I just rewatched the Netflix special because I wanted to refresh my memory. There’s an actual thing where most of the time families actually sign away any future litigation with cases like this. (Meaning hospital stays where CPS/DCFS is also involved) I can’t remember what it’s called. The reason is they get their children back quicker or whatever. But since Beata and Jack Kowalski didn’t sign this document and also Beata had extensive notes and recordings, this case was able to be tried in front of a jury. But it took years of the family and the defendants to actually go to trial because the hospital tried to prevent it, and it had something to do with punitive damages. The hospital knew it was so damaging what the plaintiffs case would be and the proof. So, they might’ve tried to settle but the Kowalskis knew their family had the most to go to trial. This same Dr. Smith along with the hospital and CPS has many cases of families going through all of this. Dr. Smiths personal malpractice suit was settled though, according to the Netflix special.
Are you watching the witnesses testimony?? I’m with the hospital now. The Netflix documentary is completely biased! I believe Kyle is the only victim there!
Let’s also not forget Beata was a registered nurse! Nobody gave her the respect she deserved and the tragedy that followed leaves many of us enraged, disgusted and speechless.
And it’s this experience with Beatta’s very well constructed and organised notes and records up until her death that’s provided the family and lawyers with the level of detail needed to fight this, without her record keeping unfortunately the family wouldn’t have stood a chance. RIP Beatta you were an outstanding mother
Dr. Smith, Cathy Bety, and John Hopkins really mis-DX Maya with Munchhausen by Proxy. What a terrible tragedy for this Maya, Byata, family, and friends 😢.
The fact that she was a nurse was a huge part of why they targeted this family. It checks off another box - female, strong, medical knowledge. It’s a modern day witch hunt that garners $$$$ for the hospitals, and sometimes the counties. It’s a corrupt and disgusting business
She took her life because she was told if Maya would EVER have any contact with her mom, she would never be allowed to go back home. This mother sacrificed herself so that her family could be together. It is the saddest thing ever.

I have crps. I woke up from my third ankle surgery and instantly realized something was terribly wrong. My tendon repair didn't hurt where it should have- yet, it was excruciating pain in my toes, heel, ankle and front shin. For 8 years I was treated with high doses of opioids. I'm now on suboxone and enduring the pain. The opioids worked until they didn't. The opioids eventually made the pain unbearable. I would totally try this ketamine therapy! Praying for justice in this case!! Praying for Maya!!❤😢
My niece has had CRPS for over 15 years. They used ketamine infusions to wean my niece off of the opiods. She still had withdrawal symptoms, but thankfully, she was able to get off them.
What blows my mind is in 2017 medical staff should be familiar with pain syndromes!! I was diagnosed in 2007 and pain conditions have become more recognised and studied. It’s crazy that they didn’t know enough about it and treatments.
You was diagnosed with CRPS? From everything I’ve gathered it’s still not a very well understood condition. It’s still so rare that most doctors never even run into it and that’s if they’re even able to diagnose it.
@adish7275 This is a totally different hospital issue going on here for Maya's situation. This has nothing to do with anyone here needing medical attention for ourselves. We will all go to a hospital to get the right medical attention that we're in need for. But on other grounds we also don't have to put up with hospital's mis diagnosed on our conditions putting up with their rudeness towards us & anything else in between. They are all getting paid regardless. So this isn't about us! Just for one example before they finally thought of this light bulb 💡. When you needed your left leg amputated and wake up to find out that you no longer have your right leg and still have your left. Doctors make alot of mistakes too. Just now this mistake from these doctors cost this poor young lady growing up with the most important person that she needed in her life 💔 now😢😢😢 growing up.
JH poorly understood crps and yet charged the family crps... That is so insane! Mom probably thought she was being targeted instead of focusing their care to her daughter, she needs to be out of the equation hence she took her own life...mother's love is so immense..much love and respect. Hope they find justice at the end.
It's very rare if she ever really had it most Doctors never see a case. She seems able to ice skate and jumps right out of the pool in the video and is dancing around why do you think the Hospital in Mexico is right and the hospital in the US is wrong.
Are you watching the trial? They were treating her for that condition but after seeing her they changed the diagnosis! I believe that the hospital saved Maya’s life. Both, Maya and her mom weren’t mentally well 😢
Another important point to this case is while the hospital where in denial of the condition CPS OR CRPS, accusing Maya of suffering from munchhousing for the whole stay accusing the mother etc, on the insurance claims from the hospital they wrote CRPS! Maya & your family I wish you the outcome you all deserve x
All that hospital needed to do was call the two Doctors who prescribed the ketamine therapy. They failed to do that one simple thing. Instead they demonised Beata and destroyed her.
I HAVE WRITTEN A BOOK on all the things I caught while watching this complete trial there are so many things wrong that we’re not addressed that this hospital did!! I am so very thankful the jury HEARD IT ALL THEY CAUGHT EVERYTHING GOD BLESS THEM!!
For myself and family we have been effective by this terrible disease in after an injury to the foot area then surgery then a blood clot my fiancee developed this rare condition. We believe you Maya we're cheering for you rooting for you sending you all the love and light prayers and Good Vibes healing.
So so so sorry for this family and others in similar circumstances. Wishing Maya and Kyle and their father Gods strength throughout this law suit and all the best for the future ❤️❤️
My son in law has a virtually unknown form of Muscular Dystrophy. And it’s killing him. It too is a neurological condition and the one thing we, as a family, have found is that when medics, health professionals etc have little or no knowledge about a condition their automatic response is to disbelieve, underestimate and blow off the condition. He’s dying and one doctors concern was that he might become addicted to mild…mild ! pain meds. He was accused of being an alcoholic, this man’s who can’t move off the bed, cannot stand or walk and he doesn’t drink…never has. His liver is damaged by the medication he takes. And on it goes. It’s almost that for some ‘experts’ their lack of knowledge is personally insulting to them and the patient is to blame.
The hospital disagreed with the treatment Maya had received from other doctor and even spoke with other doctor. That's fine. Just say that you aren't comfortable providing same treatment, and let the family take her somewhere else. How it escalated into what it did was so beyond extreme and unnecessary. I don't know how those who were part of it sleep at night.
And watch all the people who have been helped tremendously by this hospital have higher hospital bill. JH is the #1 Fl children’s hospital this year. This lawsuit was is frivolous and the family brought this on herself.
These insensitive comments are jaw dropping. Either you don’t have children, don’t know a child you love with all your heart or shouldn’t be a parent or caretaker, ever. Y’all are as bad as the people who tortured this family. Watch the documentary and if you still feel such judgement of the family, heaven help you.
I agree with you! I have read the comments posted by people who are heartless and cold, who lack empathy and compassion, understanding and kindness. They are meanspirited! Thank goodness, not everyone is like them. They have no conscious to feel what this family and other families go through, when their loved ones have the same syndrome's. When the mother lost all hope, felt helpless and accused of wrong doing, when all she did was love her daughter and the determination to get her the necessary help she needed. Being a nurse herself, she knew what she had to do for her daughter, only mistake was made, was to put her trust in JH, the doctors and social workers, they were the people who did the family wrong. I hope and pray the family wins. 🙏🏼🙏🏼
Many years ago Hopkins had an initiative to teach their doctor how to apologize to patients and families when something went wrong instead of ignoring the wrongdoing. I remember that email.
The big key piece of evidence was the hospital was denying Maya's crps yet the entire duration of Maya being held there, they were charging the insurance company thousands of dollars for crps treatment.
They certainly don't, many will cover up their mistakes, hoping Not to get caught. I know through family members of a couple of doctors in another State, both caught over medicating their patients to the point of death. One tried to flea the Country, both now serving time behind bars. I don't trust doctor's.
its crazy in the case of Gypsy Rose nobody realized it was Muchousen by Proxi until the mother was killed, and then here they couldnt understand that it WAS NOT muchousen by Proxi and Maya actually had a dease until the mother killed herself, Its like each time they want to look to wrong perspective.
By the looks of it, it seems as though she sacrificed herself to save her daughter. I don’t think anyone would have listened if it wasn’t for her, and most likely her daughters condition would have worsened until death. God bless her soul, and her family 🤍
Its not accusations against the hospital rather accusations by the hospital. This type of situations happen all the time. Families just break because of being gaslighted.
How ironic that the hospital billed the insurance company for CRPS even though they claimed the mother was lying about the diagnosis. That’s just evil!
Welcome to the fl hospital system not the first time ive Heard of threats of arrests if you don't cooperate..... hopefully this trial will change how hospital staff treat people .
Praying for you Sweet Maya and family. I watched your story too. I also understand health issues no one understands and chronic pain. I understand the gaslighting from doctors especially in Florida.
I have a question, at the documentary, hospital weren't treating Maya proper medication but claiming it to the insurance company. Isn't it fraud action by hospital that didn't treated to patient?
I would think so, why bill the insurance company when they aren't using whatever medical methods they claim only to the insurance and not the patient. Maybe the insurance company will look into this matter.
@@rebeccalasiter5429 because there were many diagnosis they were billing under and CRPS was very low percentage, it’s not uncommon to bill for a diagnosis they are trying to rule out. Ketamine is not used to treat that diagnosis anyway but they were treating her with other proper meds.
Everything about this case is heartbreaking. The hospital claims they were “protecting a child” yet so many inflicted continuous and increased harm including denying “actual treatment”. Certain individuals seemed more interested in criminalizing the mother than treating the child. The statements in the depositions and the responses on the witness stand were so ridiculously fabricated. It’s unbelievable that in the end they still denied any wrongdoing. Egos and opinions sadly held more power than actual healthcare.
These doctors, social workers and nurses, your there to help not accuse! I'm watching the documentary on this as I'm typing this and let me say, money is not enough! This family needs JUSTICE!
I wish this as well. They need aggressive lawyer's who will fight harder for the family. The attorney they have, seems weak, bored and tired. He doesn't have his work organized.
My trust in the medical community has deteriorated so much...and I have family members who are doctors. I'm so glad that the jury found the hospital liable!
Her diagnosis of,complex regional pain syndrome useds to be called RSD Reflux Sympathetic Dystrophy. It is a real thing to. Justice was done right. was a 32 year HC worker and sad how some not all lack compassion and ego and judgement along with business attitude has ruined the spirit of health care.God Bless this family and mother.
Yes, exactly. It's completely unreasonable and that's why the hospital was found guilty of trigerring this - you have to be going creazy with pain to do it. On the other hand, it worked - Maya was home 6 days later.... It does look like the mother gave her life so that her daughter's suffering could end.
It’s unsettling and indeed the ultimate action an I’m not sure if you have ever been in such stressful situations for months, but trust me in the end you want it to be over no matter how and to what consequences.
Heartbreaking is the only word that comes to mind when you think of what this family has and is going through.. They’re extremely strong and I am so happy that Beata did not sign that document that would allow the hospital to not be liable if any wrong doing..
I was tortured to death, twice in one day, at my local Virginia MN hospital. They did it in front of my aunt and left the ambulance waiting outside for over 4 hours to transport me to Duluth Nut hut. The ambulance gave me haladolfor the ride. I HAD A PNEMOTHORAX
I have mild CRPS from a distal radius fracture August 2020 where the bone had to be wired to secure it. I remember the feeling on the back of my hand was being scalded when it brushed my clothing….and there was aching pain and my hand was much smaller than my other one…but thankfully it has dissipated. I have since met children who have suffered fractures and subsequent CRPS. It is real. I do hope the family win this case, however Beata was treated in the most injurious manner and the hospital staff must be held accountable. The social worker, especially, as it sounds like some staff fell down a rabbit hole believing that this was a case in Munchausen by Proxy…this is an example of tunnel vision, with such tragic consequences for Beata, Maya, and the rest of her family. 🐑🐑🇳🇿🇳🇿NZ
It’s neurological. Parents can’t SEE any disease! Horribly tragic what happened to this little girl and the way the social worker took charge OVER THE DOCTORS recommendations. Kids don’t fake this.
Money won't bring their Mother back. Maya is heard and believed, and her Mom being vindicated from all the lies. That made their hearts relax a bit. I watched the video when the verdict was read. Their faces just warmed my heart. The money will make things a bit more comfortable. I hope they all have some relief from all of the stress and do something to decompress. Yay for them
The truth will set them free. Only God really knows what happened. Praying that the family gets their justice. I'm so against hospitals and unexperienced doctors. They did something like this in ohio to my friends baby. So sad.
We need CPS training for attorneys, so more will take these cases and win. Try calling 100 attorneys and ask if they will take a case to sue CPS. You are out of luck, nobody handles these cases, and they don't know anyone who does. There is no place to complain to that isn't government run. They won't find fault with themselves, they dont want their state sued
I dont trust that hidious hospital after learning about this. Never again will I ever look at a childrens hospital as a trusting one. No way. That evil place. 😢
If Kowalski's attorneys digged deep enough, they'd find a very lucrative contract between the hospital and CPS. This medical kidnapping happens constantly at Phoenix Children's Hospital and yeah, there's a lucrative contract between Arizona Department of Child "Safety" and PCH. In our world it's called trafficking.
Sp sad the mother took her life from the stress of her daughter being sick .she felt helpless and beaten down . And hospital and all involved nurses social worker and that smith freak of a woman needs to be all fired and sued.
This case is one of the worst display of “smart, trusting people, swinging their Richard 🍆 around and digging in. What makes the states doctor more qualified than the doctor they were seeing (who was listening to and helping them)?
If there are anything more sickening than Münchhausen by proxy, it is to falsely judge, decide, that a parent is making his or her child sick. Maya is looking like a very sad a-list super model, by the way. I hope she finds peace.
I watched this case with great interest. My husband has had severe CRPS since his foot was crushed in 1994. He has all kinds of treatment including physical spinal block. It has taken his livelyhood and mobility away. It is a central nervous system malfunction and a milder version has passed to his uninjured foot. Maya was not faking. The hospital's behaviour was disgustung and I believe they are responsible for her mother's death.
Crazy how many mistakes happened among medical staff, how many times they did not show empathy or acknowledge that beata was a nurse and her daughter had been suffering for a long time. The family was let down at every corner
I would love to know if she had had any inoculations right before this "light bulb" switched and she started having these symptoms. That's very intriguing, and I would love to know the answer.
I'am very concerned about the attitude of people towards doctors and the hospital,. I see the hospital not negligent which is what I believe has to be proved. This is a emotional sad story but the hospital doesn't seem to be to be fault. Lots of decisions these day being made on emotion alone. That is more concerning to me than this trial.
@@4H2O4EVER gotta use logic not emotion. I do kinda feel sorry for dad cause I think mom was running him. That being said, and it sounds mean, Maya is doing better without mom. Mom needed help.
When someone’s mental health is affected so deeply by being told lies, being forced to stay away from their own child, knowing that their child is suffering and not getting access to the correct help, financial ruin, a breakdown of your relationship, not sleeping, no support from a psychologist, being put on multiple meds, not eating, you tend to fall into a place where you see no answer but no longer being in this world. Beata knew that Maya would come home to Jack and he would take care of her too, she likely also felt that she could no longer be the Mom she wanted to be bc of feelings of depression, suicidal ideation etc. She was clearly in a dark place. The only answer then became not living anymore. It was not selfish, or to hurt anyone she loved.
Because her daughter was being held medically captive and she was blamed for that. She saw her daughter suffering and no doubt knew the only way Maya would be released out of that custody and given back to family, was if she was out of the picture. And that’s exactly what happened!!! Very shortly after her death, Maya was released back to her father. The mother was obviously overwrought seeing her daughter suffer.
Did you watch the documentary? They wouldn’t release maya to either parent because of mom. Mom took herself out of the equation so maya could at least be home with her father.
Wow aren't you ignorant pay attention before making such a comment. They wouldn't release maya endless mom wasn't in the picture they asked the husband to have the wife leave the home and stay away from her children this mother's world was falling apart when your being told you can't see your children anymore after three months they still wouldn't let mom see her kids and kept her out of the picture wouldn't allow her to even hug her daughter either at the very last court appearance before Beata hung herself she even wrote a letter stating the reasons she was going to kill herself all she wanted was for her daughter to be home and get the right treatment not suffer and literally after the mom killed herself they released Maya a few days later and the text messages from these doctors after she killed herself was even more disgusting I hope they show that in the trial as well .
Did she not have medical records for the nurses and doctor to check through for proof? Just assuming she was mistreated? I’m just now learning about all of this
Yes they had medical records and experts who diagnosed Maya. The nurse in court admitted she deliberately left out any information from other doctors and experts because she says she knows better. The family won their case.
Despicable behavior by the hospital staff. It almost seems as if they were being discriminated against for their religious beliefs. They told them they would be arrested if they left? The doctors and nurses cannot arrest them.
When the plaintiffs attorney asked about her being weened off of something. Jack said he didn’t know and said maybe ketamine. That’s wrong if you look at the medical records that the Defense presented it clearly said other drugs they were giving her not ketamine. Dr Chopra said you don’t have to titrate ketamine!!! I wish this would have been clarified by Andrews!!
If you think weaning of ketamine wasn’t part of it I’ve got a bridge to sell you. Week long coma? Insane. Mom injected sodium and hung herself pure selfish. That girl got better and is thriving today. Mom lost control and she had mental issues.
@@SAMMYBAMBAM24 According to today's testimony, Maya is NOT thriving. She is suffering right now from a relapse. She'll suffer from CRPS the rest of her life. She was also hospitalized in 2020 for a week from a relapse.
Any sedating pain medication that is received long term at extremely high and unsafe doses absolutely has to be weaned down. Withdrawal is absolutely a concern.
@@glitter7777 well by the time she was being discharged from JH she had only been on the very low doses of ketamine that the hospital gave. Also I was referring to the medical records that were presented on the screen for the jury to see. It listed the exact medications they were titrating her off of. Did you see that evidence that JH attorneys put up? During the cross of Jack?
Just one correction, its not the doctoers who didnt let maya see her mother for 3 months, its the court, they dont have that authority. Its the court , afert viewing the evidence.
The court made the decision based upon the recommendations and diagnosis the physicians made. That's the responsible decision of the courts because they recognize they are not medical professionals. So, it is in fact, the fault of the physicians.
Maybe the hospital wasn't comfortable with the fact the mother was giving her enough ketamine to knock out an elephant and putting her in comas as regular treatment. She refused any alternative treatment plan. She was forging prescriptions. The hospital knew that Maya would die from that much ketamine. The father even mentions that Maya seemed fine and healthy whenever she was was him, her brother, hospital staff and physiotherapists but whenever the mother was around immediately she was in pain and couldn't walk or sit up and just getting worse. That alone is suspicious. So the hospital wanted to monitor Maya and get her off the high doses of ketamine and continue with a different treatment plan. Now she doesn't even need a wheelchair. In cases of mbp usually the parent is very knowledgeable in medicine, usually in nursing. So what's noticeable is whenever the child is in the hospitals care, they improve tremendously but after being released the parent brings them right back because suddenly they're ill. And not just that, but another red flag is they usually will insist on invasive surgeries for the child. The mother wanted them to perform invasive surgeries on her spine. All the mother had to do was follow instructions. Maya was going to be in the hospital for three months. Two had already passed and she couldn't do thirty more days. Maya was getting better and stronger, the mother saw that, and felt like the walls were closing in, she was forging prescriptions for insane amounts of ketamine and under investigation and she probably would've lost her license. And when Maya came back in her care, how would it look for her to suddenly be so ill and wheelchair bound when she was walking, sitting up and thriving? Unfortunately documentaries are biased and serve an agenda.
As a floor nurse, EVEN IF we suspected foul play, that little girl was allowed to have her religious items. When you needed your left leg amputated and wake up to find out that you no longer have your right leg and still have your left. Doctors make alot of mistakes too. Just now this mistake from these doctors cost this poor young lady growing up with the most important person that she needed in her life 💔 now😢😢😢 growing up.
Justice for this family!!
You're no good to your daughter DEAD.
Are you watching the trial? They were treating her for that condition but after seeing her they changed the diagnosis! I believe that the hospital saved Maya’s life. Both, Maya and her mom weren’t mentally well 😢

Putting the toilet, of all necessities, out of reach to “test” her is beyond cruel. This is heartbreaking.
Yes!!! This the whole time the billing reflected what the parents and other docs said
Hi I agree with your comment.
Munchhausen not Munchhousing lol
I hope this family wins every penny they are seeking, the hospital is so negligent.
It's beyond negligent !!
All that hospital needed to do was call the two Doctors who prescribed the ketamine therapy. They failed to do that one simple thing. Instead they demonised Beata and destroyed her.
But they could be under the impression that the previous doctors prescribed the drug because they were manipulated into a wrong diagnosis.
Seriously. A simple ROI (Release of Information document) could have provided them so much.

Now that the case is over my heart hurts for Beata. Those who were involved in keeping Maya away from her parents need to be in jail.
Your last sentence is so true
The arrogance of them. I've experienced it personally.
So sorry for your son in laws situation.
I want to see the family win !!

Yeah that's fraud
This is disgusting! Drs don't know everything!
They certainly don't, many will cover up their mistakes, hoping Not to get caught. I know through family members of a couple of doctors in another State, both caught over medicating their patients to the point of death. One tried to flea the Country, both now serving time behind bars. I don't trust doctor's.
Another reason they call it practice, because they practice on us they definitely don’t know everything!

No…there were dozens of diagnosis and small percentage of CRPS which is a group of symptoms, a syndrome, not a disease.
She was receiving appropriate therapy which Is so important

Unaliving herself is so unreasonable. Don’t do that no matter how much stress you’re going through.
Yes, exactly. It's completely unreasonable and that's why the hospital was found guilty of trigerring this - you have to be going creazy with pain to do it.
On the other hand, it worked - Maya was home 6 days later.... It does look like the mother gave her life so that her daughter's suffering could end.

The family's lawyer has the most monotone voice, and seems to unprepared, unaware, so sad.
Family's lawyers have done their job exceptionally well. I think you're referring to the hospital's lawyers.
Does Docter Smit have more patients that have or are sueing her? To me it looks like she did this more often then this one case 😮
I have this mess and it's horrible
Mine, thank God is not that severe but I have to say until this case, I'd never heard of ketamine being used against it
I watched this case with great interest.
THEY WON 211 MILLION. BUT STILL FEELING THE LOSS OF THEIR MOTHER.
If maya had any chance of a normal life without addiction, the hospital ripped that away after all the trauma they inflicted on the family.
Crazy how many mistakes happened among medical staff, how many times they did not show empathy or acknowledge that beata was a nurse and her daughter had been suffering for a long time. The family was let down at every corner
So does this mean when a child kills themselves from being bullied then there is precedent to sue the bully or the bully’s family?
I’m almost 100% sure that a friend of mine who had a baby at the same time I did had her child taken by Johns Hopkins as well
Why didnt they contact Maya's doctor? I dont understand why that doctor wasnt involved? smh
They did contact him,but when he confirmed everything what Beata said they disregarded his opinion and omnitted it.

@@boomds5602 Maya's.
Yes. Maya could have been the one to die from her mother’s bad choices.
Why would you as a mother kill yourself knowing your child needs you and you need to fight for her?
I've been wondering that myself.
This is so sad.
Despicable behavior by the hospital staff. It almost seems as if they were being discriminated against for their religious beliefs. They told them they would be arrested if they left? The doctors and nurses cannot arrest them.
I watched the story last night and l felt hearbroken. No money will bring back Beata.

I bet their egos couldnt handle the mother telling them what to do
Just one correction, its not the doctoers who didnt let maya see her mother for 3 months, its the court, they dont have that authority.
