It would have been better to display a modified Ferrari badge (as deadmau5 did), the law on copyright infringement is clearer and has precedence. That being said Ferrari is unlikely to sue them in the first place, I've seen many a prancing moose shield and i doubt those random owners got sued
In Germany Ferrari can't put copyright on the prancing horse, because it is the coat of arms of the city of Stuttgart. So Porsche has the prancing horse also on their badge and Ferrari can't do anything about it. So if anything, Ferrari stole the logo from Stuttgart. Which existed a few centuries before Ferrari.

Uhhh no, there isn't a law that hinder Ferrari, what the people buying a ferrari needs to know is that they need to sign a contract before purchasing one, stating that they have a limited amount of things they can do with the car. You can still customize it by taking it to Ferrari's tailor.
I don't believe that Ferrari or ANYONE can force anyone into a first sale agreement, or block modification of any kind. Once it's yours, you can do anything you want to it, including modifying it, destroying it, or selling it to someone else. I'm not renting or leasing a Ferrari, I'm purchasing it, and once it's mine it's mine.
You can make the sale of the car conditional upon an agreement to engage/not engage in certain post-sales behavior. If you are purchasing a Ferrari from an authorized Ferrari dealership, you must sign such a contract as a condition of sale. If you are acquiring a used Ferrari from elsewhere, obvious those contractual restrictions don't apply. However, they always have the option of blacklisting anybody they don't want to sell to because they feel that person has disrespected the Ferrari brand. And the reason given for Justin Bieber being blacklisted is wrong. As far as I know, he worked with a dealer to purchase a new Ferrari that was allocated to the dealer principal, and got himself blacklisted as a result. The dealer also lost their Ferrari franchise rights.
@@Goudafortuna If the contract is in conflict with national law, whatever compoents are in conflict are null and void. And First Sale Doctrine & the First Amendment kinda conflict with Ferrari’s asinine bullshit in the US.
I'm not at all convinced Ferrari was morally in the right against Deadmou5, and certainly not all courts would have agreed with Ferrari. It greatly depends on the country how copyright/branding/defamation cases are handled. In many countries, a company has to PROVE that they actually sustained a financial loss because of the 3rd party's actions, before the court will take any action. No matter what bit of paper they made you sign beforehand. The right to parody and make art is inalienable and well protected in some places, especially if you're not causing direct, measurable and provable financial harm to anyone. Which Deadmou5 most likely wasn't. Then there's also the question of ownership of the vehicle. Some countries say that if you buy a physical product, like a car, you have the right to modify, sell, repair or destroy that product in any way you want. No matter if they made you sign something beforehand. It's one of many means to protect consumers from unfair deals, swindlers and coercion. Like in the copyright case, national citizen's rights will often trump whatever agreement some company made you sign.
I think they could also argue that the customization was parody which is protected under the law. It's how mad magazine gets away with doing something like that.
Exactly, but I believe "in many countries" the court would declare that it is not within their jurisdiction. I can only assume jurisdiction lies in the country of origin, so while it could be true with lada or bugatti (idk), but we know it wouldn't be true with even Fiat (if they sued around like ferrari does). So, don't mess with Italians.
I 100% agree, like I thought with copyrighted stuff you’re allowed to use a copyrighted piece that you changed or modified to make it your own, especially if you aren’t using that to make monetary gains, (at least in the U.S., idk about in other countries). I don’t know the laws super well, but that I’m sure of. I get they signed some stupid contract, but yeah… Idk. I don’t really care about the contract. It’s rather pretentious. It’s their property anyways.
They kinda have a double standard with this take too because at around the 13 minute mark they talk about another person customizing their Ferrari, doesn't really make sense
Could you imagine Ferrari sending a cease and desist to their F1 team for losing a race? Like "Hey guys, that loss really tarnished our name sooo can you not?"
If they could do that, they would've definitively sued everything about the 2020 car. It was illegal to the F1 rules, they had to redesign the engine and as a result they were about the 4th worst team of the year.
this is exactly why i like lamborghini. they actually know who buys their cars and arent so far up their own ass to think the cars people buy from them are glorious, untouchable, priceless works of art that cant be mistreated or changed in any way. i hate ferrari

I've always felt that companies need to realize that after you purchase the product, IT BELONGS TO YOU, and they should have no say whatsoever in what you choose to do to or with it afterwords. It's fine if they decide that you voided a warranty and don't get their special privileges anymore, but to try and deny you the right to modify something that you own in a way you choose because they don't like it is just just ridiculous.
Well no. Since a Ferrari it is not a necessity They will explain to you the rules, you sign the rules and so you have to comply with it, simple! If you don't like that just buy another super car. Their product, their rule
@@alexx8708 well yes. Necessity is irrelevant, once you purchase something, that something belongs to you. End of story. Tortilla chips are also not a necessity, but I'm betting you would not agree that the manufacturer should be allowed to determine what type of dip you are allowed to eat with "their" chips. No matter what your argument is, the simple fact remains that it is wrong for a company to attempt to dictate what you do with YOUR property, it was purchased, not rented.

They definitely acknowledge some of these lawsuits by Ferrari are stupid, but they understand sometimes you have to do what's need to protect your business. Doesn't mean they're shitty ppl.
I have a theory.. You buy a car, and then it's your property that you can do whatever you want with it within the laws of the country you have it titled in. Ferrari's only rights beyond that is to refuse to sell any cars to that customer in the future.
If Ferrari used 1% of the brainpower from the lawsuits that they use to preserve their ego, they’d actually hire talented engineers, put together a team that adapts to the future, and win more in f1
In Northern Ireland, there's this trend of sticking replica Ferrari hubcaps on your alloys (I don't know why, I think people just like the yellow colour). But it's quite hilarious if Ferrari take it seriously and start suing farmers and their stanced Jetta's and Golfs.

Deadmau5 didn't "infringe on their intellectual property" by having the modified logo. It's not copyright infringement to have something like that, just to sell/distribute it. So he may have been in violation of some sort of eula but def not copyright. The company that made them for him, on the other hand, may have been in the wrong.
Absolutely *LOVE* the channel, and the show, but: You guys mixed up copyright and trademark. Failing to take legal action over copyright infringement does not invalidate your copyright in anyway or set any legal precedent. Failing to enforce your trademark does. In this case, this was all about Trademark. But even then, I don't think Deadmau5 really infringed on Ferrari's trademark legally, I think he just breached his contract with them. Trademark infringement would have been using Ferrari's trademark improperly (eg: putting it on something that wasn't a Ferrari)... removing it isn't using it.

The story of Maradona's black F40
When Maradona was playing in Napoli, he wanted an F40. His manager met in person with Enzo Ferrari at Monza and they argued a few hours about getting one (the original 400 units were sold out). Finally he got the OK, but when Enzo was leaving, Maradona's manager whispered "he wants a black one". Enzo went crazy, at that time there wasn't black Ferraris straight out of Maranello. At the end they agreed on getting a red one and he could paint it on his own.
A few months later, Maradona won the World Cup with Argentina. When he was returning to Italy after such achievement, he was greeted in the airport with a black F40 straight out of Maranello. The fun part, when he got inside the car he literally said "this shit doesn't have a stereo".
... and then Maradona snorted a kg of cocaine right from the car hood. The end!

Yea you sign for that in the contract when buying a ferrari. Otherwise they won’t sell it to you. Even though I agree with you.
@@alfredofernando6445 HOA's "you have a problem with that?"
@@pleasedontwatchthese9593 I guess Ferrari got their will due to the contract you need to sign when buying a Ferrari.
Just like here in the Philippines. The Prancing Horse is a popular emblem that they would stick it to anything from hand tractors to tricycles-for-hire to jeepneys. Even dump trucks.
It's even worse than you think, you might not have noticed but generally speaking those Ferrari badges are on replicas of Ferrari wheels (most common is the 458 wheels) 😂 Double law-suit!
The way they go from “it’s HIS car!” To agreeing with Ferrari’s BS fine print was confusing.
honestly.. also how does the purrari logo not fall under a parody?
i was confused why the f40 mod just had to remove the horse, but the purrari had to restore everything
@@collinbrown5751 the only thing I can think is that Italian law must be different
probably think they'll get one. f-ferrari.
@@Appletank8 probably because what was altered on the purrari was badges/emblems. While the yellow abomination was custom built, fundamenlty changing the vehicle. Laying grounds for ferrari to claim its no longer a Ferrari so it shouldn't carry the badges of one
“This is essentially like making fake Jordan’s”
No, it’s like making Replica Shelby Cobra’s. The real deals are millions of dollars and hard to find, and not all of them even had a 427 FE, some had the lower hp 428. So making your own gives you the power to make it exactly how you want it, and add your own customization/authenticity to it. For a HUGE fraction of the price.
Imagine if other companies sued you after you bought their products. You can't use that refrigerator how you want. GE will sue you for $300,000 because they don't like sliced ham.
LOL TRUE
and absolutely no fridge magnets can be put on our fridge! HIDEOUS
They can just like john deere if you modify it to use non-certified water filters or whatever. The only difference is, they most likely won't bother
yes yes, imagine how done one has to be to recognize what 'brand value' means.
Lamborghini be like: Ohhh you twin turbocharged your Huracan? Wow nice! We glad you enjoyed it!
I no longer feel bad that I can't afford a Ferrari.
Lol i get that
Considering those who could afford a Ferrari cannot buy Ferrari, let's say a bullet is dodged.
What I don’t get it you buy the 500k Ferrari and you basically can’t do anything to it even though YOU bought it with YOUR money.
Holy crap it never occurred to me just how tall Jerry is, or maybe how short Nolan is. Either way, that side by side and that whole promo ad was rather comedic 👌
I think jerrys high heel shoes helped out a bit ahah
Just a suggestion, it would be cool if one weekly donut segment was called something like "stay on track" or some pun like that, and it was about updates on what happened that week with all kind of racing that's active in that current season. I could host it if you need 😂😅
This sounds awesome!
It doesn't matter if they're in the right or not, getting in lawsuit over pitiful shit, it's just bad PR.
The Ares one is great! It doesnt matter who was wrong or right in that case. With how many lawsuits Ferrari starts and wins, its nice that a smaller company was able to win a lawsuit against and make a big ass bully of a company sit there and take it
Day 100 of asking Donut media to do either a Up To Speed or a Wheel house on the oil crisis
No... i don't wnna go down that rabbit hole
Lmao the bots
I want an up to speed on Hyundai
Used to have respect for Ferrari for making high performance cars. Now they’re a joke to me. Thanks for the great video!
Just go to Lamborghini 👌 much nicer cars and you won't risk getting sued over stupid shit.
If they can get my boi Sainz in contention for a championship, I'll forgive everything.
@@birisuandrei1551 you mean rebadged Audis? 🤮🤮🤮🤮. Dont get me wrong, they are a great brand but there parts are from the VW group partsbin and do not have the history & passion of a ferrari
@@brakinglate8828 yet as of rn, Lamborghini designs look much better, they are more powerful, they are cooler, more innovative, only thing they aren’t is as handcrafted or elegant as Ferrari
@@brakinglate8828 there's nothing wrong with having parts from other companies, everyone does it except Ferrari i guess. I'm not a fan of supercars in general, they're unnecessarily powerful and fuel inefficient they're a sign of greed and Ferrari Is even more ugly cause they capitalize on their greed to control everything and make their car seem like the finest there is when in fact Lamborghini, Koenigsegg and Bugatti are far better (as i said before though, those are also unnecessarily powerful) also heard about Tesla model S ? It's literally one of the fastest cars at going 0 to 60 km/h and it does that using way less energy than whatever Gasoline 16 cylinder monstrosity you'd love to drive.
It’s ironic that they sue people over stupid stuff to protect their brand and all it ends up doing is turning people off to buying a Ferrari
Mmh looking at their trend sales I don't think people are stopping buying a ferrari
They just don't need a certain kind of unrefined unclassy people. And they do good in this.
They don't know about this that's why. There heads are so high in the clouds, ignorance is bliss.
Ferrari: Very Iconic, f1 and Le mans classic, have more exotic cars.
Lamborghini: Makes powerful road cars, makes good engines and makes some of the best looking cars.
I've definitely seen Ferrari badges on a few Fieros in my life.
There's is an MR2 in my town with ferrari badges
In my hometown there was a red Mazda 323F with Ferrari badges :))))
Y'all are way behind. In my city, there are BUSES with Ferrari badges
I've definitely seen my handful of ferrari badged cars on marketplace
I've seen it in a large variety of fiats
How to get sued by Ferrari:
- get a Ferrari
- call it "Fredo"
James should do a D list ranking all the license plates in the US 1-50
That would honestly be awesome
I'm really curious why Ferrari hasn't been sued by buyers or other CAR CLUB class action lawsuits, hurting the right to buy a car or the freedom to customize a vehicle, etc.
The Fair Trading Commission doesn’t care?
You can tell these guys have lived in California for to long.
Bottom line if you own the car you should be able to do whatever you want.
Change the logos, take a picture with some ugly shoes on it, sell it to some homeless guy for a dollar or modify the car.
It is kinda funny seeing them talk like this when they enjoy modifying cars lol
Nolan is from here ya doof
Milk delivery got me...
Sal Esman is my new favorite donut character now.
You guys NAILED the 90s toy commercial vibe for the kove ad.
Well played, got the nostalgia kicking.
Ferrari is like Nintendo.
They need to move into the 21st century
I was thinking of that too
14:36 Ferrari Legal Dept. bit 😂😂😂 hilarious!
Wrap a Ferrari with the word “Lamborghini” and a bull logo on each side and the hood!
You'd get sued by the two companies hahaha
