That plainview doctrine works both ways...and they hate that.
The plain view doctrine means that evidence of a crime which is in a place a police officer has no lawful means to search or access may grant police lawful permission to search and seize, enter private property for which they have no warrant and/or allow it to be used in evidence against you in court.
The plain view doctrine has nothing to do with citizens, it’s just a clumsy shorthand some auditors use to remind cops that citizens may lawfully photography virtually anything from a place they can lawfully stand unless there’s an expectation of privacy (like a public washroom). I wish auditors would not sound silly using it.

@@LuckyCartel They may disagree, but they are wrong. Simply look up the definition of the plain view doctrine in any search engine. It has nothing to do with public photography. Nothing to do with citizen rights whatsoever. It’s about what police may use as evidence when they otherwise don’t have a warrant or reasonable articulable suspicion of criminal activity. There’s no “works both ways”, any more than reading Miranda rights “works both ways” or qualified immunity “works both ways”.
If you think the plain view doctrine applies to citizens, you don’t understand what it is and you’re mistaken.

What is quite evident and not disputable is that these LEOs had a bug up their butt about a camera and tried to trespass a citizen with authority they didn't have. Trespass in a public area like this video can be tricky. They do have the right to trespass him BUT it comes down to 3 things, time, place and manner. 1) TIME: is the area open for business. Say a lobby of a post office is open from 9 to 5 then you can be trespassed if outside that time frame. 2) PLACE: Restricted areas. It may be public building but if at post office you go behind the counter you can be trespassed. 3) MANNER : Are you disrupting service? Even if in post office lobby during 9 to 5 you can NOT start screaming etc... if it disrupts normal operations you can be trespassed.
In this video the parking lot appears to be open 24/7 and no restricted area warnings (I couldn't see any time/place restriction signs) and him walking around taking pictures does not disrupt service and he is also allowed to take pictures so he is 100% allowed to be there and any trespass is unlawful.
As for ID you do not need give it on a warning or if trespass is unlawful. You do need to give it if you actually trespass though since now you committed a crime.

There is no crime and they don't get to issue illegal orders outside their authority. She claims they "Asked him to leave." after she realized they were out-classed.
Suspicion is not a concern for the Police unless there is Reasonable Articulable Suspicion of a CRIME. They can investigate from a distance, but they are operating on ego and feelings when they operate outside the Law and the Constitution.

I feel that this guy is striking just the right balance between being overly disrespectful and erroneously obsequious. I believe that the minute a cop intrudes on one's legal activities and starts issuing unreasonable demands, they've lost the right to expect courteous responses. He is being more assertive than disrespectful. When someone is being ganged up on by a pack of ego-driven authoritarians, I really don't want to hear them calling them "sir". I think his aggressive tone drives home the point that these clowns are powerless to get the results THEY want, even though they try to continue the confrontation.
