  • The plaintiff says he brought his sweet 1988 Mustang GT to the defendant’s shop for a paint job, but she did such sloppy work that he’s embarrassed to drive it. He’s suing for his money back. The defendant says the plaintiff told her he was pleased when he picked up his car, and she denies owing anything.

      For real. The judge was so reasonable and fair by saying - Just honor the warranty.....and she had the audacity to continue to justify her defense as to why she didn't need to honor it - when it's a freakn national chain and that should be the immediate protocol, no exceptions!

      It was so funny. If she had just stfu and taken the ruling, they could've fixed his car at cost and saved themselves money. The fact she kept trying to argue that somehow his paint just was fine and didn't need fixing showed that she was acting in bad faith.

    I like how the judge went outside with the plaintiff and defendant to look at the car. The defendant was lying. The plaintiff is entitled to getting his car repainted somewhere else.

      @@carlyy8284 I have 16 years detailing and I can 100% tell you of there is dust in the paint in one spot that every panel on that car has dust in it and it will need to be completely repainted.

      @@carlyy8284 with paint jobs you have to repaint the whole thing (segment of metal plastic. Like if it's on the hood of the car, it has to be the entire hood.) because it won't look even otherwise.
      Touch up jobs are not paint jobs. Touch up jobs are never perfect, they're always 'close enough I guess'.

    Glad the plaintiff won and doesn't have to deal with the defendant any longer. He already said he gave her one chance to fix it and they didn't. Her attitude in court says it all. Wish he had another estimate to fix it, he may have received more $$!

      no he shouldn't, part of that amt was for the labor, they did the the job albeit not perfectly but they did it and should be compensated for their work, that's the law. this guy was OCD with this car, glad they didn't give it all back to him.

      it’s now where you can’t get away with a bad job because people pay good money and want a good job no matter what business you’re n. life is expensive and quality is priority or you will shut yourself down by not performing. the customer deserves the best you have to give, if you don’t get that, don’t even start a business.
      don’t know where these people work because even if you have a simple job you should be giving 100%, just by having pride alone. a job in a warehouse or stocking shelves deserves you making things look good,

    Judge made a good call not making Pops go back to the same paint shop. She woulda kept refuting stuff and it woulda just went even worse. Smart call. She saw the personality and character of the defendant. I like Pops.

      he should've gotten the entirety of what he paid, you don't have to be a pro painter as a judge or have a defendant with an estimate for fixing the 'damages' (which would've been a total repaint) to know, as a judge, that the error would be obviously systematic, possibly both active and deferred

      Time to bust out my favorite People’s Court explanation! “The point of a lawsuit is to make yourself whole, not have a bonanza.” Presumably, there was still work that the defendants completed on the car...I’m not a paint shop or anything, but I would assume there was prep work done on the car before painted, and that’s still technically worth SOMETHING. Also, if the new shop only has to do a patch job for the shoddy spot work instead of a complete redo, that means at least half of the work the defendants did was passable, and thus they still get paid,
      It seems unfair, but if the judge awarded all of his money back, she’s basically undoing the contract, and it’s like the plaintiff never went there in the first place (which I’m sure he wishes was true). We don’t know what condition the car was originally in...for all we know, they did a phenomenal job on the roof and shitty everywhere else!

      Maaco was on Undercover Boss. Franchise owner was seriously cutting corners. This lady was a terrible franchise owner.
      Her shop did a shoddy job all the way around. While Maaco is a discount painter (a good body shop would be 3-4x that for the whole car because it’s disassembled) there is no reason an exterior paint job couldn’t be done well.

    Somebody find out the name of that paint business so we can all go elsewhere!!! Who wants to pay over 2,000 dollars for a paint job and have to keep going back for peeling paint, dirt particles in the paint, bubbles in the paint, paint overspray on the windows, etc? AND the contract, she says, states that the customer should *expect* dirt particles? Really?
    That's a less than ghetto business with paint techs that should be washing dishes and scrubbing toilets....NOT painting cars!

    I love this man. His voice is soo settling. I have a lottery customer and we actually call him pops. His voice is very calming and if you ever hear this man angry or a different tone then you know you really really messed up

    When I met my husband he had a 66 Mustang. We sold it a few years later and after 30 years we're still heartbroken by that stupid decision.

      No it wasn't a decent job it shouldn't have dust or dirt under the paint and the over spray on the windows is easy to remove but they didn't. The peeled bubble on the bumper was probably from not being cleaned properly the whole job was terrible

He can tell right away if a vehicle was hit, repainted or repaired in any way cosmetically. I learned so much from him and developed that eye to be able to pick out what that others don't see. So I understand why some people get ripped off and don't even know

      @@dougsmith6077 shoot, I was quoted 8K for a ‘65 Jeep Kaiser Wagoneer. Of course, that’s disassembling it to paint each part individually and not just an exterior overlay. Totally worth it for these survivors.

    Marilyn acts as though the money is coming out of her and her husbands pockets!     I totally disagree with the judge. She saw how the defendant was and he shouldn’t have to return to them from the jump. Then the defendant continued to lie and be unreasonable, then she makes the right decision. Full refund is due for that subpar job. She’s being cheap on this one.

    If the big chain company he went to was Maaco then I’m not surprised. I brought my car there to have some body work done and they told me that it would take approximately two weeks to do the work. I was fine with that but when it hit the end of week four… I started to get a little ticked off. After that I called them three times a day figuring the squeaky wheel gets the grease. I got my car after three days of that.

    The defendant lady appears shady. Apparently she is an owner of an independent shop with a franchise license with one of the national quick auto paint job companies. As such, she is not a representative or spokesperson for the national chain. Which is probably the reason why the name of the shop was never mentioned during this court hearing.

    The plaintiff did well to prove his case so I'm glad he got most of his money back (should be all but ok). The defendant was shady as fuck and I certainly go to her to fix dust much less a car

    I was hoping JM wouldn’t send the plaintiff back to the defendant’s shop. He’d already given them two opportunities to make things right, and at a certain point, anyone would begin to lose faith in the shop’s ability to do the job correctly. I’m glad he won.

    One of the best cases. The plaintiff was very clever and knew what he was doing. It is crass to say "that is tape" indicating you do not really give a damn. The guy is not arguing "some paints go wrong" he is saying he paid for a service and did not get what he was paying for.

    I had a 93' 5.0 and he is 100% correct! Those bumpers were a nightmare to maintain! Rubberized paint and NO DUST that no one but one got right! Great car and right on pops! 🐎 The defendant is very untrustworthy!
