Ethan can be controversial but he’s still always more respectable than most and I will always watch them. The whole crew has been what makes my day watching h3 more enjoyable now too. Been watching since I was a young kid and I really hope they get the money they deserve.☺️

But there is other gray area, like super-chats, which almost certainly fall under the definition of other net revenue.

It's unfair to characterize Ethan as "suing for content" -- he is ALWAYS the defendant. If he files a complaint against BBTV, it would be his first time as the plaintiff. Also, Ethan has always been sued (in my OPINION) for frivolous, anti-democratic reasons -- copyright infringement when commentary obviously qualifies as fair use; and defamation when he's simply referencing lawsuits and journalism. He is well within his bounds to clown on the people suing him. If anything, his lawsuits have been helpful as reference for other creators who might be facing similar (in MY OPINION) harassment and anti-participatory and anti-free speech intimidation tactics.

As a person who has youtube Premium, and has had it since youtube red... I technically had a Google Play subscription at that time and it included youtube Red. With that I had unlimited acces access to google podcasts, Google play music (which is now youtube music), and youtube red - add free yt and premium creator content. At some point the name switched and it automatically changed to a "youtube premium" acct.. I did not have to sign up again/separately. I still have all the same content as I had when ethans contract was written. I also have had individual subscriptions to different youtubers (specifically cristine and emily d baker) and those are charged separately of my youtube premium account. They are called channel subscriptions and in my mind... I clasify that very differently than my Google subscription(now called youtube premium) What i heard described in Ethans contract sounds like it would cover my youtube premium but i dont think the verbiage in the contract sounds like it should cover individual subs to specific creators.
Im assuming the views from people with YT premium is a separate chunk of a creators YT earnings. My guess is the MCN was hoping to bank off of a massive increase in people wanting to have YT premium subscriptions... but unfortunately YT premium creator content didn't have the pull that Google hoped it would in gaining subscribers.
I haven't seen the Tetris movie but there's a channel called Gaming Historian that did a good video about the history of the licensing of the Tetris game.

It sounds like the subscriptions should have been solely the creators money based on that contract. It doesn’t fall in the “other” category. It is clearly a Google net revenue.
Yeah, it’s not to suggest that H3 are responsible for making sure their business partner isn’t stealing from them, but if it was clearly disclosed that first month they turned on memberships they could have claimed breach and resolved this without hundreds of thousands of dollars on the line.

FAMILY! I really don’t know if i totally agree with the idea that ethan is doing this for content. I think he sees this as someone else trying to take advantage of another “dumb youtuber”. He’s always voiced how malicious MCNs are because he has seen what they do to other creators. He didn’t see this coming for him bc the contract is clear and the membership money is not fair ground for BBTV. Maybe it’s not the SMARTEST move to go joker mode, but he’s emulating exactly how all the other creators felt when they were screwed over. The others coming forward saying how they were taken advantage of is definitely fuel for this fire. Ethan’s about standing up for what’s right and this is the ethan way of doing it. Anyways, cue the soundboard- what are we gonna do about it

I actually discovered H3H3 because of Ben back before they were famous. Ben mention them for something don’t recall I looked them up and I became a fan. Back when they lived in New York in a small “apartment”

All contracts are sketchy with fine print (esp loans). You have to read/learn and be your own advocate. Glad you guys nvr signed because you guys managed to evolve (though I miss old Simply antics), create the podcast/stream, and ofc HT. MCNs don't survived long term and most of those content creators c. 2013-16 are rarely on YT anymore unless they regained controll. The ones who benefit the most are the C level of the MCN. Tetris showed how tech evolving made media law more difficult. Would've wanted to see the closed door lawsuit too NYT had an article about ebooks and how publishers can revise content whenever because you don't own the purchase.
I 100% agree about the Tetris movie. I kinda resent how every video game-related movie feels the need to randomly insert pixel graphics and 8-bit sound effects just because it's about gaming. I would have appreciated a more grounded-in-reality take on the story instead of putting in random car chases and sexy KGB agents turning coat and pulling guns.
When the YT membership came online, they should have went to the contract to add an addendum to it. They didn't even bother to contact their contractees. However, it clearly states in the contract TH-cam and Google revenue goes 100 percent to H3. The memberships come directly from TH-cam and are NOT a third party. They are at fault in two different points. They didn't review and renew the contract with the Klein's and then they proceeded to take Google income.
i feel like this lawsuit/situation specifically was important for ethan to make public. mostly considering that the money they are taking is money the viewers are choosing to give to H3, not just passive viewers who generate ad revenue. but people who are specifically choosing to give money every month to support the creator/crew. as a member of H3, i appreciate the transparency on where my money was actually going. and it’s very frustrating to learn that a portion of my monthly payment is going to a bad faith company who made no effort to generate an additional agreement on this new source of income (memberships). i also feel ethan’s use of his platform to show the inner workings of lawsuits helps especially small creators to show that they have legal standing. that they don’t have to take bullying from big corporations lying down. not to mention how many smaller creators would never have known bbtv was doing this to their channels had ethan not made this information public. all in all, i will always appreciate ethan’s transparency whether i agree with him or not.

I clasify that very differently than my Google subscription(now called youtube premium) What i heard described in Ethans contract sounds like it would cover my youtube premium but i dont think the verbiage in the contract sounds like it should cover individual subs to specific creators.
Im assuming the views from people with YT premium is a separate chunk of a creators YT earnings.
My guess is the MCN was hoping to bank off of a massive increase in people wanting to have YT premium subscriptions... but unfortunately YT premium creator content didn't have the pull that Google hoped it would in gaining subscribers.

I haven't seen the Tetris movie but there's a channel called Gaming Historian that did a good video about the history of the licensing of the Tetris game.
I think back then they were also not financially at the point they are at now so missing 2 weeks was more detrimental at that time to them.
But to sign up with some company for years to come over a possibility of it taking two weeks is very dumb. Most of us have been in situations where we’ve not had a paycheck for a longer time than that. I think they were young and dumb and got taken advantage of
@@bish_puddin I don’t disagree that people have struggled for longer I was just noting that it wasn’t from a perspective financially of where they are now. Also still doesn’t justify what the company is doing which I believe is against their own contracts terms.
I know Ethan isn't innocent and has said and done some things I haven't agreed with *but* he and his wife have always seemed like genuinely good people. I haven't watched them in forever so glad I have this to catch me up on what is going on 😂

He also said he would be more scared of a black security guard than a white one. And recently his comments about top/bottoms in the gay community were just homophobic, plus he seems confused about trans people so he constantly makes jokes that people find horrendous. Which is why it should be no mystery to why people hate ethan

It sounds like the subscriptions should have been solely the creators money based on that contract. It doesn’t fall in the “other” category. It is clearly a Google net revenue.

Yeah, it’s not to suggest that H3 are responsible for making sure their business partner isn’t stealing from them, but if it was clearly disclosed that first month they turned on memberships they could have claimed breach and resolved this without hundreds of thousands of dollars on the line.

ben got it a bit wrong about ethan suing for content, hes never sued anyone before. weirdos have tried to sue them over nothing though and h3 set a huge legal precedent when it came to fair use on youtube back in the day. id love if you guys and h3 ever did a collab or if you got on their pod. i think it would be fun.

FAMILY! I really don’t know if i totally agree with the idea that ethan is doing this for content. I think he sees this as someone else trying to take advantage of another “dumb youtuber”. He’s always voiced how malicious MCNs are because he has seen what they do to other creators. He didn’t see this coming for him bc the contract is clear and the membership money is not fair ground for BBTV. Maybe it’s not the SMARTEST move to go joker mode, but he’s emulating exactly how all the other creators felt when they were screwed over. The others coming forward saying how they were taken advantage of is definitely fuel for this fire. Ethan’s about standing up for what’s right and this is the ethan way of doing it. Anyways, cue the soundboard- what are we gonna do about it
Ben’s assessment that is is for content was the finale to his consistent need to find blame onto Ethan and Hila through this whole podcast. He’s trying to add nuance where there just wasn’t. Even Christine said “Is there any grey area?” to him reaching at straws over the contracts.

MCNs don't survived long term and most of those content creators c. 2013-16 are rarely on YT anymore unless they regained controll. The ones who benefit the most are the C level of the MCN.
Tetris showed how tech evolving made media law more difficult. Would've wanted to see the closed door lawsuit too

I 100% agree about the Tetris movie. I kinda resent how every video game-related movie feels the need to randomly insert pixel graphics and 8-bit sound effects just because it's about gaming. I would have appreciated a more grounded-in-reality take on the story instead of putting in random car chases and sexy KGB agents turning coat and pulling guns.

When the YT membership came online, they should have went to the contract to add an addendum to it. They didn't even bother to contact their contractees. However, it clearly states in the contract TH-cam and Google revenue goes 100 percent to H3. The memberships come directly from TH-cam and are NOT a third party. They are at fault in two different points. They didn't review and renew the contract with the Klein's and then they proceeded to take Google income.

i feel like this lawsuit/situation specifically was important for ethan to make public. mostly considering that the money they are taking is money the viewers are choosing to give to H3, not just passive viewers who generate ad revenue. but people who are specifically choosing to give money every month to support the creator/crew. as a member of H3, i appreciate the transparency on where my money was actually going. and it’s very frustrating to learn that a portion of my monthly payment is going to a bad faith company who made no effort to generate an additional agreement on this new source of income (memberships). i also feel ethan’s use of his platform to show the inner workings of lawsuits helps especially small creators to show that they have legal standing. that they don’t have to take bullying from big corporations lying down.
not to mention how many smaller creators would never have known bbtv was doing this to their channels had ethan not made this information public. all in all, i will always appreciate ethan’s transparency whether i agree with him or not.
