confiscate the equipment they left, but I'm guessing that making them talk to you is more likely to shame them into stopping their illegal activities -- at least on YOUR claims. Of course, they may no longer be capable of shame. We simply can't know. 😞

    In the UK we would class it as fly tipping. Leaving stuff on land that you do not own, without permission is littering. It's not stealing you are doing its cleaning up. You could always leave a note (on a sign pegged into the ground at the spot) saying you handed it into the local police station if they want to collect. Then tell the police what they were doing as you hand them the stuff.

    It's littering what they left behind. You are just cleaning it up and keeping what is reusable. No difference from when people pick recyclable cans, bottles and glass for the refund in deposits and they find tools, supplies and list goes on. Keep everything, sell or donate what you don't need. Your inner mind battle just shows how good of a person you truly are. Lots of us have those battles internally, don't feel guilty, keep being you.

Lmao The stuff left behind was left by trespassers, they were doing illegal acts, the claim/ land owner cleaning it up is inconvenient but keeping or discarding or selling the stuff left there isn't illegal. It would be stupid and irresponsibly to leave it and let nature wash or blow it away, and the potential risk to wildlife is cruel. Its okay, I understand, you likely are doing illegal things or friends with criminals... Don't trespass, don't leave trash. Facts here....I found a hockey bag full of gear on property that the owner of the bag dropped off their truck when trespassing and doing 360's all over a field. The rcmp told me to keep it, I could either find the owner and press charges, keep the gear, sell it or donate it because who is stupid enough to admit to a crime, and pay for the damages or costs to collect the items... I donated it. I found your comment hilarious along with your assumptions and logic. Have a good day litter bug.

    My opinion is if it's on YOUR claim, it belongs to you. You found it on your property, so it's yours. They should've respected your rights to it.

      a claim is not OWNERSHIP of the property, property ownership is called fee-simple and comes with a title, he does not own anything but the ability in the mining lease...

      @@bashkillszombies I think you should go back to school, Dan does not have a fee simple, it seems you need to go back to school since these are very different rights, the right you are focused on Dan does not have. now a days it seems changing the topic based on your own definitions seems to be the real problem, this comes from a deep lack of understanding, not just a simple mistake. do you know the different in the 2 titles fee simple vs mineral lease?

      I have been told by the ministry that if I find mining related debris on my claim not only can I remove it, I should remove it and I can claim the work of removing it towards the title for extension of time.

    Dan you have every right to confiscate their stuff! I used to confiscate the claim jumpers stuff whenever they went on my claims back when I had claims. I wish I lived in Canada. I would definitely give you a hand and I wouldn’t charge you or wanna dime to help you out. It would just be a fun adventure.

      @ProspectiveProspector you are making these accusations without even reading the laws pertaining to this situation. Section 19 of the mineral tenures act explains the right to access, and land owner notification. Written consent from the land owner is not needed. The actual legal procedures here were followed, and confirmed by the ministry or mines. If you want to give any more of your Psedo "Legal Advice" at least read the BC Mines Act and the Mineral Tenures Act. And maybe, just maybe you don't know this situation or our laws as well as you think you do. The Private land is only covering the trail in, the claim is on crown land, there are laws about abandoned equipment on a claim. And the above land owner or agents of theirs can not pan on this claim without my consent. Period!

    Dan, when I first saw your videos I thought that you were a bit over the top..but I'm an introverted type of person. I've grown to really like you. I've been going through a lot of dark times and have seriously thought of checking out for good. Putting this video on, first thing in the morning here in Australia, has brightened my mood substantially.       Maybe you need a big change in your life. Checking out isn't the answer. Think about making a big move or doing something different completely out of your normal comfort zone , (nothing shady) but it could be just what you need to feel alive again.

      Often folk will allow their feelings of disappointment with others make them think ending their life would be easier. No. Nope. Don't do that.
      Get outdoors and find the miracles out there. Visit the nice people at the library for a good book.. Ponder what you love to do, then do it...or study about it. Hate your job? Change it. Don't wallow in negative thoughts. Challenge yourself to think more positive thoughts. Life changes in a flash. Hang on and ask God for guidance. Your gut will lead you to the right path for life's journey. Drugs and alcohol destroy the path. Avoid.
      I hope you let the sun shine into your life.

    Dan, it would be great if you could devote part of an episode to educate us on how to stake a claim and the importance of doing so. Hopefully this would enlighten those who ignorantly buy some equipment and randomly start panning and high-banking along the Fraser. However it looks like the claim-jumpers you found might have been doing it in full awareness of their criminal actions. Love your videos and your appreciation for our natural wonders in BC.

    Hey Dan, long time subscriber (although on my other account), just a quick tip for the metal detector (you may already know it) - I've been detecting for about 30 years now so have a little experience, and living in the UK, we have HUGE amounts of Iron and dirty signals in the ground due to thousands of years of metalworking that has taken place through the land.
    If you have a suspect signal that seems tempting but also occasionally flashes a ferrous signal, turn on your discrimination for iron (if it wasnt on already) rotate yourself 90° to the target and swipe over the area again. If the signal is 'clean' in one of the positions and disappears, clipped or broken in the other, you can guarantee its going to be junk piece of iron or other ferrous containing material.
    You probably already know this, but figured I would suggest it in case you didnt already know 😊

      I lived there from1987 to 2008 and within that time I saw a drastic change in the lake, the shore line. I never thought I would see so much trash left behind by people. The same goes for the lakes in the Sierra Mountains. It was heart breaking. Don't get me wrong the mountains are beautiful to look at but hiking trails and lakes have changed. It's going to take everyone to pack out more than the pack in to clean it up.

      Best advice yet. If you "confiscate" their stuff you open yourself up to a legal world of hurt. And criminal charges. I wouldn't even take it to the police, I'd call the police to me. Taking it could still cause problems.

    Taking the items off the land is the right thing to do. If you feel bad, then donate the items to a local school or panning club. Encourage/promote those who pursue the hobby responsibly.

    Just an idea to deter claim jumpers and help the channel and veterans.
    If you’re so inclined you could run a competition on the channel for veterans in need who could win the chance to be taught by yourself to (camp on site) pan the river for a set period of time and keep what they find and in return keep an eye on your claim while you’re not there.
    You love panning, you love teaching and you have a distaste for claim jumpers. Just an idea but it seems to fit the bill.

      This is a similar offered that a lot of us costomers have offered to a store we frequent. They have been robbed 3 times this years, smash and grab style, at night. So many of us have offered to chill in the back, armed, and await the next attempt by the little punks.

    You had us all in that yellow piece of tin can. lol keep in mind that ethics, morality and I believe written laws all dictate you did the responsible thing Dan. You are the claim owner therefore you are solely responsible for removing any and all mining equipment. In the event the government inspector would have found that in your registered claim you could have been issued a written notice or plausible fine. It wouldn’t be the first time that Claim jumpers have gotten responsible claim owners in trouble. Well done sir. Great episode

    I mean if you look at it as a trade instead of stealing, they technically left the gear as payment for the gold they took so you legally own it in my opinion. Fair trade, make them get their own gold somewhere else to buy new gear

    Hey Dan, great video. Would have loved to see some more fine gold panning in this area, looked like a good spot. I hope those jumpers didn't steal any of the nice pickers that you could have shown off. Above all, I really hope that no one that watches your channel would be the ones stealing from you, that just feels worse. That yellow tin can made me laugh, I wonder if the rest of the can has tricked other people throughout the years too. Keep up the great videos, I'll keep watching them.

    Really positive video, It used to be in the BC mines act that if you held a valid free miners licence you can pan on another one's claim. but you could not use any tool to fill your pan, also the free miner's licence allowed you to carry a hand gun for protection against wildlife.

    Hey Dan,
    Love your channel!
    I've been wondering about the gold you find at Pickerton. Most of it is hammered very flat and has obviously traveled far from its source. You have speculated that it is coming down from older riverbed deposits along the hill above your claim, and then is being reworked by high water.
    There seems to be a HUGE difference between high water/flood level and normal/low flow on the Fraser right there (I would guess about 20 meters from the exposed banks). That much extra water would create MUCH faster currents, which would also be violently boiling and swirling. These might be strong enough to lift gold flakes off the bottom of the channel and swirl them like leaves up onto the steep boulder strewn banks, where they fall out.
    I don't know if this could explain your heavier pickers, but maybe some of the finer flakes are "float" gold. Fun to think about.

    From my understanding of the B.C. mining regs, panning is not considered mining, it's test work. If someone is panning through following a lead there's not a whole lot the ministry will do. But if it looks like they're setting up shop, and excavating a crater, then they need a little free room and board at the crow bar hotel. Any gold that they have on them, may be including a few fillings should go to the claim holder.
    It's very easy to find out who owns the claim, and politely ask for permission to go panning.

      Actuallly BC rules are very clear about what this. You cannot pan either recreationally or for prospecting purposes with claim owners permission. Very clear in the regulation.

    Early comments are non-sensable but I'm looking forward to the video. Having a property in the middle of nowhere has got to be a nightmare to keep an eye on year round. Hope they get years but I'm sure it'll be a slap on the wrist. We need deterrents.

    I love your videos, you have reawaken the inner rockhound in me. Unfortunately I live in a area where there is simply no gold or pretty much anything to pan for. I shall continue to live my dreams through your videos. As for the claim jumpers, well the dirty rotten scoundrels deserve nothing but a long stint in prison. You do take a bit of a risk putting yourself out there, but you also have illustrated in the past where they can go and pan at no charge... free is free without repercussions.... I admire your sense of morality... even bothering to carry it out to preserve the area... I salute you sir...

    I would consider the claim jumper's equipment "abandoned" and free to take. I do like your strategy of offering to give it back if they contact you. Perhaps they can get a pair of metal bracelets, too.
