Sa liability issue on the sign and seal, if a liability act was breached or committed, how is the aggrieved party indemnified by the offending party/architect? Do architect/s have professional liability insurance to protect them from lawsuits? Thanks in advance for your reply.

William, please read Sec. 20 of R.A. 9266 of the qualifications (Read 2nd Sentence), As-built drawings is different things to be considered, under Sec. 20, 2nd sentence of R.A. 9266 An Architect may sign through the work of another architect "unless the same is made in such a manner as to clearly indicate the part or parts of such work actually performed by the former". but for the total design of another architect, the other of course is prohibited as he is not the author of the design. So "as-built" is cover under 2nd sentence of Sec. 20 of R.A. 9266.

@@Jamil1989 yes that is the general rule between two Architects in design, and it extends to the preparations of those as-builts where the original architect is not already the one who prepared the as-built, so it is detrimental for the original architect who will carry alone the liabilities set forth in Art. 1723, so in that case the other architect will also be solidary liable with the original architect.

Alfred, How about the situation like this, If there is a Lead Architect which is an International Architect who is hired by the client for the concept & Preliminary Designs and then the Local Architect will be the Architect Of Record which means He/she will sign and seal the architectural document. Hi Arch.Ramelle. My answer is "No". If the client hires the services of a foreign Architects and the business transaction happened outside the Philippines, they are governed by their own law in the practice of the profession and not the Philippine law, but if the transaction happened in the Philippines, then they are encroaching the practice of the architectural profession in the Philippine Soil, in which case, they need to register with the PRC for the STP (Special Temp Permit). If the concept and preliminary design executed abroad, and later submits by the Client to the Filipino local Architect, such shall be considered by the Filipino Architects as schemes from the Client, and since details are to be executed by a Filipino Architects and its details including signing and sealing, he is now the Architect of record of the totality of the design. I will discuss it further in my next future vlogs as it connects to anti-dummy law. Regards.

Legal ba na ang pipirma sa architect of record ay ang general contractor na licensed civil engineer? Ma apruban ba ang business permit if si engineer ang pumirma sa architect of record?
Architect of Record shall signed and sealed only by the Architect who isnthe author of the plans and specifications, the General contractor may sign only the in-charge of Construction.

May accountability ba xa pag gnun? Ano magiging problema ng client if the engineer acts as an architect of record then approved naman ang business permit?

Ang ginagawa po nila naghahire sila ng mga Professionals/Architects para magdesign ng kanilang mga projects tapos sila narin ang nagsasign and seal. Knowing na yong business man already violates the law because of accepting Architectural services without License, may violation din po ba si Architect sa pagsign and seal nya sa project ng company kahit na siya mismo ang nagdesign habang employed siya ng company? They can hire CAD operators, they will just teach the lay out or they may sketch first then give it their hired CAD drafter.. Architects, Engineers are designers in their own fields, wag natin sila e degrade to be the cad operator of other professions.

Sec. 32 of R.A. 9266 does not use the word "or", the law uses the symbol "/". Therefore, either of any of he signing and/or sealing will make you liable.
You have been a great resource. My colleagues and I are trying to hold-to-account our former employer (a non-registered foreigner), who used our designs and had another architect sign and seal the contract documents. Any advice, or resources you can give will be appreciated. More power to you.
Pinagawa ko ng Plano.ang Civil engineer ko at pinakuha ko sya ng building permit. Sya ang engineer Naka pirma sa Plano. At sa building permit. Hindi ko pa na sign ang contract namin sa pag renovate ng bahay. I decided na hindi ko na sya kukunin sa pag gawa ng bahay. Pwede po ba iyon decision ko na hindi ko na sya Kunin.? Kasi po sa binigay ko na budget sa kanya sa paggawa ng Plano at pagkuha ng building permit. E parang napamahal ako. Hindi ko pa na sign ang contract namin.
