    As long as Bob's able to dial a phone or communicate with a fellow inmate, neither the Durst family nor the witnesses against him will be beyond his reach for the purpose of retribution and vengeance. He's also been the beneficiary of a personally constructed form of tribal loyalty that has denied justice to his victims and their families. Blind loyalty to him earned his victims a bullet in the head. If he walks away from this trial, as he told Nick Chauvin, it will be him or them. His body is shot, but his mania is relentless and fully funded.

    I've watched a lot of trials over the last 10 or so years. Sometimes even thought I know the defendant is guilty the Defense in closing almost has me doubting. This defense is atrocious!!! No way he has convinced the jury he's innocent!! Just awful

      Durst’s case is nearly impossible to defend. Don’t confuse that fact with the competence of his attorneys. They have presented EVERYTHING that was available to them to create doubt. They attempted more than was allowed by the judge. I agree that part 1 of the closing argument was weak. I suspect that it was intentionally brief and focused on emotional appeal given the overbearing weight of circumstantial evidence and apparent guilt of their defendant. They are saving their stronger argument for Monday’s closing. It won’t be enough. Not because they are atrocious. The problem is insurmountable.

      Yes...that's why it is important to watch people's behavior. The fact that Durst's brother hired security is a VERY telling piece of information for the jury. His own brother is afraid of him and knows that one has to protect themselves from anyone in Robert Durst's crosshairs.

    Mr. Lewin is right. Mr. Deguerin is used to being the top dog attorney in a Texas courtroom where this would definitely be overlooked. He doesn't know how to handle someone like Mr. Lewin. To be honest I expected more from him really. Even though he doesn't have much to work with.

      20 years ago he was maybe worth the money, but DeGuerin is not the man he was 20 years ago, and should not have tried this case. He may have been the only one willing to, though.

      He was asking for attention through his actions throughout his life. If he wasn't such an evil narcissist and hadn't loved the attention, he would have done the honourable and decent thing, admitted his guilt and told the McCormack family where Kathie lies. Horrible man, would have loved for him to be convicted for Kathies murder, too.

    Give it a break about the sick old man. He didn't have to testify. I agree he doesn't look well. He sure has fight in him though. When his voice would get hoarse it made him seem weak. I wonder if he was using that as a tactic. He was conniving when he was younger and conniving as an old man.
    The statement about him being 'different'. That's an understatement. .

      His demeanor changed depending on who was asking the questions ... he didnt seem to have a hearing problem when his defense team were asking but WHAM suddenly he is deaf as a post .. he changed his posture to look weaker amongst other subtle changes. What sickened me the most was when he attempted to insinuate all his behaviours was due to being on the spectrum ... there is nothing this psychopath wont do ...

      He really did have to testify. Lewin essentially left them no choice but to put him on the stand because it was the ONLY hope they had to counter his statements to Jarecki and Lewin. If, after the defense opening, they *didn’t* have him testify, then Lewin could have attacked the lawyers themselves for everything they said they would do, but didn’t. They were trapped. It was an absolutely stunning move on Lewin’s part.

      Lewin loves to talk lol. He is a good prosecutor, but he could say what he wants to say in about 1/2 the time and lose none of its effect. In fact it would be more potent if he shaved off some of his repetition. DeGuerin needs more structure, jumps around too much.

      No. The jury was assembled early last year and served for a week (opening arguments), but then the trial was postponed for 14 months. They started the case up again in mid/late May of this year. So technically they've been "in court" four days a week for roughly 4 months in total.

      I found the first part of the trial on You Tube from over a year ago. (March of 2020). The original openings and some testimony. Unfortunately, the one or two days of testimony were in audio only. Opening were on video. I believe this is the same jury from March of 2020 when the trial was postponed because of the pandemic.

      You know, it’s funny, because if you listen to his statements outside of the jury’s presence, it’s clear he absolutely thinks Durst is guilty. He literally called this a “confession case” rather than a circumstantial one, and he said he knew Durst had perjured himself.
      He IS a bit hard on Lewin, but I think, honestly, it’s because they both enjoy the challenge. He actually defers to Lewin’s expertise on matters of case law.
      I think the reason he is somewhat lenient with the defense, has even “helped” them in some instances (“make a different objection”) is because he didn’t want any chance to have his decisions overturned on appeal. DeGuerin and Chesnoff are not CA lawyers. They are poorly educated on CA case law. Windham has tried to make sure that their ignorance in some areas isn’t grounds for claiming incompetent defense later on.
      All judges have an ego. It comes with the territory. But he’s actually one of the most reasonable ones I’ve ever had the pleasure of watching.

    Thanks for sharing the trial. It was anxiety provoking to watch Lewin most days but the closing prosecutor was more than tolerable and did a great job. I also felt the defense attorney did a great job today.

      I disagree. Defense attorneys are not their clients. I wouldn’t ever call them trash for doing their jobs. If we didn’t have them we would be in big trouble. I may not agree with who they are representing but to demonize them for defending any citizen, regardless of what we think, is wrong. I can see being angry when they are seemingly so behind their clients but they can lose their licenses for not defending vigorously. This defense attorney is doing exactly what he swore he would do.

      Yeah that’s never good to do and I agree. The Travis Alexander case was like that but I think most of it came from the defendant there too. I’m not hearing too much from them on Kathi or Susan other than to say they weren’t perfect people. Bob bashed but his attorney just said they weren’t perfect. This seems reasonable since no one is perfect but after we die we become that way somehow. Doing coke in the 80’s was practically a norm for example.

      @@dianac2498 @Lara Desautel they're doing a good job defending alright, but @Werner Colyn is right. They cannot by rules allow a client lie on the stand, risking disbarment if caught. They absolutely broke that rule, among several other rules that are way over the boarder of being improper.
      DeGuerin himself explained what he thinks about lying on the stand in NBC's dateline episode "Robert Durst: The Secret Tapes". Listen to what he says, he absolutely is dishonest and uses dishonesty as part of a strategy. The "piece of human trash" can be inferred.

    Terrible beginning to defense closing. Very disjointed and confusing. Unfortunately for defense the prosecution has shown all the lies Bob has told in his own words in audio , written form and videotape.
    I don’t think this defense will convince a jury unless they are as stupid as the Texas jury. Let’s hope bit.

Unfortunately, humanity has any progress in a better life inside his wall, his house or school, or jobs. In this case, domestic violence is not only a simple word, it collects the screaming of children, wife, grandparents or men who live in terror, maybe all their life. It is not depends of money, it is about characters and personalities togheter transforming a life in a toxic environment.

    This is shameful. Durst chose to testify. The prosecution cross examined him…which by the way mostly took nine days due to his “reading the questions” aka “buying time to answer”. Durst lied so sloppily that every lie led to at least ten more questions. I know the defense is just doing their job and they don’t have a lot to work with but this is beyond desperate.

    I am not sure what the verdict will be. We are told that how believable 'witness' testimony is what determines guilt or innocent. The State had many believable witnesses in my opinion who testified that Susan Berman told a number of people that Durst was involved with Cathy's murder. There was also evidence that Durst knew the authorities wanted to speak with Susan. There were other witnesses who testified that Durst himself said he killed Susan.....If the jury believes those witnesses then I believe he will be found guilty.

    Over-whelming evidence Durst did it, laid out really clearly by the first Prosecution closing statement. I was worried Lewin had muddied the waters by going after every lie and inconsistency no matter how irrelevant, but it was properly pulled together in the end. Degurin was terrible, looked ill-prepared and only had one substantial point about one of Durst's confessions (to Chauvin). Weighed against the prosecution's detailed presentation, it got Durst nowhere. It's true the Defence doesn't have much to work with, but they've done nothing. They let Durst testify, ruining their chances of just sitting back and saying case not proven, and they've offered no alternative theory or exculpatory evidence. Who knows what the other Defence lawyer will come up, but it's hard to see how Durst can possibly get off. Hard to see how he got off murdering Morris too! He's a cold blooded serial murderer.

    I just think it's funny how Lewin is acting like a child and objects each time he doesn't like what he hears from Mr. Deguerin's mouth from his closing argument. I don't remember hearing Mr Deguerin ever wasting the courts time objecting each time time he didn't like what he heard from the prosecution mouth.

      He literally objected to nearly every question during Durst’s cross examination, despite being overruled repeatedly AND knowing the objection had no merit. He’s making unethical statements in this closing, and Lewin is right to object.

    I am listening Mr. DeGuerin with all my fully attention. His strategy is to split this case in three parts. Dissparition of Kathy Durst, Susan Berman murder and accidentally death of Mr. Morris Blake and his dismembering.
    Mr. DeGuerin wish to focus attention of Jury of these case, separately with any relation between them and with Mr. Durst.
    But life is made by seconds, hours, days, months, years during the persons in a relation release feelings, do actions and collect different memories and frustation, angry, mercy, fear.
    He neglects just this main topic. Mr. Durst was deeply involved in these relations and he tried to exclude everyone who know more about his facts.

    Love John Lewin. I love the way he holds these Texas “good ol boys’” feet to the flame. It’s probably one of the only times DeGuerin has been held accountable for bad behavior. Lewin’s right, DeGuerin’s closing was a performance to win over the jury. Too often DeGuerin lies and twists truths in the hopes no one calls him on it. The defense has met their match in Lewin who does not miss any of their shenanigans. And Mr DeGuerin? Lawyering is only an honorable profession when it’s done honorably. Looking at your list of clients, (David Koresh, Tom Delay, Kenneth Lay and Jeff Skilling of Enron) your honor is debatable.

    I think both defense and the prosecutor did a good job in their closing. It was smart from the the state to switch Lewin in the closing. De Guerin could have been more forceful but he does make good substantive points.

Or you would write a cadaver note instead to get out on the streets for helping your best friend? You would capable to leave the house of your best friend, maybe alive??? You could exclude all the possibilities to find a car, an emergrncy, a neighbour, a police station if you would run far away for doing this???     Listen to me, please! It is one evidence enough for incriminating Mr. Durst. He denied many times he had written that paper with misspelled Beverly... That cadavre not is the most important thing in this case. He denied using a clear tone of his voice, but in this trial he came with details related to that cadaver note and circumstances. He saw or not Susan? It is enough to his incrimination! Susan must be assessed in relation with Kathie and Morris Blake. I am thinking that never somebody could split this case in three different.

    John Lewin is an insufferable bullfart. Seriously, if this jury comes back with a "not guilty" verdict it will be solely due to Lewin's constant aggressiveness, manipulating statements and general unprofessional behavior towards the judge, the opposing counsel and the witnesses.
    Thanking my lucky stars that H. Balian did the closing arguments for this case. He's immeasurably more professional, cohesive and palatable than his co-counsel. My hat is off to you, Mr. Balian. It's a shame Lewin didn't let you do MORE of the questioning throughout this parade of chaos. 👏

      There’s no evidence she was in therapy. Durst tried to claim it was drug rehab, but investigative journalists have said that Lennox Hill Hospital didn’t have drug rehab at the time. She could have used therapy, but it was most likely not an option for her.

      to be fair blood splatter science is pretty sketchy & not enough to base a verdict on. But bashing a form of evidence that the court ruled admissible as "junk" probably didn't go over well. He should have focused on what was supposedly wrong with the specific testimony, not whether a whole field is valid.
