4000 pound helicopter is OK but not a 251 gram toy
Anybody can buy a 251 gram toy. A helicopter pilot has extensive training.
FAR 91.119 Anywhere.: An altitude allowing, if a power unit fails, an emergency landing without undue hazard to persons or property on the surface.
this is the rule for the helicopter or an maned airplane.
noob question: Where does a 20g tinywhoop w/ prop guards sit within these regulations?
I don't intend to zip around people, but I do like to fly downtown sometimes with people walking by.
Thanks for the info. However, the info is just vague enough to state what the rules say. What about doing an orbit around a group of people from say, offset from group by about 50 feet? Or hovering from this same distance away from the group? It must be ok because it wouldnt be directly over them right? No one answers this question.
Correct. If you’re not directly over them, then you’re not violating the rule.

But I do have one more question, if I was going to do a map for job progress monitoring, would I be in compliance if I had the construction company notify everyone that a drone will be overhead on May ??, between ?? and ?? o'clock and advise them to remain under cover? And use my Mavic 3E, no prop guards. Thanks again for everyone's help.
Yea as long as they were under a covered structure, you'd be good!
If you are flying over people, get a cinewhoop. Then you are class 1. With the lastest HDeco FCs, you get low weight, quality image, and easy compliance.

I was at a music festival, and they had drones flying over the crowd of all sizes, none had prop guards. How did they get away with this?
There's nothing within drone software that keeps people from doing this. It's akin to asking "I saw a guy going 120mph on the highway, how do they get away with this."
The cop (FAA in this case) just didn't catch them. It doesn't make it right but many people just don't know (or care) about the FAA rules.
However, the FAA has some very hefty fines for people that they do catch doing these kinds of things so beware.
Doing these kinds of things puts a sour taste in the general public regarding drones and could force the FAA to crack down even harder if more people keep doing it which can ruin the industry.
Best thing to do is kindly alert the pilot in command of the violation and dangers associated with it. Some will be thankful and some will say get lost but it's worth doing imo.
Quintessential federal bureaucracy ... having to do ballistics calculations incorporating gravitational acceleration to make sure you're not being an outlaw. 🙄
You can in fact fly over crowds, and moving cars. What you cant do is operate over people. Example. I want to flim something. A crowd of people and a road withbcars is between me and my mission location. I can fly my drone over those people and cars to get to my mission location and back from that location. I cant operate over that crowd of people or cars. I can't constantly pass over those people or cars.
In that situation if your drone doesn’t have a category you can not transit over moving cars or people in the us
Hell yiu can fly at 3am without a part 107 or any waiver. Just have collision lights that can be seen from 3 statute miles.
Basically it seems like you can't fly over people/cars. I don't get what all these classifications are for beyond classification 1 if they all say "you can't fly over people" ? Sure, classifcation 1, under .55 lbs and prop guards. This seems super clear that if you have a drone with those specs, you can fly over people. All the rest basically say "no".
The one thing that is missing here is what classifies as “over” people. So there needs to be an altitude requirement. At what Altitude is considered over people. I looked at this a few years back. And over people was something like 12 ft.

Here’s a good one. How about CHASING a car. Just as in your demonstration the illusion of flying over can be done with a little zoom.
So if I am 10 feet behind a moving vehicle and the vehicle is traveling faster than me (so it’s impossible for me to overtake them) and there’s no traffic at all behind me. Am I good to go?.
Next one. What if it’s a highway that during most of the day is completely empty for like hours can a person fly over, up and down and around all over the street? Not flying over any cars? No cars in sight. This is the radio control enthusiast equivalent of driving your nitro traxxis up and down the street 20-30++ MPH.
As far as I have interpreted from videos like yours and the FAA website (and chat, GPT crunching everything down) I think I’m good to go. What’s your opinion?
